DISCUSSION
On December 9, 2003, the Shakopee City Council approved the Planned Unit Development
(PUD) for Dean Lakes. The PUD approved the development plan for a mixture of commercial,
residential, and business park uses on approximately 270 acres. The subject property is located
south of Hwy 169 and east of CSAH 83.
Ryan Companies, property owner, has submitted a PUD amendment request asking the City to
consider allowing approximately 60 acres of property for agricultural purposes. The approved
PUD plan designates the area for business park development. The property owner is making
this request due to the current lack of activity in the marketplace.
The application for PUD amendment was received by the City on September 9, 2010. Minnesota
Statute 15.99 allows the City 15 days to review the application materials, determine whether or
not the application is complete, and notify the applicant of staff's determination. The application
is incomplete at this time due to the absence of crucial application materials. Staff is utilizing the
15 day review period to further research appropriate process and additional information that is
necessary to adequately review the request once a complete application is made. This
information and process will be provided to the applicant in the 15 day letter provided to them
during the review period.
In reviewing the active PUD Agreement for Dean Lakes, staff finds that Article 18.6(b) states
that "The Council shall have sole discretion to determine whether a public hearing is required
for any amendment".
Staff is recommending that the City Council determine that a public hearing is required for this
amendment, should a complete application be filed with the City.
Reasons for staff's recommendation include 1) the area immediately to the south and east of
property proposed for farming has been developed as residential neighborhoods consistent with
the approved PUD plan. Conducting a public hearing would allow residents of the area to be
active participants in the review process; and 2) staff is concerned that the act of farming the
property is inconsistent with the conservation/ecological development that was carefully
scrutinized and crafted through the 2003 approval process.
ALTERNATIVES
1. Require that the PUD Amendment be subject to a public hearing before the Planning
Commission with final review by the City Council (standard process for PUD
Amendments).
2. Require that the PUD Amendment be subject to a public hearing before the City Council
with review and a recommendation provided by the Planning Commission.
3. Do not require a public hearing for the PUD Amendment but do require review by the
Planning Commission and City Council.
STAFF RECOMMENDATION
Staff recommends that the PUD Amendment be subject to a public hearing before the Planning
Commission with final review by the City Council (Alternative No. 1 }.
ACTION REQUESTED
Offer a motion consistent with the wishes of the Coun~l, and move its-adoption.
