Request of Kue Contractors, Inc. for Extended Work Hours on New Fire Station ProjectCITY OF SHAKOPEE Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Kris Wilson, Assistant City Administrator SUBJECT: Request of Kue Contractors, Inc. for Extended Work Hours on New Fire Station Project DATE: July 19, 2011 Kue Contractors, the contractor building the new Fire Station, has requested that City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, be suspended for certain work hours. IMMMOM11TRY9 The above named section of the City Code restricts the hours of operation from 7:00 A.M. to 10:00 P.M. on weekdays, and from 9:00 A.M. to 9:00 P.M. on weekends and holidays. Kue is requesting a suspension on the hours to allow for work to begin at 6:00 a.m. on weekdays thru August 5, 2011. This request is being made to help expedite the work which has fallen slightly behind schedule and to allow for work to start earlier in the day during these warmest weeks of the summer. Work is currently centered around the hose tower section of the building on the far western side. The new station has no neighbors to the north, west or south, but there are a few residential properties to the east. Staff would recommend that if the suspension of hours is granted, that the approval is subject to the following conditions: 1. Approval is contingent upon minimizing noise exposure. 2. If property owner complaints are received by the City, the suspension can be revoked at the discretion of the City Administrator. If Council approves the suspension, a public notice to meet the City Code requirements and notice such as a news release or Council minutes would be placed in the Shakopee Valley News. RECOMMENDATION: Staff recommends approval of the suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, to allow work on the new fire station to begin at 6:00 a.m. on weekdays, through August 5, 2011. ACTION REOUESTED: If the Council concurs, it should offer a motion approving the suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, to allow work on the new fire station to begin at 6:00 a.m. on weekdays, through August 5, 2011, and direct staff to publish notice of the suspension terms with the conditions as recommended by staff.
