SHAKOPEE TO: Mayor and City Council FROM: Jason Arras, Police Sergeant DATE: 10/06/2015 SUBJECT: Snowmobile Ordinance Amendment, Ord. No. 918 (A, B, D) Action Sought The Council is asked to accept Ordinance No. 918, allowing snowmobiles to travel to and from the state trail and the city approved parking lot at 219 West 1st Avenue, using Levee Dr. and Fuller St., for the purpose of utilizing the downtown businesses. Background The local snowmobile club met with city staff to determine a location for parking snowmobiles so they would be able to access downtown businesses conveniently. The city parking lot located at 219 West 1st Avenue was agreed upon by all parties. Our Legal counsel has reviewed and approved the ordinance amendment. Recommendation Staff recommends the acceptance of this ordinance amendment. Budget Impact No Impact. Relationship to Vision This item relates to Goal A, B, and D: A. Requested Action Offer Ordinance No. 918, Fourth Series, an Ordinance Amending Section 8.30 of the City Code Pertaining to the Operation of Snowmobiles. Attachments: Ordinance No. 918 ORDINANCE NO. 918, FOURTH SERIES AN ORDINANCE AMENDING SECTION 8.30 OF THE CITY CODE PERTAINING TO THE OPERATION OF SNOWMOBILES THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA.ORDAINS: Section 1. Section 8.30 Subdivision 3, Paragraph A of the City Code is amended to read as follows: Subd. 3. Operation. It is unlawful for any person to operate a snowmobile or ATV not licensed as a motor vehicle as follows: A. On the portion of any right-of-way of any public highway, street, road, trail or alley used for motor vehicle travel, except as follows: 1. A snowmobile may operate upon the most right hand lane of a municipal street or alley and may in passing or making a left hand turn, operate on other lanes which are used for vehicle traffic in the same direction only when the snowmobile is traveling directly to or from the residence of the operator and the nearest lawfully designated snowmobile trail, and only when traveling at a rate of speed not in excess of fifteen (15) miles per hour. 2. A snowmobile may also be operated upon the ditch bottom or the outside bank of trunk, County State-aid and County highways where such highways are so configured within the corporate limits. 3. A snowmobile may operate on Levee Drive and Fuller Street only if the snowmobile is travelling to or from a lawfully designated snowmobile trail and the designated snowmobile parking area at 219 West 1st Avenue. Section 2. Effective Date. This ordinance shall be in effect from and after the date of its passage and publication.
