SHAKOPEE TO: Mayor and City Council FROM: Kyle Sobota, Senior Planner DATE: 09/15/2015 SUBJECT: Amendment to City Code Section 11.61 (Parking) Regarding Required Minimum Parking Stall Sizes, Ord. No. 914 (B) Action Sought The City Council is asked to approve Ordinance No. 914, an ordinance amending City Code Section 11.61 (Parking) relating to minimum parking stall sizes and bumper overhangs in parking areas. Background: The City Council recently approved a PUD Amendment to the Southbridge Crossings East PUD for Marcus Theatres. One of the concessions approved by the PUD was a reduction in the size of required parking stalls. For required 90-degree (perpendicular parking) stalls, the minimum size was reduced from 9' x 20' to 9' x 18' for double loaded stalls, and 9 'x 17' for perimeter parking stalls. The reasoning for allowing smaller perimeter stalls is that a vehicle's bumper could overhang without encroaching into an adjacent parking stall, such as a parking space adjacent to green space. The City Code currently only allows bumper overhangs for angled parking spaces. The proposed amendment reduces the amount of bumper overhang allowed for angled spaces and adds an allowance for bumper overhangs for 90-degree spaces. The bumper overhangs in the current regulations for angled spaces are much greater than the distance that a typical vehicle's bumper would overhang a curb. A reduction in parking space size can significantly reduce the amount of impervious surfaces in large parking areas when comparing parking lots of equivalent numbers of spaces. For a 300 stall parking lot that may have 240 standard stalls and 60 perimeter stalls, the amount of impervious surface could be reduced by 5,940 square-feet, or 0.136 acres with the proposed text amendment. Staff researched the ordinances of other cities regarding parking stall sizes and 9 'x 18' is a common stall size when paired with a 24' drive aisle. Chanhassen and Prior Lake require a wider drive aisle when paired with a shallow parking space. Stall sizes by city are listed below (drive aisle width is 24' unless noted) : Inver Grove Heights: 9' x 18' Savage: 9' x 18' Burnsville: 9' x 18' Apple Valley: 9' x 20', spaces next to curb / landscaped areas may be 18.5' deep Bloomington 9' x 18' Lakeville: 9' x 20' Chanhassen: 9' x 18', 26' drive aisles Coon Rapids: 9' x 20', 2' bumper overhang permitted where applicable Maple Grove: 9' x 18' Prior Lake: 8.5' x 18', 25' drive aisles Recommendation: On September 3, the Planning Commission recommended unanimously that the City Council amend the zoning ordinance as proposed, with the additional requirement to maintain a clear space around walkways and shrubs and bushes for screened parking areas. Requested Action: The City Council is asked to approve Ordinance No. 914, an ordinance amending City Code Section 11.61 (Parking) relating to minimum parking stall sizes. Attachments: Ordinance No. 914 ORDINANCE NO. 914 AN ORDINANCE OF THE CITY OF SHAKOPEE APPROVING AN AMENDMENT TO CITY CODE SECTION 11.61 (PARKING) WHEREAS, The City of Shakopee has proposed an amendment to City Code Section 11.61 (Parking) of the Zoning Ordinance regarding the minimum parking stall size for 90-degree parking and bumper overhangs in parking areas; and WHEREAS, notices were duly sent and posted, and a public hearing was held before the Planning Commission on September 3, 2015, at which time all persons present were given an opportunity to be heard; and WHEREAS, the Planning Commission recommended that City Code Section 11.61 be amended to revise the language pertaining to parking stall size; and WHEREAS, the City Council heard the matter at its meeting on September 15, 2015; and THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS: Section 1 -That City Code Chapter 11 (Zoning) is amended to add the language as follows: Language which is underlined shall be added. Bumper Overhang. To receive a reduction in space depth for parking stalls adjacent to walkways or sidewalks, a clear space in the sidewalk or walkway of at least 5' in width must be maintained that is free of sign posts,bumper overhangs, bollards, or other obstructions. Screening such as trees, shrubs,bushes, or fencing must be located and maintained in a manner that allows at least 1.0' of clear space between the parking area and the screening both at the time of installation and at full and mature size for plantings. Section 2. The City Council adopts the following findings of fact relating to the request to modify the language in the City's zoning ordinance regarding parking stall size. Criteria#1 That the original zoning ordinance is in error; Finding#1 There has been no evidence that the original zoning ordinance is in error, the proposed text amendment relates to a change parking stall size. Criteria#2 That significant changes in community goals and policies have taken place; Finding#2 A reduction in the amount of impervious surface and stormwater discharge from developed sites is a community goal. Criteria#3 That significant changes in City-wide or neighborhood development patterns have occurred; Finding#3 There has been no evidence presented that either city-wide or neighborhood development patterns have changed. The proposed ordinance conforms to design standards in place in surrounding communities, and allows for a reduction in the amount of impervious surface when comparing parking areas of equivalent size. Criteria#4 That the Comprehensive Plan requires a different provision; Finding #5 The Comprehensive Plan does not require a different provision. Section 3. Effective Date. This ordinance shall be in effect from and after the date of its passage and publication. Adopted in session of the City Council of the City of Shakopee, Minnesota held this day of , 2015.
