No. 7021 i • A, CITY OF SHAKOPEE Memorandum CASELOG NO.: 10 -016 TO: Mayor and City Council Mark McNeill, City Administrator FROM: Mark Noble, Planner II SUBJECT: Final Plat of Riverside Bluffs Third Addition MEETING DATE: July 6, 2010 REVIEW PERIOD: May 28, 2010 — September 24, 2010 DISCUSSION Mattamy Homes submitted an application on May 28 requesting final plat approval of Riverside Bluffs Third Addition, proposed for property north of Eagle Creek Blvd. and generally west of Foothill Trail. The plat, as currently proposed, contemplates the replatting of 6 single family lots. The preliminary plat was approved on September 6, 2005, the First Addition of the final plat was approved on September 5, 2006, and the Second Addition of the final plat (which included these lots) was approved on July 7, 2009. As part of the Riverside Bluffs Second Addition, these lots were conditioned on receiving approval from the property owner to the West granting permission and dedicating easements necessary to grade and located utilities in the back yards of these lots. The developer has been unsuccessful with receiving this approval; therefore, they proposed changes to the final grades and utilities for these six (6) lots and have requested approval of the Riverside Bluffs 3 Addition (see attached applicant narrative). Staff received comments from City Engineering, Scott County Public Works, Parks, Recreation, and Natural Resources Director, and SPUC. Staff has incorporated the comments and conditions into the draft resolution. ALTERNATIVES 1. Approve Resolution No. 7021, a resolution approving the Final Plat for Riverside Bluffs Third Addition. 2. Approve Resolution No. 7021, a resolution approving the Final Plat for Riverside Bluffs Third Addition, with revisions. 3. Direct staff to prepare a resolution of denial of the Final Plat for Riverside Bluffs Third Addition for action at the Council's next meeting. 4. Table a decision and request additional information from staff and/or the applicant. Mar Noble Pl. • er II g: \cc\2010 \07 -06 \fp riverside bluffs 3rd.doc 1 RESOLUTION NO. 7021 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE FINAL PLAT OF RIVERSIDE BLUFFS THIRD ADDITION WHEREAS, Mattamy Homes, applicant and property owner, has made application for final plat approval of Riverside Bluffs Third Addition; and WHEREAS, the subject properties are legally described as: Lots 1 thru 6, Riverside Bluffs Second Addition WHEREAS, the Shakopee Planning Commission conducted public hearings on the preliminary plat on April 7, April 21, and May 5, 2005; and WHEREAS, all required public notices regarding the public hearing were posted and sent; and WHEREAS, the Shakopee Planning Commission had recommended denial of the requested preliminary plat; and WHEREAS, the City Council reviewed the preliminary plat request at its meetings of June 21, August 16, and September 6, 2005; and WHEREAS, the City Council reviewed the final plat request at its meeting on July 6, 2010. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, THAT THE FINAL PLAT FOR RIVERSIDE BLUFFS THIRD ADDITION IS APPROVED SUBJECT TO THE FOLLOWING CONDITIONS: I. The following procedural actions must be completed prior to approval of a grading permit and/or a street /utility plan: A. No public improvements (site grading and street and utility) shall be constructed until the City Engineer and the Shakopee Public Utilities Commission (SPUC) approves the required Final Construction Plans and Specifications. B. The applicant shall submit a revised landscaping plan in compliance with the most recent version of the City of Shakopee's Easement Fencing and Landscaping Policy. C. The applicant shall install sod the full width of the drainage and utility easement encompassing the storm sewer from CB 5002 to CB 5001 to the end of the storm sewer lateral. D. The applicant shall provide engineered plans, specifications, details and other pertinent information for the retaining walls and ornamental fencing. E. The applicant shall contact SPUC to discuss details concerning the proposed storm sewer crossing an existing watermain at the west end of Oakridge Trail, in order to meet requirements for separation. II. The following procedural actions must be completed prior to the recording of the Final Plat: A. Approval of title by the City Attorney. 2 f B. Execution of a Developer's Agreement, which needs to include provisions for security for public improvements within the Final Plat as well as payment of engineering review fees, and any other fees as required by the City's adopted fee schedule. 1. Street lighting to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. 2. Electrical system to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. 3. Water system to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. 4. The developer shall be responsible for payment of Trunk Storm Water Charges, Trunk Storm Water Storage and Treatment Charges, and Trunk Sanitary Sewer Charges, as required by the most current City of Shakopee Fee Schedule. 5. Street construction, sidewalks, trails and retaining walls shall be constructed by the developer, consistent with the City Engineering requirements. C. An escrow, Cash, in an amount to be determined by the City Engineer, shall be provided for the future extension of the storm sewer lateral from CB 5001 to the west property line. The timing for extension of the storm sewer lateral shall be at the discretion of the City. D. An escrow, Cash, in an amount to be determined by the City Engineer, shall be provided to allow the City to modify any grading or utility work to insure that adequate drainage patterns are maintained when the property to the west develops. E. Provide electronic files (AutoCAD and Adobe Acrobat formats) of the Final Plat to be recorded with datum on the Scott County coordinate system. F. In order to provide Lots 1 -6 with usable rear yards and to reduce the likelihood of future encroachments into drainage and utility easements, the applicant agrees to limit building /structure depths on each lot so as to provide a minimum of twenty (20) feet of unencumbered yard from the edge of the drainage and utility easements to the edge of any building /structure. G. Easements shall be shown on the Final Plat as approved by the City Engineer. They shall include, but are not be limited to, the following: 1. Minimum drainage and utility easements for public storm sewer shall be dedicated per the City of Shakopee Design Criteria, Section 10.1 (A -D). The easements shall be centered along the public utility alignments. 2. For the storm sewer in the rear of Lots 1 -2, provide a minimum of forty - nine (49) feet of drainage and utility easement, centered on the utility alignment. Denote the dimension on the plat drawing. 3. For the storm sewer in the rear of Lots 3 -4, provide a minimum of thirty- one (31) feet of drainage and utility easement, centered on the utility alignment. Denote the dimension on the plat drawing. 4. For the storm sewer in the rear of Lot 5, provide a minimum of twenty (20) feet of drainage and utility easement, centered on the utility alignment. Denote the dimension on the plat drawing. 3 H. Temporary street signs shall be provided prior to issuance of building permits, and shall remain until such time that permanent street signs are installed. III. The following items need to be addressed /completed prior to issuance of a building permit: A. Record plans shall be provided per the City of Shakopee Design Criteria, Section 2.5 and Section 11.2 (A -L). The record plans shall be submitted to the City Engineering Department. IV. Following approval and recording of the final plat, the following conditions shall apply: A. Building construction, sewer, water service, fire protection and access will be reviewed for code compliance at the time of building permit application(s). B. Noise issues along the County roadways may arise as traffic levels increase in the area. The developer and/or their assigns shall be responsible for any required or desired noise mitigation measures. C. The developer shall implement the use of Best Management Practices for erosion control and stormwater management during construction. D. The applicant shall verify that the tree replacement plan is part of the overall plat tree replacement plan. There were 20 trees proposed in the back yards of these 6 lots, as identified on the previously approved landscape plan. A new landscape plan shall be submitted to show these 20 trees located outside of the drainage and utility easements in these back yards, or relocated to an acceptable location as approved by the Parks, Recreation and Natural Resources Director. E. The applicant shall not plant ash trees (Fraxinus sp.) on the site due to the threat of Emerald Ash Borer. F. The applicant shall meet the city's woodland management ordinance requirements. G. The applicant shall ensure that at least every third tree planted along the streets should be of a different species to diversify the tree plantings. These lots would be granted building permits once the owner of the adjacent property to the West granted permission and dedicated the appropriate easements needed to complete the grading/utility improvements along these lots. Riverside Bluffs Second Addition was approved under Resolution No. 6916, I.(C.) which states that; The applicant shall grade the entire site, as proposed on the submitted plans, in one phase within one year from the date of approval of the grading permit application. Grading will be defined as bringing the site up to the proposed finished grade with materials deemed acceptable by the City of Shakopee engineering department, providing topsoil per City requirements and applying seed, mulch and/or sod per City requirements and providing an as -built grading plan per Section 2.5 of the City of Shakopee Design Criteria. Due to the fact that the proposed development plans for the adjacent site have been denied and Mattamy Homes has been unsuccessful in their attempt to obtain construction easements from the adjacent property owner. Mattamy is requesting approval for modifications to the Riverside Bluffs plans that will eliminate impacts to the adjacent property. These changes include modifications to the approved grading plans as well as modifications to the proposed building pad widths. An 8' wide drainage swale will convey drainage at a 2 percent grade to the south and a catch basin will be added on the lot line between lots 4 and 5. Furthermore a 15 inch storm sewer pipe will be extended to the adjacent property to provide for a future connection if needed. Lot 1, Block 1 will be modified to allow only the northeast corner of the proposed home to walkout. Mattamy homes is requesting to Amended the Riverside Bluffs Plat to reflect the above changes affecting Lots 1 -6, Block 4 Riverside Bluffs Second Addition in order to comply with Resolution No. 6916. The lots being "re- platted" are Lots 1 -6 of Block 4. The reason for the request is the developer's inability to obtain the appropriate easements from the property owner to the west. These easements are necessary to perform the offsite grading and adjacent utility installation to accommodate the Riverside Bluffs 2 Addition design. The Riverside Bluffs 3 Addition design proposes to eliminate the grading on the property to the west, thus shifting the resulting slopes, drainage swale and storm sewer alignment to the east. It also reduces the building pad depths and changes the housing styles from lookouts and walkouts to ramblers. It should be noted specific conditions concerning Lot 1 of Block 1 and Lots 1 -7 of Block 4 appear in the resolution of approval for the Riverside Bluffs 2 Addition. They are as follows: • The applicant needs to obtain an easement prior to performing the grading improvements and storm sewer improvements on the property to the west of the subdivision. These improvements will need to be completed by the applicant and formally accepted by the City prior to issuance of any building permits on Lot 1 of Block 1 and Lots 1 -7 of Block 4. • For the storm sewer from CB 5000 to CB 5001, provide a minimum of ten (10) feet of drainage and utility easement to the west of the utility alignment. The drainage and utility easement needs to be dedicated to the City prior to issuance of any building permits on Lots 1 -7 of Block 4.
