SUBJECT: Text Amendment to Add Power Generation Facility as a Use and
Definition in the Zoning Code - Ord. No. 909 (A,B)
Action Sought
The Council is asked to adopt Ordinance No. 909, an ordinance amending various
sections of City Code relating to Power Generation Facilities.
Background
The Minnesota Municipal Power Agency (MMPA) is interested in constructing a
power generation facility in Shakopee. Currently, the City Code includes provisions
for uses such as wind energy conversion systems, utility service structures, or solar
equipment, but does not include power plant or power generation facilities. In order
to permit a power generation facility, the code needs to be amended to include the
definition of this use and designate the zones where it would be permitted.
After working with the City Attorney and reviewing the code language of several
other cities, staff is recommending the City adopt the following definition for power
generation facilities:
Power Generation Facility - A power station, powerhouse, power generation
plant or similar facility, other than a wind energy conversion system or solar
energy conversion system or facility, that produces or generates electric power.
It is recommended that power generation facilities be conditionally permitted in the
I1 - Light Industry, I2 - Heavy Industry, and MR - Major Recreation zones.
MMPA has supplied a site map and elevations to show what the power generation
facility they are proposing will look like. However, the attached ordinance only
affects the definition and permissible zones and does not approve or deny any
application from MMPA at this time. Therefore, the attached materials are
supplied for reference and scale purposes only.
Recommendation
Following a public hearing on August 6, the Planning Commission recommended
adoption of the attached ordinance. If adopted, all power generation facilities will
require a Conditional Use Permit, which requires a public hearing, and will
receive additional review by the Board of Adjustment and Appeals.
Requested Action
If the Council concurs, it should offer a motion to approve Ordinance No. 909, an
ordinance amending various sections of City Code relating to Power Generation
Facilities, and move its adoption.

AN ORDINANCE OF THE CITY OF SHAKOPEE AMENDING
VARIOUS SECTIONS IN CHAPTER 11 OF THE CITY CODE
RELATING TO POWER GENERATION FACILITIES
WHEREAS, The City of Shakopee has proposed an amendments to Sections 11.02
(definitions) 11.42 (Major Recreation), 11.44 (Light Industry), 11.46 (Heavy Industry),regarding
Power Generation Facilities.
WHEREAS, notices were duly sent and posted, and a public hearing was held before the
Planning Commission on August 6, 2015 at which time all persons present were given an
opportunity to be heard; and
WHEREAS, the Planning Commission recommended that the City code section 11.02,
be amended to include defining power generation facilities; and
WHEREAS, the Planning Commission recommended that the City code sections
previously listed, be amended to include language conditionally permitting power generation
facilities; and
WHEREAS, the City Council heard the matter at its meeting on August 18, 2015.
THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS:
Section 1. Section 11.02, Subd. 100. all other numbers adjusted accordingly, of the Shakopee
City Code dealing with Definitions are amended to read as follows:
100. Power Generation Facility—A power station, powerhouse,power generation plant or similar
facility, other than a wind energy or solar energy conversion system or facility, that produces or
generates electric power.

Sec. 2. Section 11.42 Subd. 3.P, Section 11.44, Subd. 3.S, and Section 11.46 Subd. 3.Q, all
lettering to be adjusted accordingly, of the Shakopee City Code dealing with Conditionally
Permitted Uses are amended to read as follows:
Power Generation Facilities.
Sec. 3. The City Council adopts the following findings of fact relating to the request to modify
the language in the City's zoning ordinance regarding permitting goods produced off-site to be
sold by the home occupation permit holder.
Criteria#1 That the original zoning ordinance is in error;
Finding#1 The original ordinance did not account for, define, or permit power generation
facilities. This is not an error, but an unforeseen use that has been proposed within
the City.
Criteria#2 That significant changes in community goals and policies have taken place;
Finding#2 There have not been significant changes in community goals and policies.
Criteria#3 That significant changes in City-wide or neighborhood development patterns have
occurred;
Finding#3 There has been no evidence presented that either city-wide or neighborhood
development patterns have changed. The proposed text amendment does not alter
the character of development.
Criteria#4 That the Comprehensive Plan requires a different provision;
Finding#4 The Comprehensive Plan does not require a different provision.
Section 4. Effective Date. This ordinance shall be in effect from and after the date of its passage
and publication.
Adopted in session of the City Council of the City of Shakopee,Minnesota held this
day of , 2015.
