SUBJECT: Intoxicating Liquor - Hours of Sunday Sales

INTRODUCTION:
City Council is asked to consider amending the city code to allow the on-sale of intoxicating
liquors on Sunday beginning at 10:00 a.m.
BACKGROUND:
The City Council has received a letter from Mr. Gary Laurent, Stonebrooke of Shakopee, Inc.,
asking that the Council consider allowing the sale of intoxicating liquor on Sunday beginning at
10:00 a.m. versus 11 :00 a.m.
The current city code allows for the issuance of a Sunday liquor license to hotels, restaurants, or
clubs which hold an on-sale intoxicating liquor license and have facilities for seating not less
than thirty (30) guests at one (1) time, in connection with the sale of food. Sales authorized may
begin at 11 :00 a.m. on Sunday morning.
In response to a request from a licensee, in 1992, the City Council held a public hearing and
amended the city code to allow the sale of intoxicating liquor on Sunday to begin at 11 :00 a.m.
versus 12:00 p.m. (The state law changed the 12:00 p.m. start time to 10:00 a.m. and permitted
cities to allow sales beginning at 10:00 a.m. after the City Council held a public hearing. City
Council held the required public hearing and amended the city code to allow sales at 11 :00 a.m.
versus 10:00 a.m.)
State law has since been amended and no longer requires a public hearing to change the start time
for the sale of intoxicating liquor on Sunday beginning at 10:00 a.m.
The following neighboring cities allow the sale of intoxicating liquor on Sunday beginning at
10:00 a.m.: Savage, Prior Lake, Chaska, Eden Prairie, Burnsville, Apple Valley and Lakeville.
New Prague allows sales to begin at 12:00 noon.

ALTERNATIVES:
1. Allow the sales of intoxicating liquor to begin on Sunday at 10:00 a.m.
2. Keep the status quo allowing the sales of intoxicating liquor to begin on Sunday at
11 :00 a.m.
3. Table the request for additional information
RECOMMENDED ACTION:
If Council concurs with the request from Mr. Laurent,
Offer Ordinance No. 832, Fourth Series, An Ordinance of the City of Shako pee, Minnesota,
Amending City Code Section 5.34, Sunday Sales, and move its adoption.

AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA,
AMENDING CITY CODE SECTION 5.34. SUNDAY SALES
THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS:
Section 1: City Code Section 5.34, Sunday Sales is amended to read as follows:
SEC. 5.34. SUNDAY SALES.
The electorate of the City having heretofore authorized the same, a Sunday liquor license may be
issued to hotels, restaurants, or clubs, as herein defined, which hold an on-sale intoxicating liquor
license and have facilities for seating not less than thirty (30) guests at one (1) time between the
hours authorized by Minnesota Statutes, in connection with the sale of food. Sales authorized
hereunder may begin at 11 :00 /~.M. 10:00 A.M. on Sunday morning.
Section II: Effective Date. This ordinance becomes effective from and after its passage
and publication.
Adopted in session of the City Council of the City of Shakopee,
Minnesota held this _ day of ,2010.

RE: Stonebrooke Liquor License
We have had numerous requests from patrons, notably from those who come to our
Sunday morning breakfasts, for alcoholic beverages. They cite other places they could
go where their requests would be served, so long as it was after lOam. Weare currently
prohibited from serving alcohol until after 11 am.
I believe the state statute provides that, if certain conditions are met, a city may grant a
license to serve liquor after lOam on Sundays. I also believe we meet those conditions.
We hereby request that the city grant us such a license.
