Campus Planned Development (PUD)

DISCUSSION
St. Gertrude's Health and Rehabilitation Center, along with the other property owners within the
South Valley Health Campus, has submitted an application for PUD amendment. Specifically,
the applicant is requesting approval of the construction of an addition to the existing St.
Gertrude's facility. The addition is proposed to house an additional 30 beds and would be used
for a transitional care unit. The proposed addition would be constructed over an existing parking
lot, thereby, not adding any additional impervious surface area. Please review the attached report
to the Planning Commission for additional information.
PLANNING COMMISSION RECOMMENDATION
The Planning Commission reviewed this request at its July 8, 2010 meeting. At that meeting, the
Planning Commission recommended approval of the PUD amendment to the City Council.
The Planning Commission did have a discussion regarding the parking proposed by the PUD
Amendment. Because the proposed expansion area is contemplated to be constructed over an
existing parking area, St. Gertrude's will lose parking spaces on its property. St. Gertrude's has
entered into discussions with St. Francis to allow for a shared parking arrangement between the two
entities.
From a zoning ordinance perspective, staff interprets that because the entire medical campus is a
PUD that parking requirements need not be met on individual lots but rather within the entire PUD.
As the parking study indicates, the overall PUD provides a surplus of approximately 625 parking
stalls beyond what is required by City Code.
The Planning Commission's particular concern was whether or not the City could legally issue a
building permit for St. Gertrude's expansion if St. Gertrude's is unable provide on site the number
of parking stalls required by City Code. The City Attorney has commented that a PUD approval
supersedes individual zoning code requirements. Additionally, when the PUD was originally
approved, the parties involved (at that time it was St. Francis and Park Nicollet) entered into an
Operations and Easement Agreement. This agreement does include parcels owned by St. Francis
and St. Gertrude's and does allow for shared parking arrangements.
ALTERNATIVES
1. Approve Resolution No. 7026, approval of an amendment to allow the expansion of St.
Gertrude's subject to the conditions presented.
2. Approve Resolution No. 7026, approval of an amendment to allow the expansion of St.
Gertrude's subject to revised conditions.
3. Deny the request for an amendment and direct staff to prepare the appropriate resolution.
4. Table the request for additional information.
ACTION REQUESTED
Offer a motion to approve Resolution No. 7026, approval of an amendment to allow the expansion
of St. Gertrude's subject to the proposed conditions, and move '1110 adoption. -

RESOLUTION NO. 7026
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA, APPROVING AN
AMENDMENT TO THE PLANNED UNIT
DEVELOPMENT FOR SOUTH VALLEY HEALTH CAMPUS TO ALLOW AN
EXPANSION TO ST. GETRUDE'S
WHEREAS, St. Francis Regional Medical Center, St. Gertrude's Health Care Center, and
Park Nicollet, applicants and owners of said property; have made application for an amendment to
the Planned Unit Development for South Valley Health Campus; and
WHEREAS, the property upon which the request is being made is legally described as
follows: St. Francis Regional Medical Campus, Scott County, Minnesota; and
WHEREAS, on November 15, 1994, the City Council of the City of Shakopee did approve
Resolution No. 4120, approving the Preliminary and Final Development Plans for the South Valley
Health Campus; and
WHEREAS, the Planning Commission of the City of Shakopee did review the amendment
to the Planned Unit Development on July 8, 2010; and
WHEREAS, all required public notices regarding the public hearing for the Planned Unit
Development Amendment were duly sent and posted and all persons appearing at the hearing have
been given an opportunity to be heard thereon; and
WHEREAS, the City Council of the City of Shakopee did review the amendment to the
Planned Unit Development on July 20, 2010.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA, AS FOLLOWS:
That the Planned Unit Development for South Valley Health Campus is hereby amended to allow:
1) Development of the transitional care unit at St. Gertrude's shall be allowed consistent with
the drawings dated 5/7/2010 and attached as Exhibit C. No other expansions within the PUD
that may be depicted on Exhibit C are considered to be approved at this time.
2) As a part of this approval, the transitional care expansion area shall be allowed to be
constructed up to three stories in height.
3) Approval of this amendment acknowledges the shared parking arrangement between St.
Gertrude's and St. Francis in order to meet the parking requirements campus wide rather than
as individual users within the campus.
4) Building materials and landscaping will be reviewed for compliance with City Code
requirements at the time of building permit application. Building materials shall match
existing building materials and meet the requirements of City Code. Landscaping shall be
compliant with City Code and shall be compatible with utilities on site, as determined by the
appropriate representatives of the utility providers.
5) The applicant must submit a detailed site plan showing all work associated with the project as
well as the impervious surface areas being added and removed so as to insure that there is no
net increase.
6) Should there be an increase in impervious surface areas, the applicant will need to submit a
comprehensive impervious surface area drawing to insure these areas on the properties do not
exceed the maximum allowable.
7) The applicant needs to submit a landscape plan to insure the varieties of landscaping and
their locations do not conflict with any public utilities.
8) Approval of the PUD Amendment does not constitute approval of the submitted drawing(s).

DISCUSSION
St. Gertrude's Health and Rehabilitation Center has submitted an application requesting an
amendment to the existing Planned Unit Development (PUD) for the medical campus. Please
see Exhibit A for location of the subject property. Specifically, a 30 bed expansion for
transitional care is proposed at the northwest corner of the St. Gertrude's facility (please see
Exhibits B and C). The addition is proposed to be 2 stories in height with the ability to expand to
a total of 3 stories.
The proposed location of the addition is currently used as a parking lot. Therefore, no increase
in impervious surface area would be created with the expansion. The portion of the parking lot
proposed for removal is currently used by St. Gertrude's staff. As a part of this application, St.
Gertrude's has conducted a parking study to ensure that the parking requirements of the City, as
well as, the parking needs of the users within the medical campus are met. As a result of that
study, St. Gertrude's and St. Francis have executed a shared parking arrangement. A copy of this
agreement (Exhibit D) is attached for the Commission's reference. In short, this agreement
allows St. Gertrude's to meet its City parking requirements by utilizing surplus parking that is
located on property owned by St. Francis.
The Engineering Department has commented that the applicant may want to investigate
providing an entry /exit to the east of the one being removed so as to improve traffic circulation.
Other comments provided by the Engineering Department have been included in the draft
conditions of approval.
ALTERNATIVES
1. Recommend to the City Council the approval of the proposed PUD amendment subject to
the conditions listed.
2. Recommend to the City Council the approval of the proposed PUD amendment subject to
revised conditions.
3. Recommend denial of the proposed PUD amendment to the City Council.
4. Continue the public hearing and request additional information from staff.
STAFF RECOMMENDATION
Staff recommends that the Planning Commission recommend approval to the City Council of the
proposed PUD amendment subject to the following conditions:

Saint Gertrude's Health & Rehabilitation Center
The project consists of an addition to the existing St. Gertrude's Health & Rehabilitation Center. This 30-
bed expansion is being planned at the northwest corner of our property facing the St. Francis Hospital
north tower. This two -story addition is designed to have a future third floor. The building occupancy is
an I -2 with construction type II -A. The first floor footprint is 14,300 sq. ft. and it is attached to the
northwest corner of our 400 unit. The building is sited an existing staff parking lot to minimize the loss
of green space. Some parking modification will happen and we are in the process of discussing the
arrangements with the St. Francis Medical Center. We have done a parking study to determine our needs
and we have concluded that there are ample parking spaces in the south and northeast parking lots to
address our needs as well as clinics and hospital needs.
The exterior of the building will blend into the context of the campus. We plan to match the existing brick
base and steel siding. The canvas /metal awnings will add green color matching green shingles of St.
Gertrude's. There are plans to provide some trees on site and landscaping around thenew addition. We
will provide the landscape plan once we get to that stage. We have also discussed access to the site by the
fire truck via fire lane with Tom Pitschneider. He has agreed to a fire lane shown on the site plan between
St. Gertrude's and the hospital expansion.
The tentative schedule for the project is to start this spring/early summer and enclose the exterior before
the winter. We will be working with our architect -Horty Living and others to finalize the construction
documents.

ST. GERTRUDE'S HEALTH AND REHABILITATION
PARKING STUDY
Memorandum of Understanding for a
Shared Parking Agreement

Whereas: The purpose of this agreement is solely to document the intent of the St. Gertrude's
Health and Rehabilitation Center to meet its city parking requirement by utilizing surplus
parking available on the overall St. Francis Regional Medical Center campus, and
Whereas: 108 parking stalls will be required for shared purposes to meet this requirement, and
Whereas: It is recognized that the St. Francis Regional Medical Center campus has ample surplus
parking available to support this arrangement, and
Whereas: The City of Shakopee has agreed that such an arrangement will satisfy the parking
requirements for the St. Gertrude's Health and Rehabilitation Center Expansion
Application.
NOW, THEREFORE, IT IS MUTALLY AGREED TO AND UNDERSTOOD THAT;
1. The St. Francis Regional Medical Center President and St. Gertrude's Health and
Rehabilitation Center CEO /Administrator will collectively work toward an outline for
where and when St. Gertrude's staff can utilize other areas of the campus.
2. The two parties involved have agreed to this arrangement.
