SUBJECT: Ordinance Establishing Even Year Municipal Elections - Ord. No. 910
Action Sought
If the Council so desires, it should move adoption of one of the two attached
Ordinances and direct its publication.
Background
At the August 5 City Council meeting, the Council directed staff to prepare an
ordinance changing municipal elections from odd to even numbered years.
To facilitate such a change, the Council would need to provide a transition plan for
moving from the current schedule to the new schedule. Working with the City
Attorney, staff has identified two possible approaches to making this transition.
Attachment A outlines the start and end dates of terms for each elected office under
each of the options.
Option #1: Completes the transition as quickly as possible but results in
elected officials serving terms that are longer than they were originally elected
for because it simply cancels the November 2017 elections and extends all
terms by one year. This is a legally permissible option, and is actually the
default transition plan provided for in statute if a City was to change its
election year without providing a specific transition plan.
Option #2: Takes two additional years to fully complete the transition, and
requires that elections be conducted in 2017, 2019 and 2020, but results in all
elected officials serving the length of term for which they were elected.
Ordinances for both options have been prepared by the City Attorney and are
attached for Council's consideration. If Council desires to adopt one of these
ordinances, the maker of the motion should clearly specify which option her or she
is moving.
As noted in the text, an Ordinance on this topic does not become effective until 240
days after its publication. Therefore, any action taken now will have no impact on
the upcoming November municipal elections.
Requested Action
If Council so desires, it should offer Ordinance No. 910, specifying Option #1 or
Option#2, move its adoption and direct its publication.

AN ORDINANCE OF THE CITY OF SHAKOPEE PROVIDING FOR EVEN-NUMBERED
YEAR CITY ELECTIONS AND REGULATING THE TERMS OF OFFICE
THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS:
Section 1. Purpose. The city council has determined that it is in the best interests of the city
and its residents that the regular municipal election be held in even-numbered years
rather than in odd-numbered years. The purpose of this Ordinance is to change the
timing of the City's municipal elections from odd-numbered years to even-
numbered years and to modify the terms of the mayor and council members to
facilitate an orderly transition in the change to even-numbered year elections.
Section 2. Election in Even-Numbered Years. Pursuant to Minnesota Statutes Section 205.07,
the City municipal general election shall be held on the first Tuesday after the first
Monday in November of each even-numbered year beginning in 2018. No City
municipal election shall be held on the first Tuesday after the first Monday in
November 2017.
Section 3. Transition Terms. The terms of mayor and council members whose terms would
otherwise expire on the first Monday in January 2018 are extended until the first
Monday in January 2019. The terms of the council members whose terms would
otherwise expire on the first Monday in January 2020 are extended until the first
Monday in January 2021.
Section 4. The city clerk is authorized to take all actions necessary to provide for an orderly
transition from the existing election schedule to the schedule set forth in this section.
Section 5. All previous ordinances or other actions of the City Council establishing the City
municipal general election for odd-numbered years are repealed.
Section 6. Effective Date. This Ordinance shall be in full force and effect 240 days after its
passage and publication.
Adopted in adjourned regular session of the City Council of the City of Shakopee, Minnesota held
this 18th day of August,2015.
