Action Sought
Offer a motion approving a suspension of City Code Sec. 10.60, Noise Elimination
and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D,
allowing work 24 hours a day as necessary to complete the Jacking under CSAH
83, and directing staff to publish notice of the suspension terms with the conditions
as recommended by staff.
Background
Minger Construction, Inc., has requested that City Code Sec. 10.60, Noise
Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain
Operations, be suspended for certain work hours.
The above named section of the City Code restricts the hours of operation from
7:00 A.M. to 10:00 P.M. on weekdays and from 9:00 A.M. to 9:00 P.M. on
weekends and holidays.
Minger Construction, Inc. is requesting a suspension on the hours to allow for work
24 hours a day for potentially three consecutive days in September.
The City recently awarded a contract to Minger Construction, Inc. to jack a 42-inch
concrete pipe under CSAH 83. Once the Jacking operation begins, it may need to
continue nonstop until the Jacking is complete. This will depend on soil conditions
encountered. Minger Construction estimates it should take 60 to 72 hours to
complete the Jacking.
Staff would recommend that if the suspension of hours is granted, that the approval
is subject to the following conditions:
1. Approval is contingent upon minimizing noise exposure near residents.
2. If the property owner complaints are received by the City, the suspension can
be revoked at the discretion of the City Engineer.
If Council approves the suspension, a public notice to meet the City Code
requirements and notice as a news release would be placed in the Shakopee Valley
News.
Recommendation
Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, allowing work
24 hours a day as necessary to complete the Jacking under CSAH 83, and directing
staff to publish notice of the suspension terms with the conditions as recommended
by staff
