Density Residential (R1A), Ord. No. 921 (B)
Action Sought
The Council is asked to adopt Ordinance No. 921, an ordinance amending the
Zoning Map for property located at 2544 Lakeview Drive.
Background
Fritz Menden has submitted an application to rezone his property at 2544 Lakeview
Drive from Rural Residential (RR) to Low Density Residential (R1A). If the
rezoning is approved, staff anticipates that Mr. Menden will then submit a plat
application to divide the existing 9.75 acres into 13 lots with a connection to
Lakeview Drive and Jennifer Lane. City water and sewer, which are required for
the R1A zoning district, will be made available through the extension of Jennifer
Lane.
The proposed project meets the density requirements for the zone; however the
final lot configuration will be determined at the time of the final plat. A sample lot
configuration has been submitted with this report to demonstrate the maximum
density of the site. The actual number of lots may be less than those shown in the
sample due to street frontage and lot requirements. The property previously
received a preliminary plat in 1989, but due to an increase in the total number of
residential lots proposed, a new preliminary plat is required. The applicant
anticipates submission of a new preliminary plat later this year after the rezoning
process is completed.
Considerations
Rezoning the property will result in an area of R1A zoning which is not contiguous
to other R1A zones. This property will be the first to utilize the extension of city
services through Jennifer Lane. The Comprehensive Plan guides the property as
single family residential. It is anticipated that as surrounding properties develop
they will be zoned R1A. The City is not requiring properties adjacent to Jennifer
Lane or this site to develop, and will review submissions when development occurs.
Rezoning the property will allow the development of one additional lot above what
was anticipated in the original plat of this area, which was based on the assumption
that homes would be served through septic systems. One of these lots is an existing
home owned by the applicant/property owner.
The extension of Jennifer Lane and Fairhaven Drive allows connection of several
City streets, and a better transportation network than what presently exists. This
connection also alleviates an over-length cul-de-sac off of Fairhaven Drive.
Recommendation
The Planning Commission reviewed this rezoning request on October 8, 2015 and
unanimously recommended approval.

ORDINANCE NO.921
AN ORDINANCE OF THE CITY OF SHAKOPEE,MINNESOTA,
AMENDING THE ZONING MAP ADOPTED IN CITY CODE SEC.11.03 BY REZONING LAND TO
LOW DENSITY RESIDENTIAL(R1A)FROM RURAL RESIDENTIAL(RR)
WHEREAS, Fancis Menden and Bonnie Jean Menden, applicants and property owners,have
applied to rezone the located at 2544 Lakeview Drive from the Rural Residential(RR)Zone to the Low
Density Residential(R1A)Zone; and
WHEREAS,the property is legally described as:
Outlots I, N, and 0 of Stonebrooke First Addition, Scott County, Minnesota
(PID Nos. 27-142045-0, 27-142050-0 and 27-142051-0)
WHEREAS, notices were duly sent and posted, and a public hearing was held before the Planning
Commission on October 8,2015 at which time all persons present were given an opportunity to be heard; and
WHEREAS,the Planning Commission has recommended to the City Council that the subject
property rezoned as stated; and
WHEREAS,the City Council heard the matter at its meeting on October 20,2015; and
NOW, THEREFORE BE IT RESOLVED,that the City Council of the City of Shakopee hereby
adopts the following findings of facts relative to the above-named request:
Finding#1 The original zoning ordinance is not in error. However, the original zoning ordinance did not
contemplate the extension of City water and sewer services. These services are being extended as
part of the Jennifer Lane road project, and allow greater area to be served.
Finding#2 Significant changes in community goals and policies have taken place. Significant changes in
goals or policy have not taken place
Finding#3 Significant changes in development patterns have occurred. The extension of Jennifer Lane and
with it City services was not contemplated at the time of zoning the property.
Finding#4 The Comprehensive Plan requires a different provision. The request is consistent with the
Comprehensive Plan guiding as Single Family.
BE IT FURTHER RESOLVED,that the request to rezone the property as stated in this ordinance
is hereby approved.
