Action Sought
The City Council is asked to adopt Resolution 7609, a Resolution approving the
vacation of certain public drainage and utility easements at 1256 Wood Duck Trail.
Background
The property at 1256 Wood Duck trail was originally intended to be two separate
residential lots. However, due to a large wetland on the east side of the property the
site could not accommodate two homes and septic systems. Due to this, the lots
were combined removing the interior lot line these easements are adjacent to. The
owner of the property has petitioned the city to vacate the interior easements that
were adjacent to the prior lot line.
Recommendation
On September 3rd, the Planning Commission recommended that the easements be
vacated with conditions, as they did not serve the function as intended when they
were established. Additional conditions were that the property owner convey
easements adjacent to Wood Duck Trial, and Lake View Drive, which is consistent
with the purpose of the original easements.
Requested Action
The City Council is asked to adopt Resolution 7609, a Resolution approving the
vacation of certain public drainage and utility easements at 1256 Wood Duck Trail.

A RESOLUTION APPROVING A VACATION OF CERTAIN PUBLIC DRAINAGE AND
UTILITY EASEMENTS AT 1256 WOOD DUCK TRAIL
WHEREAS, Matthew A. Hanish, property owner, has made an application proposing the
vacation of a portion of certain public drainage and utility easements at 1256 Wood Duck Trail; and
WHEREAS, it has been made to appear to the Shakopee City Council that a portion of certain
public drainage and utility easements at 1256 Wood Duck Trail is no longer of public use or interest;
and
WHEREAS,the public drainage and utility easements to be vacated are legally described within
an attached Exhibit(Proposed Vacations); and
WHEREAS, the Shakopee Planning Commission considered the request at its meeting on
September 3, 2015, and unanimously recommended approval with conditions to the City Council; and
WHEREAS, a public hearing to consider the action to vacate the public easement was held in
the Council Chambers of the City Hall in the City of Shakopee at 7:00 P.M. on the 15th day of September,
2015; and
WHEREAS, ten days published notice was provided by publication of the notice in the
SHAKOPEE VALLEY NEWS and posted notice was provided by posting such notice on the bulletin
board on the main floor of the Scott County Courthouse, the bulletin board at the U.S. Post Office, the
bulletin board at the Shakopee Public Library, and the bulletin board in the Shakopee City Hall.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SHAKOPEE, MINNESOTA, THAT:
1. It finds and determines that the vacation of certain public drainage and utility easements at 1256
Wood Duck Trail hereinafter described is in the public interest.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SHAKOPEE, MINNESOTA, THAT:
1. The property owner shall convey a 10 foot drainage and utility easements adjacent to Wood
Duck Trail (northern property line) and Lake View Drive (western property line) rights-of-
way.
2. The applicant shall provide electronic files (AutoCad and PDF) of the easements to be
recorded with datum on the Scott County coordinate system.
After the adoption of the Resolution, the City Clerk shall file certified copies hereof with the County
Auditor and County Recorder of Scott County.
Adopted in the session of the City Council of the City of Shakopee, Minnesota, held the
day of , 2015.

SUBJECT: Commercial Exterior Improvement Program Loan -- DGL Holdings,
LLC
Background
The building owner, DGL Holdings, LLC, located at 206 Scott Street in downtown
Shakopee, have requested a deferred/forgivable loan from the City's Commercial
Exterior Improvement Program. This 100+ year old building is currently occupied
by Jasper, Moriarty & Wetherill, P.A. If the application is approved, the following
work will be done to the exterior of the building:
•Roof Replacement on all three levels
•Landscaping improvements
The total estimated project costs for the exterior improvements is
$47,529. The second estimate received for project showed the total project costs
being $63,288. The applicant is requesting a 5 year deferred/forgivable loan in the
amount of$23,764.50.
The EDAC reviewed this request on Wednesday, September 9, 2015 and are
recommending an award of$23,764.50.
Action Sought
If the EDA concurs, it should, by motion, approve a Commercial Exterior
Improvement Loan in the recommended amount of$23,764.50. The EDA should
also authorize the appropriate officials to enter into Repayment Agreement with
DGL Holdings, LLC, for the building located at 206 Scott Street, Shakopee.

The City of Shakopee is proud of its historic downtown and other commercial areas and would like to encourage property
owners to maintain and invest in their properties in order to preserve them as a profitable businesses and attractive
destinations for years to come.
The Commercial Exterior Improvement Loan Program,formerly known as the Facade Improvement Program,allows
businesses to apply for a forgivable loan from the City of Shakopee for exterior building improvements.
HOW IT WORKS BEFORE
For successful applicants,the City of Shakopee pays up to 50 percent of
project costs for eligible exterior-building improvements.A typicalr
award is$25,000.The City may consider additional funding requests for renovations to historic commercial properties.Awarding of loans is
dependent upon availability of funding.
LOAN FORGIVENESS 3^-
Forgiveness of a loan takes place over a five-year period with 20 percent
of the award forgiven annually.The City may extend or reduce the 230 First Ave.E.
repayment period based on the dollar amount of the award.
If the benefiting building is sold within the period of the loan,the loan AFTER
must repaid.The City may consider alternatives to immediate

RE: Application for Commercial Exterior Improvement Loan
Dear Ms. DiMaggio,
Please find enclosed with this letter our application for a Commercial Exterior
Improvement Loan. I thought I would take a moment to provide you some detailed
information about our property and the proposed project.
DGL Holdings, LLC is the current owner of the building located at 206 Scott Street. The
building is located across Scott Street from the "old" Shakopee fire station. The building
itself is really three structures, each added on to the others over time. The original
building sits on the northwest corner of Scott Street and 21th Avenue and was the original
Railroad Saloon here in Shakopee. We believe that portion was built around the time of
Shakopee's platting in around 1855. In fact, the office building still maintains the
original tin-stamped ceiling from the Railroad Saloon. In our application packet, we've
included a photo of the building from its saloon days. While the lower floor was the
saloon,the upstairs floors were a hotel.
Sometime shortly after the saloon was built,the "middle"part of the current building was
added on. This portion was a small grocery store. Finally, in the second half of the 20th
century the south portion of the building was added on as a traditional 2 story office
building.
Prior to 1972, but after it was no longer a saloon/hotel/store, the building was known as
the Jaspers Building and was occupied by Jerome Jaspers for his accounting business. In
1972, the law firm of Jaspers, Moriarty & Walburg, P.A. was formed and the building
housed the law firm and the accounting practice. Since that time to the present, the law
firm has done business in the building. Today, the firm is known as Jaspers, Moriarty &
Wetherille, P.A.
In the early 2000's, the building underwent a major interior and exterior renovation. At
that time, inquiry was made into an exterior loan to assist with the cost of the project,but
the funds in the program at that time were only available to properties in the historic
downtown area, which stopped at the corner across the street! As a result, this property
has never received the benefit of any economic development assistance from the City.
Within the last couple of years, we began a slow process of exterior improvementsto
make the building more inviting from the outside. We started with replacing an old
dilapidated fence with a white PVC fence that runs most of the length of the west side of
the property. Within the last year or so, we removed an old shed from the west side of
the property and turned the space into an inviting patio complete with a cedar pergola.
Currently we are in need of a new roof. The roof leaks due to a separation that has
occurred over time between the "old" and "new" parts of the building (see photos). The
leak has damaged the interior ceiling and needs to be repaired. Due to the age of the
building, current code requires that we add additional insulation to the roof, which has
increased the project cost substantially. We are also in need of parking lot replacement
and striping. We have proposed a comprehensive face-lift project that will improve the
look of the property from the street making it more inviting. We propose reducing the
parking lot size, adding greenspace, re-landscaping the front of the property, painting and
changing the awnings out. Some of these items have not been included in our application
and we intend to pay for those ourselves.
We hope the City will look favorably on our project and application. Without this
assistance, we could not afford to complete this project as outlined. This property is one
of the oldest in Shakopee, and we hope to keep it that way and even enhance the property
for years to come.

Background
On May 19, 2015 the EDA authorized acquisition of the former gas station located
at 234 1st Avenue West in Shakopee. On July 30, 2015, staff solicited bids from
approximately 25 demolition contractors via postal mail and listed the Request for
Bid (RFB) on the City's website. The bids were due to the City on or before August
28, 2015 at 4:30pm. A total of six bids were received and are summarized below:

The City of Shakopee is seeking the services of an excavation-type contractor capable of providing demolition of a
building,removal of footings and foundations and restoration of the site located at 234 1't Avenue West,Shakopee,
MN.Proposals are due on Friday,August 28,2015 by 4:30pm. It is anticipated that the city will enter into a
contract with the selected contractor by September 30,2015.The City expects this project in be completed prior to
December 30,2015.
The Contractor must perform the following:
1. Obtain all required and necessary permits to include the MPCA and City of Shakopee demolition
permit.
2. Contractor shall work with all utility companies and terminate all gas,electrical or other utility '
services to the site.Contractor shall locate and terminate existing City utility(water and sewer)
connections in the following manner.All service installations connected to the water or sewer
system shall be discontinued at the main and all pipe and appurtenances removed shall be returned
to the City.The contractor shall be responsible for proper compaction of soils in multiple lilts for
restoration of the utility buries.Contractor shall also be responsible for final grade with erosion
and sediment control.
3. In the event a site contains a well and septic system,the contractor shall hire a licensed septic tank
pumper and remove the contents of the septic tank.The well shall also be abandoned by a licensed
well abandonment contractor.Provide to the City copies of the septic pumping and well
abandonment certificates.The septic tank can be removed or the lid removed and the tank filled
with sand.
4. Remove the building,footings and foundation.Under no circumstances shall the contractor bury or
otherwise dispose of debris on site.
5. Contractor will remove all interior debris and will appropriately dispose of any hazardous
substances,asbestos and lead contaminants.
6. Remove all debris and demolished material to an appropriate disposal site.Document all regulated
waste removals according to state laws and provide copies to the City.
7. Maintain positive and appropriate drainage.
8. All impervious surface will be removed from the site. The Contractor will apply a 4"of final
topsoil and`hydro-seed'.
9. Upon commencement,all work must be completed in 30 business days.
