No. 7003 CITY OF SHAKOPEE Memorandum TO: Mayor & City Council "ONSENT Mark McNeill, City Administrator FROM: Jeff Weyandt, Assistant City Engineer SUBJECT: Consider Awarding a Contract for the 2010 Street Reconstruction, Project No. 2010 -1 DATE: May 18, 2010 INTRODUCTION: Attached is Resolution No. 7003, which accepts the bids and awards a contract for the 2010 Street Reconstruction, Project No. 2010 -1. BACKGROUND: On April 6, 2010, City Council adopted Resolution No. 6995, which approved the plans and specifications and authorized staff to advertise for bids for the 2010 Street Reconstruction, Project No. 2010 -1. On May 11, 2010, a bid opening was held for the 2010 Street Reconstruction Project, in which there were (14) bids opened for this improvement project. The bids are summarized in the attached resolution. From the bid opening, the low bidder is Ryan Contracting, Inc. with a bid of $1,274,438.00. The Engineer's estimate for this project is $1,460,000.00. The feasibility study contained a project cost estimate of approximately $1,940,000.00. Adding a 5% contingency to the actual low bid and 22% indirect costs, the estimated project cost is approximately $1,633,000.00, which is below the estimated project cost in the feasibility study. Therefore, we can anticipate assessments being lower than what was estimated in the feasibility study. If Council awards the contract, staff is also requesting a contingency amount equal to 5% of the contract to cover minor change orders and quantity adjustments that may occur on the project. ALTERNATIVES: 1. Accept the low bid of Ryan Contracting, Inc. and adopt Resolution No. 7003. 2. Reject the low bidder and award to another bidder. 3. Reject all bids and rebid. 4. Approve a 5% contingency amount on this project for use by the City Engineer in authorizing change orders or quantity adjustments on this project. 5. Authorize the appropriate City officials to execute an extension agreement with WSB & Associates, Inc. to perform construction staking services on the 2010 Street Reconstruction Project. 6. Table for additional information. RECOMMENDATION: Staff recommends Alternative No. 1, No. 4 and No. 5 in order for this project to commence. ACTION REOUESTED: 1. Offer Resolution No. 7003, A Resolution Accepting Bids on the 2010 Street Reconstruction, Project No. 2010 -1 and move its adoption. 2. Approve a 5% contingency amount on this project for use by the City Engineer in authorizing change orders or quantity adjustments on this project. 3. Authorize the appropriate City officials to execute an extension agreement with WSB & Associates, Inc. to perform construction staking services on the 2010 Street Reconstruction Project. Box 246, Elko, MN 55020 is the lowest responsible bidder for the 2010 Street Reconstruction. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. The appropriate City officials are hereby authorized and directed to enter into a contract with Ryan Contracting, Inc. in the name of the City of Shakopee for the 2010 Street Reconstruction Project according to the plans and specifications therefore approved by the City Council and on file in the office of the City Clerk. 2. The City Clerk is hereby authorized and directed to return forthwith to all bidders the deposits made with their bids, except that the deposits of the successful bidder and the next lowest bidder shall be retained until a contract has been signed. It is our understanding that this project consists of approximately 5300 linear feet of street and utility reconstruction. The streets included in this project are as follows: • Minnesota Street, from Shakopee Avenue to east -west alley, north of 7 Avenue • Dakota Street, from Shakopee Avenue to Milwaukee Court • 7 Avenue and 8 ffi Avenue, from Market Street to 300' east of Dakota Street • Shakopee Avenue, from Main Street to Market Street, including the intersection on Market Street and 100 feet each way on Market Street WSB will provide line and grade stakes for the utility and street improvements as required for this project. Cut - sheets will also be provided as needed. WSB will provide the construction staking required for this project on an hourly basis in accordance with our fee schedule, with a 2- person survey crew rate of $140.00 per hour. The total costs for the construction staking services are estimated to be in the $18,000.00 to $23,000.00 range. Final cost will depend on the actual needs of the contractor This includes all costs, including mileage, hubs, lathe, and final as -built survey data for the City to use in the preparation of the record drawings. It is our understanding that construction may begin in early June, 2010. We will be available, as needed, through the duration of the project.
