SnAKot'EE TO: Mayor and City Council FROM: Kris Wilson, Assistant City Administrator DATE: 09/15/2015 SUBJECT: Extension of Work Hours for Amazon Construction Project Action Sought The Council is asked to approve the continued suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, for construction activity on the site of the new Amazon facility at 4th and Shenandoah. Background Earlier this year the Council granted Ryan Companies, the general contractor for the Amazon project, extended work hours through September 22. Ryan Companies has submitted the attached request to continue working these same extended hours through November 30. The extended hours allow construction from 6:00 a.m. to 10:00 p.m.. weekdays and from 8:00 a.m.. to 9:00 p.m.. Saturdays, Sundays and holidays. Staff is aware of a small number of complaints regarding blasting noise and dust and one for noise on the site early in the morning, but believes the contractor has adjusted accordingly when these issues have occurred. Recommendation Staff would recommend that if the suspension of hours is granted, that the approval is subject to the following conditions: 1. Approval is contingent upon minimizing noise exposure near residents. 2. If the property owner complaints are received by the City, the suspension can be revoked at the discretion of the City Engineer. If Council approves the suspension, a public notice to meet the City Code requirements and notice as a news release would be placed in the Shakopee Valley News. Inc hereby requests a 90 day extension of the Amazon project work hour variance issued on 6/22/15. Due to hardships placed on Ryan Companies US, Inc, to meet a very aggressive construction schedule for Seefried Development/Amazon Corporation, we will be required to work a number of weekend days and double shift hours to meet a TCO date of 7/1/16. Below is a summary of the working hour variance request: Pre-Building Enclosure/Sitework • Weekdays from 9/1/15 to 11/30/15 o 6 AM to 10 PM • Weekends from 9/1/15 to 11/30/15 o 8AMto9PM Ryan Companies places high trust in its existing relationship with the City of Shakopee, and will continue to be good stewards of the City and our neighbors. They supported allowing construction hours from 6:00 a.m. to 10:00 p.m. during weekdays, and 8:00 a.m.to 9:00 p.m. weekends and holidays. Conditions of this approval include the following: 1. Construction traffic is to stay off 4`h Avenue prior to regular construction hours. 2. Noise generation prior to regular construction hours shall occur on the more northerly/northeasterly portion of the site. 3. The City Engineer has the authority to discontinue the expanded work hours if significant resident complaints are received. 4. No blasting prior to regular construction hours. The City will review this request in approx.90 days and consider allowing this request to continue. I will keep you informed on when we bring this request before the City Council again.
