Charges for Collection with Payable 2016 Property Taxes and move its adoption.
Background
The City routinely certifies past due utility bills for collection with the property
taxes. On October 6, 2015, Council directed staff to start the assessment process for
these delinquent accounts. Resolution No. 7629 certifies delinquent storm drainage
and sanitary sewer fees on the tax rolls payable in 2016. In addition to these
delinquent amounts, a $25.00 administrative charge will be added to each account if
not paid by the public hearing. The property owners have been notified of the
process and have until November 4, 2015 to pay. A list of property owners with
bills to be assessed will be on the table Wednesday, November 4, 2015.
Recommendation
Offer Resolution No. 7629, A Resolution Ordering Certification of Unpaid Utility
Charges for Collection with Payable 2016 Property Taxes and move its adoption.

RESOLUTION NO. 7629
A RESOLUTION ORDERING CERTIFICATION OF
UNPAID UTILITY CHARGES PURSUANT TO
MINNESOTA STATUTES, § 444.075, SUBD. 3 &. 3e
FOR COLLECTION WITH PAYABLE 2016 PROPERTY TAXES
WHEREAS, City staff reported to the City Council on October 6, 2015, that written
notice was sent to approximately 41 property owners with unpaid water and sewer system utility
charges and unpaid storm water utility charges totaling approximately $8,401.30. Said written
notice requested that the property owners pay their delinquent utility accounts in full, or make
arrangements for payment, or appear before the City Council at a public hearing scheduled for
November 4, 2015.
WHEREAS, Minnesota Statutes, Section 444.075, Subd. 3 & 3e provides, with respect
to municipal water, sanitary sewer and storm sewer charges, that "[t]he governing body may
make the charges a charge against the owner, lessee, occupant or all of them and may provide
and covenant for certifying unpaid charges to the county auditor with taxes against the property
served for collection as other taxes are collected."
WHEREAS, Public notice of a public hearing on said unpaid utility charges was duly
published in accordance with Minnesota Statutes, § 331A.05, and a public hearing was held on
said unpaid utility charges on the 4th day of November, 2015, at the City of Shakopee.
WHEREAS, The City Council of Shakopee then proceeded to hear all persons interested
in said unpaid utility charges and all persons interested were afforded an opportunity to present
their views and objections to the certification of said unpaid utility charges for collection by
Scott County Auditor with the payable 2016 property taxes.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF SHAKOPEE,
MINNESOTA, AS FOLLOWS:
1. The unpaid utility charges, as set forth in the attached list, are hereby approved to be
certified to the Scott County Auditor for collection as other property taxes are collected.
2. That there will be added to the delinquent amount a $25.00 administrative fee if the
delinquent amount is not paid to the City on or before November 4, 2015.
3. Such unpaid utility charges shall be collected by the Scott County Auditor with the
payable 2016 property taxes. The owner of any property so charged may, at any time
prior to November 25, 2015, avoid certification of the charges with full payment of the
charges on such property paid to the City.
4. The City Clerk shall forthwith transmit a certified duplicate of this unpaid utility charge
certification (with any appropriate adjustments for partial or full payments received prior
to November 25, 2015) to the Scott County Auditor on or about November 26, 2015, to
be extended on the proper tax list of the county and such charges shall be collected and
paid in the same manner as other payable 2016 property taxes
