No. 7017 CITY OF SHAKOPEE MEMORANDUM To: Mayor and City Council CONSENT Mark McNeill, City Administrator From: Jamie Polley, Parks, Recreation and Natural Resources Director Meeting Date: June 15, 2010 Subject: Accepting of Donation of Property Adjacent to Huber Park, PID 279060451, Resolution No. 7017 INTRODUCTION The City Council is asked to accept the donation of property adjacent to Huber Park as previously discussed. BACKGROUND Staff presented the request by Gary and Sherla Monnens to donate a parcel of property adjacent to Huber Park to the City at the March 2 and March 16 City Council meetings. It is approximately one acre in size. The City Council directed staff to have a Phase I Environmental Assessment completed on the property. DISCUSSION The Phase I Environmental Assessment was completed by Bolton & Menk, Inc in May of 2010. The conclusion of the report states "This assessment has revealed no evidence of recognized environmental conditions in connection with the property." A full copy of the report is available for review upon request. The property is found to have no environmental issues although there will still be some debris cleanup of the site. The cleanup will be completed by City staff and volunteers. Upon the Council's acceptance of the donation, the transfer of property to the City will take place by execution of a warranty deed by Gary and Sherla Monnens that will be drafted by the City Attorney's office. In addition the property owners have requested that the City recognize the value of the property being donated and that the property is being conveyed to the City for public purposes. BUGDET IMPACT The budget impact of the accepting this donation would include staff time needed to clean up the debris on the property. In addition, the property will be removed from the tax base. Both impacts are expected to be small. RECOMMENDATION Staff recommends that the City accept the donation of the parcel of land located at the corner of Bluff Avenue and Market Street. To become effective, State law requires adoption by a two - thirds majority of the 5 members of the Council. ACTION REQUESTED If the Council concurs with the recommendation to accept the donation, it should adopt the following resolution: Resolution No. 7017, A Resolution of the City of Shakopee, Minnesota Accepting the Donation of Land Adjacent to Huber Park, PID 279060451. RESOLUTION NO. 7017 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA ACCEPTING THE DONATION OF LAND ADJACENT TO HUBER PARK, PID 279060451 WHEREAS, on November 6, 2002, the City Council adopted Resolution No. 5794, which established procedures relating to the receipt of gifts and donations by the City; and WHEREAS, Resolution No. 5794 specifies that donations to the City of real property and non - monetary donations with a value greater than $500 must be accepted by resolution of the City Council, and require a two - thirds majority of the Council for acceptance; and WHEREAS, Gary and Sherla Monnens have generously offered to donate their parcel of property adjacent to Huber Park on the corner of Bluff Avenue and Market Street to the City for public purposes; and WHEREAS, the value of the land being donated to the City is estimated to be $95,000; and WHEREAS, such a donation will help improve park facilities and enhance the overall quality of life in Shakopee; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, that the donation of the property adjacent to Huber Park, PID 279060451 that has an estimated value of $95,000 is gratefully accepted; and FURTHER, the donation of the property shall be conveyed by Gary and Sherla Monnens to the City for public purposes, which is consistent with their wishes; and FURTHER, City staff is directed to send a letter to the donors, acknowledging receipt of the gift and expressing the appreciation of the City Council; and FURTHER, the City Attorney is directed to draft a warranty deed for execution by the donors in order to convey the property to the City; and FURTHER, City Staff is authorized to record the warranty deed with the County upon execution. • Adopted in session of the City Council of the City of Shakopee, Minnesota held this 15 Day of June, 2010.
