No. 7633 (C) Action Sought Offer Resolution No. 7633, A Resolution Ordering Certification of Unpaid Misc. Charges including false alarms and lawn mowing services for Collection with Payable 2016 Property Taxes and move its adoption. Background The City routinely certifies past due miscellaneous fees including false alarm and lawn mowing services for collection with the property taxes. On October 6, 2015, Council directed staff to start the assessment process for these delinquent accounts. Resolution No. 7633 certifies delinquent false alarm and lawn mowing fees on the tax rolls payable in 2016. In addition to these delinquent amounts, a $25.00 administrative charge will be added to each account if not paid by the public hearing. The property owners have been notified of the process and have until November 4, 2015 to pay before being assessed. A list of property owners to be assessed will be on the table Wednesday evening. Recommendation Offer Resolution No. 7633, A Resolution Ordering Certification of Unpaid Misc. Charges for Collection with Payable 2016 Property Taxes and move its adoption. Budget Impact The $25.00 administrative charge covers the administrative cost; therefore, the impact to the budget is minimal. No. 7633 RESOLUTION NO. 7633 A RESOLUTION ORDERING CERTIFICATION OF MISCELLANEOUS CHARGES INCLUDING UNPAID FALSE ALARM AND LAWN MOWING SERVICES PURSUANT TO MINNESOTA STATUTES, § 7.05, CITY ORDINANCE 403 FOR COLLECTION WITH PAYABLE 2016 PROPERTY TAXES WHEREAS, City staff reported to the City Council on October 6, 2015, that written notice was sent to approximately 10 property owners with unpaid false alarm charges and unpaid lawn mowing service charges totaling approximately $1,910.00. Said written notice requested that the property owners pay their delinquent miscellaneous accounts in full, or make arrangements for payment, or appear before the City Council at a public hearing scheduled for November 4, 2015. WHEREAS, Minnesota Statutes, Section 7.05 along with City Ordinance Number 403, with respect to unpaid miscellaneous charges including false alarm charges and lawn mowing service charges "[t]he rates for unpaid miscellaneous accounts shall be a charge against the premises, and in the discretion of the city council, may be certified to the county auditor with the taxes against the property served, and shall be collected as other taxes are collected." WHEREAS, Public notice of a public hearing on said unpaid miscellaneous charges was duly published in accordance with Minnesota Statutes, § 331A.05, and a public hearing was held on said unpaid miscellaneous charges on the 4th day of November, 2015, at the City of Shakopee. WHEREAS, The City Council of Shakopee then proceeded to hear all persons interested in said unpaid miscellaneous charges and all persons interested were afforded an opportunity to present their views and objections to the certification of said unpaid miscellaneous charges for collection by Scott County Auditor with the payable 2016 property taxes. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF SHAKOPEE, MINNESOTA, AS FOLLOWS: 1. The unpaid miscellaneous charges, as set forth in the attached list, are hereby approved to be certified to the Scott County Auditor for collection as other property taxes are collected. 2. That there will be added to the delinquent amount a $25.00 administrative fee if the delinquent amount is not paid to the City on or before November 4, 2015. 3. Such unpaid miscellaneous charges shall be collected by the Scott County Auditor with the payable 2016 property taxes. The owner of any property so charged may, at any time prior to November 25, 2015, avoid certification of the charges with full payment of the charges on such property paid to the City. 4. The City Clerk shall forthwith transmit a certified duplicate of this unpaid miscellaneous charge certification (with any appropriate adjustments for partial or full payments received prior to November 25, 2015) to the Scott County Auditor on or about November 26, 2015, to be extended on the proper tax list of the county and such charges shall be collected and paid in the same manner as other payable 2016 property taxes Adopted in session of the City Council of the City of Shakopee, Minnesota, held this day of , 2015.
