SH.AKOt'EE TO: Mayor and City Council FROM: Kris Wilson, Assistant City Administrator DATE: 10/06/2015 SUBJECT: Contract Renewal for MMUA Safety Program (F) Action Sought The Council is asked to authorize the appropriate City officials to enter into the attached contract amendment for the continuation of OSHA compliance and safety services through the Minnesota Municipal Utilities Association. Background For several years the City has participated in a shared safety program through the Minnesota Municipal Utilities Association (MMUA). The program provides the City with a qualified safety consultant who comes on-site two-days per month to conduct trainings, perform mock OSHA inspections of facilities and otherwise serve as a resource on workplace safety issues. The contract runs on MMUA's fiscal year and therefore it is time to renew for the October 1, 2015 - September 30, 2016 time frame. Recommendation Staff recommends the Council authorize the appropriate City officials to enter into the attached contract amendment for the continuation of OSHA compliance and safety services through the Minnesota Municipal Utilities Association. Budget Impact The total cost of the program is $26,400 per year, which is paid in quarterly installments and funded out of the Personnel budget. This reflects a $1,000 increase from the previous year's cost of$25,400. Relationship to Vision This is a housekeeping item. Attachments: MMUA Contract Minnesota Municipal Utilities Association AMENDMENT TO SERVICES AGREEMENT Safety Management Program Contract Date: July 7. 2015 Contract Number: 191-2016 The services agreement entered into between Minnesota Municipal Utilities Association (MMUA) and City of Shakopee (Shakopee), dated August 11, 2014, contract number 191-2015, is amended as follows: PART II, Section 1. 1. DURATION: This Agreement shall remain in force from October 1, 2015 until September 30, 2016 (the "expiration date"). PART III, Section 1. 1. COMPENSATION: For the services covered by this Agreement, Shakopee shall pay MMUA an annual fee of twenty-six thousand four hundred dollars and 00 cents ($ 26,400.00) for the 2015-16 annual period. Such compensation shall be due and payable according to the selected payment terms below. Payment terms for the fee agreed to above shall be based on one of the following options (select one): ❑ Annual Payment ($26,400.00) ❑ Quarterly Payments ($6,600.00 each) For any term of less than twelve full calendar months, the fee shall be a portion of the annual fee, pro-rated based on the number of calendar months or partial calendar months in which the services were provided as a percentage of twelve (12).
