SUBJECT: Response to SMSC Fee to Trust Application (D)
Action Sought
Authorize the Mayor to sign the attached letter regarding the Shakopee
Mdewakanton Sioux Community's application to move the identified parcels into
trust status.
Background
The City received notice on November 10, 2015 from the Bureau of Indian Affairs
that the Shakopee Mdewakanton Sioux Community (SMSC) has requested to have
real property currently in fee transferred to trust status with the United States of
America. The parcels include Tax ID #s 279290170, 279290180, 279290161,
279290162, and 279290163. The attached map outlines the location of the parcels
in question.
The parcels currently house a residence, a weir and land used for farming by a tribal
member.
Relationship to Vision
This item supports Goal D: Maintain, improve and create strong partnerships with
other public and private sector entities.
Recommendation
Approval of requested Action.

LAND ACQUISITION APPLICATION
Pursuant to the Code of Federal Regulations,Title 25,INDIANS,Part 151.10,notice is given of
the application filed by the Shakopee Mddewakanton Sioux Community to have real property
accepted"in trust"for said applicant by the United States of America.The determination
whether to acquire this property"in trust"will be made in the exercise of discretionary authority
which is vested in the Secretary of the Interior,or his authorized representative,U.S.Department
of Interior.To assist us in the exercise of that discretion,we invite your comments on the
proposed acquisition.In order for the Secretary to assess the impact of the removal of the subject
property from the tax rolls,and if applicable to your organization,we also request that you
provide the following information:
1) If known,the mania'amount of property taxes currently levied on the
subject property allocated to your organization;
2) Any special assessments,and amounts thereof,that are currently assessed
against the property in support of your organization
3) Any governmental services that are currently provided to the property by
your organization;and
4) If subject to zoning,how the intended use is consistent or inconsistent
with the zoning..

acquisition is to obtain sufficient data that would enable an analysis of the potential impact on
local/state government which may result from the removal of thesubject property from the tax
roll and local jurisdiction.

In response to the Bureau of Indian Affairs' (BIA) letter of November 10, 2015, the City of
Shakopee, Minnesota (City) hereby provides comment regarding the Shakopee Mdewakanton
Sioux Community's (SMSC) application to have the above subject parcels accepted "in trust" by the
United States of America.
The parcels currently house a residence, a weir and land used for farming by a tribal member.
The City has no objections or comments on the proposed trust application.
