SI L1KOfl F TO: Mayor and City Council FROM: Bruce Loney, Public Works Director DATE: 08/18/2015 SUBJECT: Approve Quote for Crossing Boulevard's Median Opening (E) Action Sought To approve a quote for opening the median on Crossings Boulevard at Penstemon Lane East and approve a 10% contingency amount in this project for use by the City Engineer in authorizing change orders or quantity adjustments on this project. Background Southbridge Fields Addition was platted in 2006 as a neighborhood commercial development. Part of the approval process was placing a median on Crossings Boulevard to have the first access to the development be a right in/right out access. Since 2006, construction and development of the area has changed and with the installation of County Road 21, County Road 18 has less traffic. The City received several traffic complaints in 2009 due to the median and how traffic was circulating. The Traffic Safety Review Committee reviewed the situation and recommended opening up the median as a better alternative for the commercial traffic and less impact to residential areas. On August 3, 2011, the City Council approved Resolution No. 7113, approving a full access on Crossings Boulevard and Penstemon Lane East which is attached. Steve Soltau of Shakopee Crossings LP paid for the design and plans which are attached and approval for consideration. Staff is currently out for quotes and anticipates that quotes will be received on August 17th, 2015 and will send out the quotes before the meeting if received. Staff is proposing to provide the surveying, inspection and right of way permit and to pay for storm drainage work. Shakopee Crossings, LP would pay for the rest of the construction items. Recommendation Staff recommends approving the low quote in order to proceed with the project which has taken over 4 years to get to this point and approve a 10% contingency amount in this project for use by the City Engineer in authorizing change orders or quantity adjustments on this project. Budget Impact The project affects the Surface Drainage Fund and Professional Services Funds in the Engineering Division. Sufficient funds exist for this work. BACKGROUND: On August 17, 2015, the City received 2 quotes to complete the project. The low quote was received from Krueger Excavating Inc. in the amount of$33,170.00. The Engineers estimate for this project is $35, 000. The two quotes received are attached to this memo. RECOMMENDATION: 1. Approve the quote of Krueger Excavating Inc. for the Crossings Boulevard's Median Opening. 2. Approve a 10% contingency amount on this project for use by the City Engineer in authorizing change orders or quantity adjustments. BUDGET IMPACT: The storm drainage fund will pay $7,235.00 for storm sewer work and Shakopee Crossings LTD will pay the remainder of construction costs, (see attached). City staff will inspect, provide the surveying and the right-of-way permit for the project. BACKGROUND: The final plat of Southbridge Fields Addition was approved on August 29, 2006 by adopting Resolution No. 6469. The installation of the improvements included a right in/right out access to the neighborhood commercial property which lines up with Penstemon Lane East. Since the installation, there have been problems with trucks exiting the commercial property and turning eastbound on Crossing Boulevard at Penstemon Lane West as well with vehicles making U-turns on Crossing Boulevard at Penstemon Lane West. Staff was first contacted by Mr. Mohmmed Shah of 1801 Penstemon Lane and attached is his e- mail and picture of damaged boulevard. Later staff was contacted by residents of West Penstemon Lane to consider alleviating traffic concerns of the neighborhood. Attached is their letter that was shared with the Council. The Traffic Safety Review Committee (TSRC) has met on December 3, 2009, June 17, 2010 and May 19, 2011 to discuss alternatives. Early this year, staff had concept drawings of alternatives prepared which are attached. The TSRC did review the three alternatives and Option No. 2 was the preferred alternative for opening the median. The committee felt the median could be opened with the following reasons: 1. Traffic volumes on CSAH 18 will be reduced with the opening of CSAH 21. This will therefore require less traffic signal timing for the CSAH 18 approaches and providing more green time for Crossing Boulevard, which then will remove the concern of traffic potentially backing up past the Penstemon Lane East intersection. Less left turn storage approaching CSAH 18 will also be required. 2. The traffic volume on Crossings Boulevard will be reduced with the purchase of several acres by the Shakopee Mdewakanton Sioux Community. This will result in less conflict and delays for westbound Crossings Boulevard traffic attempting to turn left onto the existing Penstemon Lane East. 3. Observation of the current traffic problems and difficulties would be improved by opening the median by businesses and for the neighborhood. By allowing traffic to turn left out of the business access, the issue of the truck driving on the boulevard will be eliminated. 4. With the opening of the access,the amount of traffic past the swimming pool and through the Penstemon Lane West intersection will be reduced, which will improve the safety for residents walldng or biking in this area. In reviewing the geometries of the area, the East Penstemon Lane intersection is approximately one City block in length. An example of a similar situation would be 4th Avenue and CSAH 17 and 1st Avenue and Sommerville Street in the Downtown area. For low speeds (30 m.p.h.) and low volume collector streets,the committee feels the full access will function and be a better situation than the current arrangement. The TSRC recommends amending the resolution to allow for a full access at Penstemon Lane East. An informational meeting is scheduled to be held at 5:00 PM,July 28th by Steve Soltau of Shakopee Crossings Limited Partnership with the neighborhood. The results of this meeting will be presented by the August 3rd meeting. If this change of access is approved by the City Council, staff would approve the use of our consultant, WSB & Associates, Inc. to complete the design for the development and payment of design to be by the developer. The actual work would be done under a right- of-way permit and this work would be done privately and paid by the developer. ALTERNATIVES: 1. ACTION REQUESTED: Approve Resolution No. 7113,A Resolution Amending Resolution No. 6469,Approving the Final Plat of Southbridge Fields Addition. /r kr 1.14 43 Loney,P.E Public Works Director ENQR1201I-PROTECTS/2011-COUNCII/AMEND-RES6479-SOUT HBRIDGE-F1ELDS-ADDITION RESOLUTION NO. 7113 A RESOLUTION OF THE CITY OF SHAKOPEE,MINNESOTA AMENDING RESOLUTION NO.6469 APPROVING'IRE FINAL PLAT OF SOUTHBRIDGE FIELDS ADDITION WHEREAS,Southbridge Crossings,L.P.,applicant and property owner,has made application for final plat approval of Southbridge Fields Addition;and WHEREAS,the subject property is legally described as: Outlots B,Riverside Fields 3rd Addition, according to the recorded plat thereof Scott County,Minnesota; and WHEREAS,the Planning Commission recommended approval of the proposed preliminary plat with conditions;and WHEREAS,on February 21,2006,the City Council approved the proposed preliminary plat; and WHEREAS,on July 18,2006,the City Council approved the proposed final plat pursuant to Resolution No.6460;and WHEREAS,on August 29,2006,the City Council considered a request by the applicant to revise the conditions contained in Resolution No.6460. WHEREAS,on August 3,2011,the City Council considered a request by the applicant to revise Condition III on the access to Crossings Boulevard;and WHEREAS,the City's Traffic Safety Review Committee received a request and made a recommendation on May 19,2011 to open the median with Option No.2. NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE,MINNESOTA THAT RESOLUTION NO.6469 IS HEREBY RESCINDED AND THAT THE FINAL PLAT OF SOUTHBRIDGE FIELDS ADDITION IS HEREBY APPROVED,SUBJECT TO THE FOLLOWING CONDITIONS: I. The following procedural actions must be completed prior to the recording of the Final Nat: A. Approval of title by the City Attorney. B. Remove the signature block for the City Planning Commission. C. Execution of a Developer's Agreement,which shall include provisions for security for public improvements within the plat and the engineering review fees,and any other fees as required by the City's adopted fee schedule. 1. Shakopee Public Utilities Commission shall be contacted if the applicant wishes to contract with them for security lighting. 2: Electrical system to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. 3. Water system to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. 4. Public sanitary sewer,public storm sewer and public watermain have been extended through the site. The applicant shall work with City of Shakopee staff to provide acceptable access to each system and their associated appurtenances. This includes providing adequate easements and entering into an encroachment agreement with the City. 5. The developer shall be responsible for payment of Trunk Stonn Water Charges,Trunk Sanitary Sewer Charges,Trunk Storm Water Storage and Treatment Charges,security for the public improvements,engineering review fees,and other fees as required by the City's most recent adopted Fee Schedule. 6. No public improvements shall be constructed until the City Engineer and the Shakopee Public Utility Commission approve the Final Construction Plans and Specifications. 7. The applicant shall obtain an NPDES permit prior to any land disturbing activity. A copy of this permit shall be forwarded to the City. The applicant shall adhere to all MPCA NPDES requirements. 8. The applicant shall provide evidence of suitable easement agreements for access to all adjacent properties utilizing the private sewer system. These easements shall be approved by the City prior to recording of the plat. Maintenance of these utilities shall be the responsibility of the applicant. D. The applicant shall provide a more defined site plan showing impervious surface percentages complying with the requirements set forth by City Code,at time of Conditional Use Permit and Building Permit application submittals. E. Easements shall be shown on the Final Plat as approved by the City Engineer. F. The applicant shall contact City Engineering to apply for and secure an encroachment agreement for the trunk storm sewer located along the westerly line of Lots 1,3,4,5&6,as well as secure an encroachment agreement for the trunk sanitary sewer located between Lots 4&5. G. The survey data(length and bearings)shall be shown for each lot. H. Temporary street signs shall be provided until such time that permanent street signs are installed. The water distribution system shall be revised to comply with Shakopee Public Utilities Commission's requirements. This shall include,but not be limited to, identifying and providing water services for each lot. J. Adequate easements for watermains shall be required,consistent with Shakopee Public Utilities Commission's requirements. K. The applicant shall meet park dedication requirements by providing cash in lieu of land dedication. L. Park dedication fees in the amount required by the City Code and adopted City fee schedule shall be paid prior to the recording of the final plat. M. The applicant shall provide an 8'wide bituminous trail connection,as per City Standard Details,between Crossings Boulevard and Southbridge Parkway along the west side of County Road 18. N. Screening elements required by the Board of Adjustment and Appeals,the City Council,and/or City Staff shall be allowed within drainage and utility easements adjacent to Riverside Fields 3rd Addition. The applicant shall be responsible for the maintenance of the screening and shall repair and/or replace any landscaping located in the easements that may be damaged due to need to access the easements. O. The applicant shall obtain a grading permit prior to any additional land disturbing activity. P. The soils on site shall be subject to sampling and testing at the City's discretion. The cost associated with the testing,and if necessary,the removal of any material deemed unacceptable by the City shall be the applicant's responsibility. Q. The applicant shall provide storm water computations for the proposed development as required by City Engineering to insure the downstream system can accommodate the runoff. R. The applicant shall ensure that the emergency access from Crossings Boulevard to Southbridge Parkway be well maintained and accessible at all times. II. Following approval and recording of the final plat,the following conditions shall apply; A. The applicant shall record the private road access easement document. B. The developer and/or their assigns shall be responsible for any required or desired noise or dust mitigation measures. C. Shall provide electronic(AutoCAD)files of the Final Plat to the Engineering Department. D. The applicant shall meet the screening and landscaping ordinance requirements of the City Code. E. The applicant shall submit a landscaping plan for review and approval by the City of Shakopee Natural Resource Specialist. F. The applicant shall provide six(6)inches of topsoil below areas to be sodded. The soil composition should be similar to the MnDOT topsoil borrow requirements. G. The applicant shall provide rain sensors for any irrigation system. H. The applicant shall implement the use of Best Management Practices for erosion control and stormwater management during construction. I. The applicant shall utilize the MPCA Protecting Water Quality in Urban Areas as a technical reference for erosion control. J. The applicant shall comply with the design and performance standards for the Planned Residential District(PRD). K. Silt fence and/or tree protection fence is to be removed following establishment of vegetation as determined by an inspection by City staff. L. The easternmost access to Crossings Boulevard shall be constructed and signed as a full access according to plans approved by the City Engineer(Option No. 2). M. The city reserves the authority to close the median at the easternmost access to Crossings Boulevard and go back to right in-right out if the traffic patterns warrant a change. N. Any impact this development has,as far as adjusting or relocating existing facilities,is subject to reimbursement to Time Warner Cable applicable costs of relocation/adjustment and subject to scheduling of work requested. O. The developer is authorized to submit an application for a Minor(administrative) Subdivision for Lot 3. P. The applicants or their heirs and assigns shall be responsible for payment of the costs of any future closing of the right-out access,as well as any future improvements to the Crossings Boulevard infrastructure attributable to the impacts of Southbridge Fields and the land uses contained therein.
