Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Mark Noble, Planner II SUBJECT: Request of Riverland Ag Corp. for Extended Working Hours DATE: September 7, 2010 INTRODUCTION: SM Associates Construction, LLC, contractors working for Riverland Ag Corp., 3251 County Road 101 East, has requested that City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, be suspended for certain work hours. BACKGROUND: SM Associates Construction has begun construction of the grain storage bins for Riverland Ag Corp., and due to certain construction procedures and efforts, they have requested that they be allowed to work from 5:00 A.M. thru 10:00 P.M. on weekdays and weekends until the project is complete (scheduled for completion in January, 2011 -see attached letter from Dan Jenniges). The above named section of the City Code restricts the hours of operation from 7:00 A.M. to 10:00 P.M. on weekdays, and from 9:00 A.M. to 9:00 P.M. on weekends and holidays. Staff would recommend that if the suspension of hours is granted as requested, that the approval is subject to the following conditions: 1. Approval is contingent upon minimizing noise exposure. 2. If property owner complaints are received by the City, the suspension can be revoked at the discretion of the Community Development Director and/or the Public Works Director. If Council approves the suspension, a public notice of the nature and limits of such suspension shall be placed in the Shakopee Valley News. Michael Leek Community Development Director 129 Holmes Street South Shakopee, MN 55379 RE: Riverland Ag Corp ~ Shakopee, MN Construction Working Hours Dear Mr. Leek Proj. # 09131 We are constructing a project for Riverland Ag Corp located at 3251 Cty Rd 101 E, Shakopee, MN. The construction project consists of placing concrete foundations and erection of grain storage bins & equipment. The duration of this project will continue through January 2011. In effort to serve our customer needs and the deadlines set forth in the. construction agreement, it maybe necessary to develop working hours that will be in violation of City Ordinance 10.60; {City Noise Elimination and Noise Prevention). Certain construction procedures and efforts, specifically scheduling around severe weather and temperatures, may require sporadic scheduling that conflict with the city ordinance listed above. In addition, construction scheduling may require earlier start times and weekend performance to complete the project in a timely manner. Due to the time of year and efforts required to construct a successful project for Riverland Ag Corp, we are requesting allowable working hours for the duration of the project to be from 5:00 am thru 10:00 pm; both weekdays and weekends until the project is complete.
