Michael Leek, Community Development Director SUBJECT: One Year Change in State Surcharge for "Permits Based on Fixed Fees" MEETING DATE: August 5, 2010 INTRODUCTION: The Legislature changed for one year the state surcharge for permits that are based on fixed fees. The surcharge increases from a base minimum fee of $0.50 to a base minimum fee of $5.00. The change is effective from July 1, 2010 to June 30, 2011. By the attached ordinance, City Council is asked to amend the adopted City Fee Schedule to conform with the change. RELATIONSHIP TO CITY GOALS: This item falls under F. Housekeeping item. ACTION REQUESTED: Offer and pass a motion approving Ordinance No. 834, amending the City's Adopted Fee Schedule to increase the minimum state surcharge for permits based on fixed fees. R. Michael Leek Community Development Director H: \CC\2010 \state surcharge report_08052010.doc 1 ORDINANCE NO. 834, FOURTH SERIES AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA, AMENDING THE CITY'S ADOPTED 2010 FEE SCHEDULE RELATING TO STATE SURCHARGES WHEREAS, the City Council has determined that it is desirable to modify the 2010 Fee Schedule to be consistent with state surcharges that were changed by state law and became effective July 1, 2010. THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA DOES ORDAIN: SECTION 1 — The Adopted 2010 City Fee Schedule for the following permits is hereby amended by increasing the state surcharges from a minimum of $0.50 to a minimum of $5.00 for the following permits: Plumbing Permits Plumbing, Heating and Electrical Permits Heating, Air Conditioning, Refrigeration, and Ventilation Permits Gas Piping Permits Fire Protection Equipment Permits SECTION 2 — This ordinance becomes effective from and after its adoption and publication. Adopted in regular session of the City Council of the City of Shakopee, Minnesota, held this day of August, 2010. When permit application has been reviewed and processed there will be a minimum plan review fee assessed if applicant chooses to significantly change, alter, or abandon application /plans. State Surcharge: Building Permits The Minnesota Statutes $ 326B.148 "SURCHARGE" has been changed for one year effective July 1 2010 until June 30, 2011. The change only applies to the "Permits based on Fixed Fees Part 1" and "Permits based on Fixed Fees, Part 2" portions of the Minnesota DeRartment of Labor and Industry's (DLI) surcharge reporting form. The minimum surcharge for a "fixed fee" permit is $5, beginning July 1, 2010. No. 2604) a) Commercial /Industrial .005 x value, or $500.00, whichever is greater b) Residential .005 x value, with a $750.00 maximum 100% of the fee shall be refunded when a final certificate of occupancy is issued. 2) Landscaping Escrow: A $1500.00 escrow will be required, for landscaping and will be refunded in whole to the Applicant when landscaping requirements have been completed. 6 3) Erosion Control Escrow: A $1000.00 escrow will be required in order to guarantee the installation and removal of all required erosion and sediment control measures. The City is authorized to draw against this escrow in the event the building permit applicant fails to comply. The Escrow is required under City Code Chapter 16. Fast Tracking Issuance of Building Permits (Auth. Res. 2604) Fast tracking building permit process City expenses up to 100% of building permit fee with a 30% deposit.
