S1 t r' OI'E E TO: Mayor and City Council FROM: Jamie Polley, Parks & Recreation Director DATE: 08/05/2015 SUBJECT: Accept Work of K.A.Witt Construction Inc. on Southbridge Community Park Development Project No. PR2014-1 and Lions Park Tennis Court Improvements 2014-6 and Authorizing Final Payment, Res. No.7593 (A) Action Sought If Council concurs, offer resolution No. 7593, A Resolution Accepting the Work of K.A. Witt Construction, Inc. for the Southbridge Community Park Development Project, PR2014-1 and Lions Park Tennis Court Improvements 2014-6, and Authorizing Final Payment. Background/Discussion The City Council awarded the contract for the Southbridge Community Park Development Project and Lions Park Tennis Court Improvements to K.A. Witt Construction, Inc. on April 29, 2014. K.A. Witt Construction, Inc. was responsible for all construction elements, including site work, dog park construction, hockey rink base construction, trails, parking lot, site utilities and tennis court construction. The project completion date for Southbridge Community Park was originally August 1, 2014. The project date was extended due to very wet conditions in June of 2014. The project completion date for the Lions Park tennis court improvements was August 29, 2014. Due to the cure time and temperatures of the bituminous the painting of the tennis courts was postponed until the summer of 2015. The contract price for Southbridge Community Park was as follows: •Total bid price of the project was: $805,671.00 •Change Order #1: -$41,000.00 •Change Order #2 +$21,788.50 •Change Order #3 +$29,058.00 •Change Order #4 -$17,163.00 •Amended contract price: $ 798,354.50 The total Construction Park Reserve CIP allocation was $845,954.55 including 5% contingency. The contract price for the Lions Park Tennis Court Improvements was as follows: •Total bid price of the project was: $212,232.10 •Quantity Change for Tree Removal: +$1,127.98 •Amended contract price: $ 213,360.08 The Lions Park tennis court improvements are allocated for in the Park Asset Fund. By aggressively managing the contracts, we were able to keep the change order costs to a minimum and complete the projects under budget. The contractor has provided the City with a one-year performance and payment bond at 100% of the contract price for both projects. The park grand opening for Southbridge Community Park was held on October 23, 2014 and was extremely well attended. The Southbridge Community Park and Dog Park is a wonderful amenity to the City of Shakopee. The Lions Park tennis courts were completed this summer and include pickleball lines in addition to tennis lines. The courts are used frequently by tennis players and pickleball players of all ages. Requested Action If Council concurs, offer resolution No. 7593, A Resolution Accepting the Work of K.A. Witt Construction, Inc. for the Southbridge Community Park Development Project, PR2014-1 and Lions Park Tennis Court Improvements 2014-6, and Authorizing Final Payment. Attachments: Resolution No. 7593 RESOLUTION NO. 7593 A RESOLUTION ACCEPTING THE WORK OF K.A. WITT CONSTRUCTION, INC. FOR THE SOUTHBRIDGE COMMUNITY PARK DEVELOPMENT PROJECT, PR 2014-1 AND LIONS PARK TENNIS COURT IMPROVEMENTS 2014-6, AND AUTHORIZING FINAL PAYMENT WHEREAS, pursuant to a written contract, signed with the City of Shakopee on May 1, 2014, K.A.Witt Construction, Inc. has satisfactorily completed the Southbridge Community Park Development Project and Lions Park Tennis Court Improvements in accordance with such contract. NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA that the work completed under said contract is hereby accepted and approved; and BE IT FURTHER RESOLVED, that the City Finance Director/City Clerk and Mayor are hereby directed to issue a proper order for the final payment on such contract in the amount of $21,746.33, taking the contractor's receipt in full; and BE IT FURTHER RESOLVED, that K.A.Witt Construction, Inc. has provided the City with a one year performance and payment bond for 100% of the contract price.
