SUBJ: Authorizing Payment to Scott County and Special Assessments on Parcel 75

Introduction & Background
The city owes MDOT $520,883 for the linear drainage ponds along HWY 169. A combined
agreement in 2010 between the state, county and city provided for the city to pay the $520,883
to the county instead of the state. The city has received quit claim deeds for the land and an
invoice from the county.
Closure on MDOT parcel 75 in Southbridge has taken over 15 years. Parcel 75 is a remnant
parcel from land acquisition for the 169 bypass. The City was to receive the whole 50 acre parcel
but the state is now retaining 5 acres for ROW.
Previously, City Council decided to pay the special assessment for Southbridge Parkway on
parcel 75 (principal only) from the Park Reserve Fund to the Capital Improvement Fund upon
receiving title from the state. City Council does have the discretion to write off the assessments
and keep the money in the Park Reserve Fund. There are no outstanding bonds for the project.
Action
Move to approve payment to Scott County pursuant to the cooperative agreement regarding
the Lewis Street bridge ( #4175) in the amount of $520,883 from the Storm Drainage Fund and to
pay the principal balance of the special assessment due on parcel 75 in the amount of
$368,441.17 from the Park Reserve Fund.
