WHEREAS,
pursuant to Resolution No. 7669adopted by City Council on January19,
2016, Bruce Loney, Public Works Director has prepared plans and specifications for improvements

for the 4Avenue & Shenandoah Drive ImprovementsProject, which includes4Avenue from

Shenandoah Drive to CSAH 83 & Shenandoah Drive north of 4Avenueby installation of
sanitary sewer, watermain, storm sewer, street reconstruction, aggregatebase, bituminous paving,
bituminous trailand any appurtenant work and has presented such plans and specifications to the
Council for approval. Also included in the plans are the CSAH 101 drainage improvements from
Shenandoah Drive to Sarazin Street and Valley Park Drive trail crossing of the Union Pacific
Railroad.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SHAKOPEE, MINNESOTA:

Such plans and specifications, a copy of which is on file and of record in the Office
of the City Engineer, are hereby approved.
2.
The City Clerk shall prepare and cause to be inserted in the official paperand on

the City of Shakopeewill be expending MunicipalState Aid Funds on the
improvement of these roadways; and,
WHEREAS,
since this improvement lacks adequate width for parking on both sides of the
road, approval of the proposed construction as a MunicipalState Aid Project must therefore include
certain parking restrictions.

SUMMARY
Assists the City Administratorwith the overall administration ofCity operations. Leads and
manages the City’s Administrative Services, including human resources, information technology,
city clerk, grant coordination, and facilities maintenance functions. Responsible for overseeing
all aspects of these operations, including the establishment of an effective organizational
structure and management of personnel, equipment, and budgetary resources.
ESSENTIAL DUTIES AND RESPONSIBILITIES
Provides direct and in-direct supervision to all employees within assigned divisions in
accordance with City policies and applicable laws. Responsibilities include selection,
development and training of personnel; planning, assigning, and directing work; appraising
performance; addressing complaints, resolving problems and taking appropriate disciplinary
action when necessary.
Oversees administrative functions of assigned divisions, including but not limited to the creation
and maintenance of all necessary and appropriate records, in accordance with the City’s records
retention schedule; the dissemination of information to the public in accordance with applicable
laws; and the timely preparation of all necessary reports, correspondence and memos.
Oversees the City’s Human Resource functions, including recruitment and hiring,compensation
and benefits, employee development and training, and labor negotiations.
Serves as the liaison for personnel services with other divisions, departments and outside
agencies; assists with disciplinary issues, advises department heads and CityAdministrator on
handling employee matters; mediates and resolves sensitive and controversial issues.
Conducts a variety of organizational studies, investigations and operational studies; makes
recommendations to City Administrator regarding personnel administration programs, policies
and procedures,compensation levelsand employeebenefits as appropriate to reflect the City’s
goals, needs and resources.
Participates in the development and administration of the annual budget; forecastsfunds needed
for staffing, equipment, materials and supplies; develops and recommends annual operating
budget for assigned divisions; monitors and controls expenditures within approved limits and
according to City policies and procedures.
Prepares and presents staff reports to City Council; follows up withnecessary correspondence
and action.
Coordinates the City’s risk management activities in consultation with the City Attorney and
City leadership staff, seeking counsel, as needed,regarding legal issues.
Serves as project manager for a variety of special projects; facilitatesproject activities and
resolves problems; develops and submits reports to the City Administrator.
Serves as Acting City Administrator in the absence of the City Administrator.
Directs the delivery of information technology, grants and facilities maintenance services for the
City’s seven departments and nine year-round buildings. Continuously evaluates processes and
services in these areas; developing options for improving or matching services more closely to
organizational needs. Implements adopted changes within the designated timeline and budget.
Participates in external meetings, seminars and training designed to keep informed of recent
trends in the field, industry best practices, new technologies and potential improvements.
Participates in a variety of regularly scheduled and special City meetings and workshops.
Establishes and maintains effective working relationships with other City departments and staff;
works collaboratively as part of the City’s management team to ensure the most effective and
efficient delivery of municipal services as a whole.
Maintains regular communication with local cable company, monitors and enforces terms of
cable franchise and assists residents with service and billing issuesas requested.
Keeps City Administrator advised of developments within areas of responsibility.
Performs other related duties as apparent or assigned by City Administrator.
KNOWLEDGE, SKILLS AND ABILITIES REQUIRED
Ability to communicate ideas and explanations clearly in English, both orally and in writing.
Ability to read, analyze and interpret correspondence, financial reports, legal documents and
scholarly articles.
Ability to write reports, memos and business correspondence using proper spelling, grammar
and punctuation.
Ability to effectively present information in one-on-one and group settings and respond to
questions from employees, elected officials and the general public.
Ability to establish and maintain positive, professional working relationships with co-
workers, subordinates, supervisors and elected officials.
Ability to maintain confidentiality of personnel information, follow the Minnesota Data

QUALIFICATIONS
Minimum Qualifications:
Bachelor's degree in Public Administration, Political Science, Business Administration or
closely related field from an accredited college or university. Five years of progressively
responsible municipal governmentor similarexperience.
Desired Qualifications
Master's Degree in Public Administration or closely related field.
PHYSICAL DEMANDS AND WORKING CONDITIONS
While performing the duties of this job, the employee is regularly required to sit, stand and move
about the office; use hands to finger, handle or feel objects, tools or controls; and reach with
hands and arms. The employee is required to speak, hear and see in order to share information,
receive instructions and complete tasks using a computer screen. The employee must
occasionally lift and/or move up to 25 pounds.
The normal work environment is a modern, climate-controlled office building, with moderate
levels of noise generated by conversations, phones and other office equipment.

AN ORDINANCE OF THE CITY OF SHAKOPEE AMENDING
SHAKOPEE CITY CODE SECTION110.187 AND ADDING SECTION 110.190
PERTAINING TO THE LICENSING OF MOBILE FOOD UNITS
THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS:
Section 1. Section 110.187, Paragraph (A)of the Shakopee City Code is amended to read as
follows:
§ 110.187LICENSE APPLICATIONS.
(A)License types. Each applicant must indicate whether it is applying for a
temporary license or annual license. A temporary license allows mobile food unit
operations in the city for up to 7 10days total from April 1 to October 31March 15 to
November 15 of each calendar year. An annual license allows mobile food unit
operations in the city for 810days or more from April 1 to October 31 of each calendar
year. A licensee will only be issued one temporary license per calendar year, however
nothing shall prohibit a temporary licensee from applying for an annual license within the
same calendar year.
Section 2. TheShakopee City Code is amended to add the following section:
§ 110.190PENALTY.
Upon conviction, aperson’s first violation of any provision in this Subchapter
constitutes a petty misdemeanor. A conviction for a subsequent violation constitutes a
misdemeanor.
Section 3. Effective Date. This ordinance becomes effective from and after its passage and
publication.

Rachel Contractingin the name of the City of Shakopee for the Construction of Quarry Lake Park Phase I
Site Development, Project No. PR2016-1according to the plans and specifications ordered by the City
Council.
2.The consultant, WSB, is hereby authorized and directed to return forthwith to all bidders the
deposits made with their bids, exceptthe deposits of the successful bidder and the next lowest bidder shall be
retained until a contract has been signed.

Re:Recommendation to acceptlowbid for Quarry Park Phase 1 Site Development
A total of 8bids werereceived for this park developmentprojectwith fourbids coming in under the
original engineer’s estimate. The results indicated a very close range of bids betweenthe four low
biddersbased on potential alternates to be considered. For comparison, the bids of the two lowest Base
Bids are shown below.

Based on accepting the Base Bid plus preferred alternates #1, #3 & #4 only as necessary during
construction as site conditions dictate, and #5 and #6, the lowest bidder remains as Rachel Construction
Company.
Due to existing site conditions, we recommend setting aside a minimum construction contingency of 10%
of the total approved construction budget to allow for any additional unknowns on the site that may
require changes to the constructionbudget which would include accommodating alternates #3 and #4 as
necessary.
WSB has worked with Rachel Construction on previous projects and would recommend that the City of
Shakopee execute a contract with them for this project. WSBhas contacted Rachel Construction and they
arecomfortable with their bid submittal for completing the construction according to the timeline
proposed.

WHEREAS,
this parcel is presently zoned Multiple Family (R3); and
WHEREAS,
the property upon which the request is being made is legally described as:

Brittany Village 1Addition Outlot B;and
WHEREAS,
the SewerAvailability Charge(SAC) fees forthe proposed development areprojected to
be 57 units valued at $27,075 in City SACand $141,645 in Metropolitan Council SAC with a total value
of$168,720in Sewer Availability Charges;and
WHEREAS,
the total anticipated Park Dedication fee for 57 units of multiple family housing is $253,650,
MWF Properties, LLC, is requesting a 48% reduction in these fee’s which totals $121,280;and
WHEREAS,
the applicant has requestedthat the City waive $168,720of the SAC fees and $121,280of
the City Park dedicationfees for a total $290,000; and
WHEREAS,
The City finds that financial support or incentive to housing projects thatserve between
30% to 60% of the area median income is in keeping with the City’s housing goals;
THEREFORE, BE IT RESOLVED BY THE CITY COUNCILOF THE CITY OF
SHAKOPEE, MINNESOTA,
thatfees not to exceed $290,000 shall be waived for MWF Properties
for the development of a 57-unit multiple family housing project on the parcel legally described
above.

Section 151.039 High Density Residential District (R-4)
Subdv. 1. Purpose.
The purpose of the High Density Residential Zone is to provide areas for the development of
high density residential uses that are in close proximity to collector and arterial roadways or
transit. The High Density Residential zoning district allows for the development of multiple-
family housing from 14.01 units per acre to 40 units per acre, and provides increased housing
choices and affordability in the community. Increased density also allows for the clustering of
units near environmentally sensitive areas and the downtown and riverfront area.
Subdv. 2 Permitted Uses:
A.Multiple Family Dwellings
B.Utility services
C.Utility service structures, subject to the following requirements:
1.shall not be a water tower or electrical substation, or a building to house sanitary
lift station controls;
2.
3.may only be used to provide weather protection for utility equipment;
4.shall be designed, placed, and landscaped as necessary to assure that it blends
with the neighboring uses, and is unobtrusive; and
5.shall comply with all applicable design standards

E.Residential Facilities serving 6 or fewer persons
F.Day care facilities serving 12 or fewer persons

A.Daycare Centers serving greater than 13 persons

I.Receive only satellite dish antennas and other antennas
J.Communication service apparatus / device(s) as permitted accessory uses, subject to the
following conditions:
1.Shall be co-located on an existing tower or existing structure. Any co-located
other portion of any structure. Such co-located apparatus/ device shall be designed
and located in such a way that its appearance and surface finish minimizes visibility
off-site;
2.Lights and or flashing equipment shall not be permitted unless required by state or
federal agencies;
3.Signage shall not be allowed on the communication service apparatus / device(s)
other than danger or warning type signs;
4.Must provide proof from a professional engineer that the equipment will not interfere
with existing communications for public safety purposes ;
5.Applicable provisions of the City Code, including provisions of the State Building
Code therein adopted, shall be complied with;
6.All obsolete or unused antennas and accompanying accessory facilities shall be
removed within twelve (12) months of the cessation of operations at the site unless a
time extension is approved by the City. After the facilities are removed, the site shall
be restored to its original or an approved state. The user of the antenna and/ or
accessory facilities shall be responsible for the removal of facilities and restoration of
the site.
7.The applicant shall submit a plan illustrating all anticipated future location sites for
communication towers and/or communication device(s)/ apparatus;
8.Wireless telecommunication towers and antennas will only be considered for City
parks when the following conditions exist and if those areas are recommended by the
Parks and Recreation Advisory Board and approved by the City Council:
a.City parks of sufficient size and character that are adjacent to an existing
commercial or industrial use;
b.Commercial recreation areas and major playfields used primarily by adults.
9.All revenue generated through the lease of a City park for wireless
telecommunication towers and antennas shall be transferred to the Park Reserve
Fund.
K.Other accessory uses, as determined by the Zoning Administrator
