Introduction
The City Council is asked to consider the attached resolution, approving the City's 2010 Pay
Equity Compliance Report and directing staff to submit the report to the State of Minnesota.
Background
In 1984, the State of Minnesota adopted the Local Government Pay Equity Act (M.S. 471.991 --
471.999) requiring local governments to establish equitable compensation relationships for male
and female classes of employees in order to eliminate sex -based wage disparities in public
employment. Local governments across Minnesota are required to file a complex compliance
report with the state's Department of Employee Relations once every three years.
The City of Shakopee is required to report data for calendar year 2010 and must submit its report
to the state no later than January 31, 2011. The data in the report reflects wage levels and
employment numbers as of December 31, 2010. All positions where an employee worked an
average of 14 hours per week or more and at least 67 calendar days (100 days for full -time
students) are considered "reportable ".
The report is completed by entering data on the number of male and female employees in each
job class (i.e. Police Officer, Secretary, Lifeguard, etc.), the minimum and maximum monthly
salary for each job class, and the total number of points assigned to the position by our job
evaluation system. This data is entered into an online software program provided by the state.
The software then generates a variety of statistical reports and the results of several key
statistical tests are used to determine whether or not we are in compliance with the law.
Upon reviewing our payroll data for 2010 earlier this week, I discovered that this year four part-
time positions are reportable under Pay Equity for the first time. Unfortunately, because we have
never had to report these positions before, they were never reviewed under our job evaluation
system and therefore lack the necessary numeric score to be entered into our pay equity report.
In order to correct this situation, written descriptions of the duties, minimum qualifications and
working conditions for each of the four positions has been sent to consultants at Springsted for
their review. Once they complete the evaluation, they will forward us the numeric scores for
each of the positions and we will finalize our Pay Equity report. All of this must be completed
prior to January 31.
The four positions are:
1. Recreation Coordinator (1 reportable employee) — a position that provides additional
coordination for the Community Center and/or Aquatic Park during the peak summer
season for Park & Rec activities. This position was more fully utilized in the summer of
2010 due to the vacancy in the full -time Recreation Supervisor position that occurred in
late May.
2. Maintenance Laborer (1 reportable employee) — this is a 12 hr. per week position
cleaning the Community Center the two nights of the week that our full -time Custodian
has off. However, we utilized this employee to cover for enough sick and vacation leave
in 2010 that his average hours per week calculated to 14.07 for the year, thereby making
this a reportable position.
3. Teen Center Supervisor (1 reportable employee) — a part-time position held by
numerous employees, however, one employee worked sufficient hours to become
reportable under Pay Equity.
4. Paid - on - Call Firefighter — the City has never before needed to report this position under
the Pay Equity statute, but again, our reliance on these employees increased in 2010 to
the point that a handful of our 43 firefighters averaged more than 14 hrs. per week over
the course of the year.
In addition to completing the number crunching and data entry by January 31, the Pay Equity
report must also be approved by the City Council and signed by the Mayor. In order to meet this
deadline, Council has two options:
1. Approve the report with the understanding that reporting data for 4 additional part -time
positions will be added and authorize the Mayor to sign the report on behalf of the City at
that time. The report would then be submitted to the state on or before January 31 and
retroactively approved in its final form at the February 1 City Council meeting.
2. Schedule a special Council meeting for Thursday, January 27 to approve the report in its
final state.
Based on the test reports I have generated through the software and my understanding of the
compliance tests, I expect the City will be found in compliance with the law even after adding
the four part-time positions.
Requested Action
If the Council is comfortable with staff completing the reporting for the 4 part -time positions and
the Mayor signing off on the document at that time, then Council is asked to offer Resolution
No. 7080, a resolution approving the City of Shakopee's 2010 Pay Equity Compliance Report
and authorizing its submittal to the State of Minnesota.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE,
MINNESOTA, that the City of Shakopee's 2010 Pay Equity Compliance Report is hereby
approved.
BE IT FURTHER RESOLVED, that the Mayor is authorized to sign and the City
Administrator is directed to submit the report to the State of Minnesota no later than January 31,
2011, in compliance with the City's obligations under the Local Government Pay Equity Act
(M.S. 471.991 to 471.999).
Adopted in adjourned regular session of the City Council of the City of Shakopee,
