Cox, City Clerk RE: Delinquent Sewer and Water Bill DATE: August 5 , 1983 Introduction On July 13 , 1983 the SPUC requested the Council to put the unpaid sewer and water bill of John Nelson on the property taxes for collection. Background The Commission had three alternatives and chose to ask the City to put the delinquent bill on the property taxes because most of the bill was for sewer charges . A motion to put Mr. Nelson' s unpaid water and sewer bill on his taxes payable in 1984 was tabled at the August 2nd Council meeting. For your information, neither SPUC nor the City fee resolutions adopt a fine for delinquency of water/sewer bills , SPUC had adopted a fine for delinquent electric bills . The unpaid sewer and water bill is for the period of time from September 20, 1982 to December 17 , 1982 in the amount of water-$81 . 70 and sewer-$248 . 32 for a total of $330.02 . Alternatives 1 . Put delinquent bill on the property taxes ; pursuant to request of SPUC - interest could be charged at the legal rate from date of delinquency through December 31 , 1984. 2 . Mr. John Nelson is the owner of an apartment building in the North West corner of Co. Rd. 17 at Shakopee Ave. That building has a single water meter billed to the owner. In Janaury 1983, Mr. Nelson questioned his water and sewer bill for the previous 3 month period. A meeting between SPUC staff and Mr. Nelson did not resolve the problem, nor did a subsequent meeting between the Utilities Commission and Mr. Nelson resolve it. We have been informed by Mr. Nelson that he does not intend to pay a portion of his water and sewer bill in the amount of $330.02. The Shakopee Public Utility Commission has several alternatives available: A. Turn off the water supply. (But this would inconvenience the buildings tennants who would be caught in the middle) B. Have our attorney take the matter to court (Costly.) C. Rgquest that the City Council put the unpaid water and sewer charges on the property taxes. In view of the special circumstances in this case, and the fact that most of the unpaid bill is for sewer charges, the Utilities Commission requests the City Council to put the unpaid bill on the property taxes for collection. Coller, II, City Attorney Re: Collection of Delinquent utility bills Date: August 5, 1983 BACKGROUND The Shakopee Public Utility Commission has a delinquent account for utilities furnished by municipally operated plantand requested City Council to put the delinquent matter on the tax rolls to be collected with the taxes during the next calendar year. REMEDIES: The Utility Commission has the power to fix rates and to adopt reasonable rules and regulations for utility services supplied by a municipally owned public utility. MSA 412.361. Commission also has the power to discontinue service for non-payment by water users including the expenses of meter installations. Opinion of Attorney General 624-D-5 June 17, 1957. The governing body of the City upon request by the Utility Commission may make any delinquent charges against the owner, lessee, occupant or all of them, and provide for certifying the unpaid charges to the County Auditor with taxes against the property served for collection as other taxes are collected. MSA 444.075 Subd 3 It would be my opinion that to this delinquent account could be added interest at the legal rate of interest from the time of the delinquency up to the end of December of the next year and certifying the delinquency as a tax to be levied. It should be noted though that the discontinuing of service apparently applies only to water and light, but not to sewer. There/ot course also the other obviously available remedy - suit. The question was further asked at the Council Meeting - whether the City Council could institute any of the above remedies,and in my opinion, in an emergency or in the failure or refusal of the Commission to act,the City by Council authorization could act, but only in the limited are. _bove -ferred to. These were reviewed by Council staff members in June and July and revised again. I am now sending these guidelines to you for comments. Please call me by August 16 with any comments. I may schedule a meeting in mid-August for all of us to discuss these if it seems warranted. Otherwise, I intend to make final revisions based on your comments and send them to the Council August 25 to adopt them for public hearing the end of September. PHTRN2.DE083A • 5. Loans will be made only for the purchase of property from a willing seller, not by condemnation. 6. Property to be acquired must have a clear title. - 7. Applications will be considered as they are received, not on a periodic funding cycle. Procedural Guidelines The following procedure is proposed for loan applications: 1 . The applicant submits for preliminary Council approval an application including, as a minimum: a. Resolution of local jurisdiction authorizing loan application and purchase of property. b. Statement of need to acquire property, including evidence regarding imminent conversion. c. Amount of loan requested. d. Map and legal description of land. e. A statement on the applicant's eligibility to incur this debt. (See attached) . 2. For state trunk highways, Council staff will forward the application to Mn/DOT for advisory comments within 30 days. At this time, Mn/DOT will have the option to acquire the land itself. 3. Within 75 days from receipt of preliminary application, the Council will consider the application, including any Mn/DOT comments, and will either disapprove or give preliminary approval and authorize further negotiations by the municipality. 4. After receiving preliminary approval the muncipality will obtain and submit to the Council, as a final application, an appraisal (2 appraisals if purchase price is over $100,000) made by a bona fide appraiser who meets Mn/DOT's minimum qualifications and a purchase agreement or option to purchase. 5. For state trunk highways Council staff will forward the final application to Mn/DOT for comments on the appraisal and fair market value of the land. Mn/DOT will have 30 days to comment. 6. Final Council approval or disapproval of the loan. Other Guidelines After Council approval of a loan application, Council legal staff will prepare a loan agreement which will include at least the following points and any others the Council might specify as a condition of approval. The law, which is attached, is fairly specific regarding eligibility and procedures . However, certain aspects require more clarification so it is necessary that the Metropolitan Council prepare guidelines for distribution of these funds. The funds will be available by July. • The following is an outline of suggested guidelines and the issues, if any, around each guideline which need further discussion. These guidelines were revised after meeting on May 3 with Mn/DOT and staff members of cities likely to use the program, and on June 1 with Mn/DOT R-O-W and legal staff. Eligibility Guidelines 1 . Any county, town or statutory or home rule city within (or partially within) the 7-county metropolitan area is eligible to apply for a loan. Minnesota Department of Transportation is not eligible. 2. Loans are for the purchase of property within the proposed right-of-way of a state trunk highway shown on an official map adopted pursuant to section 394.361 or 462.359, or for the purchase of property within the proposed right-of-way of an interstate freeway or major arterial highway designated by the Metropolitan Council as a part of the metropolitan highway system plan and appproved by the Council pursuant to subdivision 1 . 3. The Council shall make loans only to avert the imminent conversion or the granting of approvals which would allow the conversion of property to uses which would jeopardize its availability for highway construction. ISSUE: Determination of "imminent conversion." Should this be further defined in the guidelines or determined on a case-by-case basis? 4. The Council shall not make loans for the purchase of property at a price which exceeds the fair market value of the property. The loan applicant should submit an appraisal that is acceptable to Mn/DOT. 1 . Loans bear no interest. 2. A private property owner may elect to receive the purchase price either in _ a lump sum or in not more than four annual installments without interest on the deferred installments. If the purchase agreement provides for installment payments, the Council shall make the loan in installments corresponding to those in the purchase agreement. 3. Loans shall not cover relocation costs of persons or property, although all sellers are legally entitled to relocation costs. 4. The recipient of an acquisition loan shall convey the property for the construction of the highway to the constructing agency at the same price which the recipient paid for the property. 5. In the event the loan recipient is also the highway constructor (i.e. a county highway) the loan shall be repaid at a time prior to actual construction as specified in the loan agreement. 6. Loan recipients shall submit an annual report by June 30 on the status of the loan. A status report on the revolving fund will be prepared for the Council by staff prior to August 31 every year to assist the Council in determining a levy amount by October. paring this status report. 7. Upon notification by the Council that the plan to construct the highway has been abandoned or the anticipated location of the highway changed, the recipient shall sell the property at market value in accordance with the procedures required for the disposition of the property. ISSUE: What procedures for disposition of the property? Are these commonly accepted or do we have to define some? 8. All net rents and other money received because of the recipient's ownership of the property and ,all proceeds from the conveyance or sale of the property shall be paid to the Council. ISSUE: When? Within 30 days of recipient's receipt of rents and proceeds? 9. Every consideration should be given to renting and maintaining acquired improvements (including buildings) in a manner compatible with the surrounding environment until full project acquisition. ISSUE: If rents received must be paid to the Council how would buildings be maintained in a rentable condition. Financial 1 . The Metropolitan Council finance department will handle receipt and dispersal of funds according to its usual procedures. 2. In general, the revolving fund will not contain a balance higher than twice the amount produced by a .05 mill levy. The amount levied for 1983 ( .05) will produce an initial 1983 balance of slightly over $1 million (received in two payments) . Comments on the Relationship to Local Government Debt, and to Eligibility. Inasmuch as there appears to be no statement which excludes the debt incurred for these R-O-W purchases from the legal limitation on the debt of cities, counties and townships, the legal limitation would be applicable. Except for cities of the first class, the net debt of the cities, towns and counties cannot exceed 6-2/3 percent of their assessed valuations. Therefore, a guideline should be included which requires a statement concerning the eligibility of the unit of government to incur the debt. The statement should show: a. The assessed valuation of the unit of government as of the preceeding January 2. b. The outstanding debt of the unit, less debt which is excludable from the net debt limitation, less sinking fund balances on hand which are applicable to the debt balance which remains. See the attached sheet for the suggested form of the statement. Line 1 : Name of the applying city or township. 2: Name of the county in which the applying city or township is located, or the name of the applying county. 3: Date of the application. 4: Amount of the assessed valuation and the date of the valuation. The date is very important if the application is filed in April, May, or June, because the unit may be completing its work on calculating the current year's valuation, but the previous year's valuation may be the official amount. 5: This should be a date early in the month, which would indicate that the debt service payments due on the first of the current month have been paid and are not included in the amount shown, and those payments which are due on the first of the succeeding month have not been transmitted to the paying agent. 6: The amount of indebtedness outstanding at the date shown in (5) . 7: There are various types of municipal debt which are excludable from the calculations for the net debt limitation (listed in Minn. Stat. 475.51 , Subd. 4) . Examples are special assessments and revenue debt. 8: Line (6) minus line (7) . 9: The unit will usually have some cash on hand in a debt service fund for each bond issue that is outstanding. This line should only include cash balances for those bond issues which are included in the amount on line (8) . In other words, any debt shown on line (7) should not be represented by a sinking fund amount on line (9) . 10: This should be the net amount of the debt which is subject to the limitation. In other words, all the excludable debt has been removed and all of the cash on hand has been removed so that only the eligible debt retirement funds which the unit has yet to collect are subject to the limitation. 11 : This should be the same amount as line (4) . (If, on some occasion, it is appropriate to use an estimated amount, that estimated amount should be shown here with an appropriate notation that it is an estimated amount, the date of the estimate, the basis for the estimate, and the reason for using the estimated amount rather than the certified amount). 12: The result of the calculation of multiplying the asssessed valuation by 6-2/3 percent. This would be the limitation, should there be no limiting debt outstanding. 13: Same as line ( 10). 14: This is the limitation itself which is derived by subtracting line ( 13) from line ( 12). The clerk of the applying city or township should sign the application. The auditor is the appropriate official for a county application, except that, to the best of my knowledge, Hennepin County has done away with the office and the Finance Director may be the appropriate officer. Never before has this come to my attention during the complete history of the Shakopee Municipal Swimming Pool. Lately some little kids have been "crapping" in the pool. Apparently a very obvious example of this happened yesterday and has caused the problem to come to a head. A young mother dragged her infant out of the premises with the obvious problem:: staring all observers in the face. The pool Manager has asked for., and has received my,permission to immediately tell mothers tor others ) entering the pool with a youngster wearing diapers under their swim suit that from now on they must also wear rubber pants. Hopefully, this will help. They also will try to figure something else out such as signs etc which might help. George F. BE IT RESOLVED BY THE SHAKOPEE PUBLIC UTILITIES COMMISSION, In regular meeting assembled on the 8th day of August, 1979, That the following water rates shall be, and hereby are established for all users of water furnished by the City of Shakopee through the Shakopee Public Utilities Commission, to- wit: Section: The first 6,000 gallons - $4.00 Next 14,000 gallons - 554 per 1,000 Next 15,000 gallons - 50 per 1,000 Next 25,000 gallons - 40 per 1,000 All over 60,000 gallons - 354 per 1,000 Minimum bill - $4.00 for (3) three months Water meters will be read quarterly, in March, June, September and December. The new water rates will be used and will be effective under the December, 1979 billing covering the previous three months, and thereafter.
