REGULAR SESSION SHAKOPEE, MINNESOTA JUNE 1, 2010
Mayor Schmitt called the meeting to order at 7:00 p.m. with Council members Steve Clay, Matt Lehman,
and Pamela Punt present. Councilor Pat Heitzman was absent. Also present was Mark McNeill, City
Administrator; Bruce Loney, Public Works Director /City Engineer; R. Michael Leek, Community
Development Director; Jim Thomson, City Attorney; Jamie Polley, Parks, Recreation & Natural
Resources Director; Gregg Voxland, Finance Director; Rick Coleman, Fire Chief; Mark Noble, City
Planner II; and Judith S. Cox, City Clerk.
The Pledge of Allegiance was recited.
Mayor Schmitt asked if there were any additions or deletions to the agenda. Mark McNeill asked to add
to the agenda 13.F.1. Hanging Flower Basket Sales.
Clay/Punt moved to approve the agenda as amended. Motion carried 4 -0.
Mayor Schmitt said in the Mayor's report that he attended the Memorial Day celebration at Memorial
Park.
Mayor Schmitt asked if there were any additions or deletions to the Consent Agenda. Cncl. Lehman
asked to add to the consent agenda, 13.F.1, Hanging Flower Basket Sales.
Lehman/Punt moved to approve the Consent Agenda as modified. Mr. McNeill read the consent agenda.
Motion carried 4 -0.
Lehman/Punt offered Resolution No. 7015, A Resolution Adopting Standard. Specifications and Standard
Detail Plates for Street and Utility Construction, and moved its adoption. (Motion carried under the
Consent Agenda)
Lehman/Punt moved to authorize staff to contract with Pipe Services Corporation for the television
inspection of $75,000 linear feet of sanitary sewer main at a cost of $0.32 per linear foot with funding to
be expended from the Sanitary Sewer Fund. (Motion carried under the Consent Agenda)
Lehman/Punt moved to approve the guidelines for the Shakopee Facility Sponsorship Program and usage
of these guidelines by the "Shakopee Recreation: Bring People Together" (SP:BPT) group and other
fundraising groups. (Motion carried under the Consent Agenda)
Lehman/Punt offered Resolution No. 7008, a Resolution Adopting Revised HIPAA (Health Insurance
Portability and Accountability Act) Policies and Procedures for the City of Shakopee's Group Health
Plans, and moved its adoption. (Motion carried under the Consent Agenda)
Lehman/Punt moved to adopt the job descriptions for the positions of Recreation Supervisor — Youth,
Teen & Community Center and Recreation Supervisor — Aquatics, Fitness and Seniors. Also, moved to
authorize staff to begin the hiring process for the Recreation Supervisor — Aquatics, Fitness and Seniors
position. (Motion carried under the Consent Agenda)

Lehman/Punt moved to approve the bills in the amount of $681,829.16 and electronic transfers in the

2. Waive the Requirement of the City Code Section 5.02, Subd.9 for Dangerfield's Restaurant

3. Consistent with previous approval, the following conditions are placed on the approval of the
license for MCW Entertainment, LLC dba Hater's Bar and Grill:
a. The extended 648 Square foot area of the license which includes the deck shall be closed
on a daily basis to the public at sunset and no sale or consumption of food or beverages is
allowed on the deck after sunset.

b. The doors to the extended deck license area shall remain closed at all times after sunset
except in the case of an emergency.
c. Applicant's failure to comply with any of these conditions shall be grounds for
suspension or revocation of the license by the City Council.
4. Consistent with previous approval, the following condition is placed on the approval of the licenses for
VFW post #4046, Inc:
a. No alcohol possession or consumption in the patio area shall occur after 11:00 p.m.

Lehman/Punt moved to approve the applications and grant a Wine License, conditioned upon compliance
with all licensing requirements to:

Lehman/Punt moved to authorize the appropriate officials to enter into contracts with Multi - Services
Incorporated for temporary custodial services at a cost not to exceed $3100 per month. (Motion carried
under the Consent Agenda)
Lehman/Punt moved to set a special meeting to be held Monday, August 2 at 7:00 pm in the City
Council chambers, to hear the reports of the financial and architectural consultants for the proposed
Community Center Improvements. (Motion carried under the Consent Agenda)
Lehman/Punt moved to adopt the revised FY2011 budget calendar, eliminating the August 2 budget
workshop. (Motion carried under the Consent Agenda) (CC Document No. 479)
Lehman/Punt moved to authorize the sale of excess hanging flower baskets by the Downtown Partnership
as part of the Classic Car Cruise in downtown Shakopee. (Motion carried under the Consent Agenda)
Mayor Schmitt asked if there was anyone in the audience who wished to speak on a topic that was not on
the agenda. No one responded.
Mr. McNeill stated that Steve Wischmann, Partner, in the firm of Kern, DeWenter, Viere, LTD., will
present the results of the 2009 Comprehensive Annual Financial Report.
In an overview, Mr. Wischmann discussed the Comprehensive Annual Financial Report, Compliance with
Government Auditing Standards /Legal Compliance Audit Guide and the Management Letter.
Mr. Wischmann discussed the City's material weaknesses, significant deficiencies and control
deficiencies. This is due to the small number in staff in some divisions who control incoming and
outgoing cash flow.
Overall Mr. Wischmann said that the City of Shakopee is in good financial standings, has a fund balance
with the recommendations of the State Auditor and has a Moody Bond rating of Aa3, which is a good
rating.

Mr. Wischmann then summarized the required communication summary with regard to the auditing
performance and process preformed by KDV.
Mayor Schmitt asked for Council liaison reports. Cncl. Clay had nothing to report. Cncl. Lehman said he
attended the Board of Equalization. The only issue was declining property values and the restructuring of
green acres and CRP programs. He also attended the Derby Days meeting. He said there may be an issue
of accessing the event because of the bridge work. Cncl. Lehman said he also attended the Memorial Day
celebration at Memorial Park. Cncl. Punt said she attended the Scott County Transit Review Board. At
that meeting there was a presentation of the metropolitan highway system improvement study. Cncl. Punt
also said work will begin on the Hwy 13/101 interchange in the spring of 2011.
Mark Noble, Planner II, presented Council with the Shakopee Historic Preservation Advisory
Commission (HPAC) Field Research Review.
Mr. Noble said the HPAC would like to inform the Council of their intent to officially designate 12
additional properties as locally significant historic properties. Mr. Noble presented pictures of the 12
properties.
Mr. Noble said the HPAC has tentatively scheduled to discuss the field research review at their 06 /14/10
meeting at which time the property owners of the listed properties will have an opportunity to approach
the commission and share their opinions.
Clay/Punt moved to approve the Historic Preservation Advisory Commission to proceed with meeting
with the property owners of the structures that are candidates for listing as locally designated historic
properties, and to forward a final determination to the Council for formal approval at a future date.
Motion carried 4 -0.
Bruce Loney, City Engineer/Public Works Director, presented Council with the Authorization of
Execution of Agreement for Participation in the CH 69 and TH 169 Interchange Preliminary Design with
Scott County.
Mr. Loney said the County has included their 2010 Transportation Improvement Program (TIP), an
interchange study for the CH 69 & TH 169 intersection.
At the February 23, 2010 workshop with the Scott County Board a request for cost participation was
mentioned by the County staff and board to the City Council of 25% of the study cost. The estimated cost
of the study is $600,000 with $150,000 or 25% at Shakopee's cost.
Lehman/Clay moved to authorize the appropriate City officials to execute the Agreement for Participation
in CH 69 & TH 169 Interchange Preliminary Design between the City of Shakopee and Scott County with
funding to be from the general fund balance and not to exceed $150,000. Motion carried 4 -0.
Mr. McNeill presented Council with the Hiring of an Architect for the Fire Station Feasibility Study.
Mr. McNeill said that Council has indicated a desire to move ahead with the construction of a new
satellite fire station, and an architectural study is therefore needed to provide a preliminary design and
cost estimate for planning and funding purposes.

Mr. McNeill said the station would replace the current downtown station located at Second and Scott
Streets. A more centralized location would be in the area of Lion's Park. Mr. McNeill said the new site
would only be a satellite station with three drive- through bays. There would also be a small meeting
room and a room for firefighters turn out gear.
Mr. McNeill also said that Allina Health Systems has been in contact with the City regarding the
feasibility of stationing an ambulance and crew in the new satellite station. That would involve an extra
capital expenditure up front for the extra space but Allina would pay monthly rent.
Mr. McNeill stated that City staff has interviewed two consultants and staff is recommending Oertel
Architects be retained to do the study for the fire station relocation at a cost of $4,200 which would come
from the Fire Department budget for 2010.
Mr. McNeill then discussed possible financial options for the cost of the new station if Council decides to
proceed after receiving information from Oertel later this year regarding design.
Lehman/Punt moved to authorize the hiring of Oertel Architects to do a feasibility study and preliminary
plan for Fire Station 2 relocation. Motion carried 4 -0.
Mayor Schmitt asked if there were any Council concerns. No one had any concerns.
Lehman/Clay moved to adjourn to Tuesday, June 15, 2010 at 7:00 p.m. Motion carried 4 -0.
