SUBJECT: Discussion of 211 Shumway Street Septic System Replacement

INTRODUCTION:
Recently, the individual sewage treatment system located for 211 Shumway Street has failed and
needs to be replaced per Scott County ordinances. Staff would like to discuss with City Council
on whether to allow replacement of the septic system or to consider a sewer and water project for
this area.
BACKGROUND:
In the area at 211 Shumway Street, the sanitary sewermain or watermain is not extended to the
property. Recently, the septic tank has collapsed at this property and the determination by Scott
County is that a new system is required in order to meet code. The property owner of 211
Shumway Street owns Lots 9 and 10, Block 35.
In this area, there is sanitary sewer and watermain at 2nd Avenue and Apgar Street and there is
watermain at 3rd Avenue and Shumway Street. It appears than sanitary sewer could be extended
to serve the property at 211 Shumway Street, although this would need to be determined through
a preliminary engineering study.
One of the main issues in why this property has not been served with sanitary sewer and water in
the past is that the watermain would need to be looped from 3rd Avenue and Shumway Street to
2nd Avenue and Apgar Street. In this area, the corner lot at 2nd and Apgar and two lots on
Shumway Street near 3rd Avenue are already served with sewer and water and thus could not be
assessed for any future improvements. Another factor in why this area has not been served with
sewer and water in the past is that the limestone is very close to the surface in this area and
would require rock excavation in order to install utilities.
Shakopee Public Utilities did discuss this particular area at its September 7, 2010 meeting and
the main discussion was to possibly remove the shared water services off of 3rd Avenue serving
two houses on Shumway Street. Shakopee Public Utilities did indicate the possibility of
contributing to watermaln looping to remove deficient services in this area, if there was a project
by the City of Shakopee. Another consideration in this area is that there would be additional fire
protection provided by a loop system along Shumway Street and 2nd Avenue.
Discussion of this issue is to decide whether or not to allow a replacement an ISTS system for
the house at 211 Shumway Street or to consider bringing sanitary sewer and water into this area.
If the Council decides that a preliminary engineering study is needed to make a final decision on
whether to bring sewer and water into this area, staff would recommend preparing the
preliminary cost and to do a benefit appraisal analysis to determine the benefit of sanitary sewer
and water to assessable lots in this area. If Council decides to have a preliminary study
performed, staff would bring back a resolution to be approved at the next Council meeting in
order initiate the proceedings.
If a preliminary engineering study is desired, the resident will need to fix the existing tank for the
winter months. Scott County has indicated that a holding tank could be allowed for a certain
period of time.
ALTERNATIVES:
1. Approve a motion to allow a replacement ISTS system for the house located at 211
Shumway Street.
2. Direct staff to prepare a resolution to initiate a preliminary engineering study for sanitary
sewer and water along 2nd Avenue and water along Shumway Street, from 2nd Avenue to
3rd Avenue.

RECOMMENDATION:
Staff would recommend Alternative No. 2 if the council wants to serve this area with sewer and
water and in order to obtain a preliminary cost estimate to determine. the amount. of funds that the
City would have to expend in order to have sewer and water in this area.
ACTION REQUESTED:
Direct staff to prepare a resolution to initiate a preliminary engineering study for sanitary sewer
and water along 2nd Avenue from Apgar Street to Shumway Street and water along Shumway
Street, from 2nd Avenue to 3rd Avenue.
