TO: Mayor and City Council

SUBJECT: Extension of Work Hours for Gateway South
Action Sought
The Council is asked to approve the suspension of City Code Sec. 10.60, Noise
Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain
Operations, D, for construction activity on the Gateway South development site at
4th and Shenandoah.
Background
Duke Realty has submitted the attached letter requesting extended work hours on
Saturdays through December 19 to allow for the completion of site work on their
Gateway South development, at the northwest corner of 4th and Shenandoah.
Similar requests have been approved in recent months for construction activities on
the Amazon site.
The request is to be allowed to begin construction activities at 7:00 a.m on
Saturdays. City Code allows for construction activities to begin at 9:00 a.m. on
Saturdays.
Like the Amazon site, the site in question will require blasting activities. However,
it is closer to residential neighborhoods than the Amazon site. Therefore staff
recommends that if Council wishes to grant an extension of construction hours, that
it allow work to begin at 8:00 a.m., rather than the 7:00 a.m. requested, and that no
blasting activity be allowed prior to 9:00 a.m. Additionally, as has been City
practice with these types of exceptions, the Council is asked to grant the City
Engineer the authority to revoke this permission if property owner complaints
become a problem. If Council approves the suspension, a public notice to meet the
City Code requirements and notice as a news release would be placed in the
Shakopee Valley News.
Requested Action
If the Council concurs, it is asked to approve the suspension of City Code Sec.
10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on
Certain Operations, D, for construction activity on the site of the Gateway South
development at 4h and Shenandoah, by allowing construction to begin at 8:00 a.m.
on Saturday mornings through December 19, 2015.

Re: Gateway South First Addition (Res. No. 7627)—Extended Work Hours
Dear Mr. Reynolds,
Duke Realty requests extended working hours on the Gateway South development project. The project
has a significant amount of site related work to be completed in the fall and early winter time-frame. To
maximize time available with the shorter daylight hours we request Saturday work hours be permitted
from 7:00am to 6:00pm starting immediately upon approval and extending until December 19,2015.
We may need to request additional extended hours at a later date as the project continues.
Thank you for your consideration. Please contact me, at 952-543-2988,if you have any questions or
concerns.
Respectfully Submitted,
DUKE REALTY CORPORATION
