Action Sought
Offer Resolution No. 7636, a resolution vacating a water main easement within the
Saint Francis Regional Medical Center Campus, and move its adoption.
Introduction
Saint Francis Regional Medical Center is requesting the vacation of a water main
easement on the site of the hospital complex. Saint Francis is proposing
construction of a new 15,000 square-foot front entrance addition. As a result of the
proposed addition, the existing public water main will need to be relocated because
it is within the footprint of the proposed addition (see attached drawing). The
applicant is proposing to install water main south of the addition and has revised the
existing agreement with Shakopee Public Utilities to reflect the location change.
Shakopee Public Utilities reviewed and approved the revised agreement request at
th6PU Commission's November 2 meeting.
Recommendation
At its November 5 meeting, the Planning Commission unanimously recommended
approval of the requested vacation. The applicant has also received approval from
the SPU Commission to modify the existing agreement and relocate the water main.
Action Requested:
Offer Resolution No. 7636, a resolution vacating a water main easement within the
Saint Francis Regional Medical Center Campus, and move its adoption.

RESOLUTION NO. 7636
A RESOLUTION APPROVING A VACATION OF A WATER MAIN EASEMENT IN THE
PLAT OF ST. FRANCIS MEDICAL CAMPUS
WHEREAS, Michael Morris, applicant, and St Francis Regional Medical Center, property
owner, has made an application proposing the vacation of a water main easement in the St. Francis
Medical Campus plat; and
WHEREAS, it has been made to appear to the Shakopee City Council that the water main
easement in the St. Francis Medical Campus plat is no longer of public use or interest; and
WHEREAS, the water main easement to be vacated is legally described within an attached
Exhibit, which is known as the legal description Exhibit B in Record Document 941066; and
WHEREAS, the Shakopee Planning Commission considered the request at its meeting on
November 5, 2015, and unanimously recommended approval with conditions to the City Council; and
WHEREAS, a public hearing to consider the action to vacate the public easement was held in
the Council Chambers of the City Hall in the City of Shakopee at 7:00 P.M. on the 17th day of
November, 2015; and
WHEREAS, ten days published notice was provided by publication of the notice in the
SHAKOPEE VALLEY NEWS and posted notice was provided by posting such notice on the bulletin
board on the main floor of the Scott County Courthouse, the bulletin board at the U.S. Post Office, the
bulletin board at the Shakopee Public Library, and the bulletin board in the Shakopee City Hall.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SHAKOPEE,MINNESOTA, THAT:
1. It finds and determines that the vacation of a water main easement in the St Francis Medical
Campus plat hereinafter described is in the public interest.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SHAKOPEE, MINNESOTA, THAT:
1. The applicant / property owner shall be responsible for all recording fees incurred as a
result of this vacation.
2. The applicant/property owner must work with Shakopee Public Utilities to dedicate a new
easement agreement for all of the public water main on the site. The applicant / property
owner shall be responsible for all recording fees for the new easement.
After the adoption of the Resolution, the City Clerk shall file certified copies hereof with the County
Auditor and County Recorder of Scott County.
Adopted in the session of the City Council of the City of Shakopee, Minnesota, held the
day of November, 2015.
