Action Sought
Adopt Ordinance No. 917, an ordinance amending Section 3.02 of the City code
authorizing special assessments against property having delinquent and unpaid
charges and costs for Sanitary Sewer service.
Background
The City needs to adopt an ordinance to allow for the collection of unpaid bills for
sanitary sewer service and by special assessments. Current ordinance does not
provide for the collection of unpaid bills.
Staff worked with the city attorney and finance director to prepare Ordinance No.
917 to establish the authority of assessing unpaid bills. The unpaid bill list is
generated with Shakopee Public Utilities.
Recommendation
Staff recommends adoption of Ordinance No. 917.
Budget Impact
Allow for the collection of unpaid sewer bills which otherwise would not be done.
Relationship to Vision
This supports Goal E: Deliver effective and efficient public services by a staff of
well-trained, caring and professional employees.
Requested Action
Adopt Ordinance No. 917, an ordinance amending Section 3.02 of the City code
authorizing special assessments against property having delinquent and unpaid
charges and costs for Sanitary Sewer service.

ORDINANCE NO. 917, FOURTH SERIES
AN ORDINANCE AMENDING SECTION 3.02 OF THE CITY CODE AUTHORIZING SPECIAL
ASSESSMENTS AGAINST PROPERTY HAVING DELINQUENT AND UNPAID CHARGES
AND COSTS FOR SANITARY SEWER SERVICE
THE CITY COUNCIL OF THE CITY OF SHAKOPEE,MINNESOTA.ORDAINS:
Section 1. Section 3.02 of the City Code is amended to read as follows:
SEC. 3.02. FIXING RATES AND CHARGES FOR SEWERAGE SERVICE.
All rates and charges for sewerage service including, but not by way of limitation,
rates for service, availability, connection, disconnection, and reconnection fees,
including penalties for non-payment, if any, shall be fixed, determined, and
amended by the Council and adopted by resolution. The owners of all property
served with sanitary sewer service must pay their proportionate cost and charges
for the collection and disposal of sewage. If a property owner defaults in the
payment of these costs and charges, the City Council may, pursuant to Minnesota
Statutes Section 444.075, levy an annual assessment equal to such unpaid costs
and charges against each lot or parcel of land for which such charges and costs
remain unpaid. The assessment shall be certified to the County Auditor and shall be
collected and remitted to the City in the same manner as assessments for local
improvements.
Section 2. Effective Date. This ordinance shall be in effect from and after the date of its
passage and publication.
