Michael Leek, Community Development Director SUBJECT: Approving a Partnership Agreement for the River Crossing Implementation Collaborative (RCIC) MEETING DATE: Apri16,2010 INTRODUCTION: The Council is asked to approve City participation in the RCIC related to the future TH 41 River Crossing. BACKGROUND: Through the Tier I Draft Environmental Impact Statement (DEIS) process, Mn/DOT has selected C-2 as the Preferred Alternative corridor for the new TH 41 River Crossing. The Final EIS (FEIS) completion is expected during 2010. Once a record of decision is filed, the identified corridor will be eligible to utilize the Right of Way Acquisition Loan Fund (RALF) managed by the Metropolitan Council as early acquisition opportunities occur. A joint workshop between the Scott County Board and the Shakopee City Council to discuss the RCIC was held February 23. Funding and construction of the new TH 41 River Crossing Bridge is currently not programmed in the Metropolitan Council 2030 Transportation Plan. However, once the alignment is finally determined right of way preservation would be appropriate. Since Mn/DOT and Federal Highway's (FHW A) selection of the preferred alternative in December 2008, city staff has been working with Mn/DOT and the other stakeholders to address specific issues related to the preferred alternative as part of the FEIS process. Planning for the new river crossing will need to take place over many years. The purpose of the RCIC is to agree on the TH 41 River crossing corridor, reach agreement on a framework and common goals and strategies, and actively carry these forward. The proposed Framework includes active support from all partners for the preferred corridor in addition to improvements that meet current and future transportation needs across the Minnesota River between 1-35 and Scott CR 9. A copy ofthe Partnership Agreement is attached for the Council's information. Other members ofthe RCIC are anticipated to be Mn/DOT, Carver County, Scott County, the Metropolitan Council, the cities of Chaska, Carver and Chanhassen, and permitting agencies, including the Federal Highway Administration, MDNR, US Fish and Wildlife Service and State Historic Preservation Office. Mn/DOT would act as the administrator for the Collaborative. RELATIONSHIP TO CITY GOALS: Participation in the RCIC relates to City Goal B. High quality oflife. Michael Leek Community Development Director River Crossing Implementation Collaborative (RCIC) Partnership Agreement (Final, October 2009) Mission The RCIC is responsible for ensuring the successful implementation of the TH 41 River crossing in accordance with the agreements reached by key stakeholders. Purpose The purpose of the RCIC is to agree on TH 41 river crossing corridor, reach agreement on a framework and common goals and strategies, and actively carry these forward over time. Composition The RCIC is composed of public entities that are either required or legally empowered to commit to this effort over the life of this project. These include the following: . Carver County . City of Carver . City of Chanhassen . City of Chaska . City of Shakopee . Federal Highway Administration . Metropolitan Council . Minnesota Department of Natural Resources . Minnesota Department of Transportation . Scott County . State Historic Preservation Office . U.S. Fish and Wildlife Service, Minnesota Valley National Wildlife Refuge Responsibilities . Work collaboratively and transparently . Steward the process from start to finish . Oversee the progress of this project, ensuring that key stakeholders are engaged and decisions remain aligned with agreements . Authentically engage other stakeholders, including regulatory entities, throughout the process in both formal and informal settings, groups, and activities . Keep the public informed and engaged throughout the process . Continually update underlying data and information that may affect this project . Continually update project tasks, timeline, and responsibilities . Routinely update agencies and elected officials . Support timely and appropriate funding . Maintain formal representation on and actively participate in the RCIC's work over time . Support and assist other members of the RCIC as needed Relationship among RCIC Members Members work under the guidance of this Partnership Agreement; MnDOT agrees to be the administrator for this RCIC. Governance The RCIC will establish any necessary structures for leadership, structure, decision making, logistics, and anything else required to ensure long-term organizational vitality. RESOLUTION NO. 6999 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING A PARTNERSHIP AGREEMENT FOR THE RIVER CROSSING IMPLEMENTATION COLLABORATIVE WHEREAS, MnlDOT has prepared a Tier 1 Draft Environmental Impact Statement (DEIS) for the TH 41 Minnesota River Crossing; and WHEREAS, MnlDOT and the Federal Highway Administration have selected C2 as the Preferred Alternative Corridor; and WHEREAS, the completion of Final Environmental Impact Statement (FEIS) is expected during 2010 with a Record of Decision (ROD) confirming the Preferred Corridor; and WHEREAS, the river crossing stakeholders, comprised of public entities that are either required or legally empowered to sustain the corridor, have collaboratively developed a framework to actively support improvements that meet current and future transportation needs across the Minnesota River between 1-35 and Scott CH9; and WHEREAS, common goals have been developed by the stakeholders to sustain the FEIS corridor decision over time; and WHEREAS, the Tier II EIS process and the actual construction of the river crossing are anticipated to be many years in the future; and WHEREAS, short term, mid term and long term planning decisions need to be made over time; and WHEREAS, right of way within the corridor should be preserved for the future river crossing utilizing Right of Way Acquisition Funds (RALF) and other tools, and NOW THEREFORE BE IT RESOLVED, that the Shakopee City Council hereby adopts the River Crossing Implementation Collaborative Partnership Agreement.
