SUBJECT: Request of Shakopee American Legion for FILP funding for soffit, fascia and
siding replacement, and new doors, sidewalk, ramp and handrails for their
property at 1266 1 st A venue East.
MEETING DATE: December l5, 2009
INTRODUCTION:
The City received the attached application for a loan under the Downtown and First Avenue Fac;ade
Improvement Loan Program. The Shakopee American Legion is proposing a number of
improvements to their east, west and north facades, including replacement of the soffit, fascia, and
siding, as well as replacement of several doors and new sidewalks, handicap accessible ramp and
handrails. The EDA is asked to direct staff whether to prepare a loan agreement for up to 50% of
the fac;ade improvement costs.
DISCUSSION:
The proposed improvement of the siding, soffit and fascia replacement is at an estimated cost of
$l9,805.00, new doors at a cost of$2,355.00, and new sidewalks, ramp and handrails at a cost of
$5,373.00, totaling $27,533.00. In this case, one-half ofthe cost would equal $13,766.50.
The EDA should be aware that there is not a specific funding allocation for this program, and that if
approved, funds would need to come from the EDA Funds budget, as directed by the City Finance
Director, and that the EDA will need to approve a budget amendment for this program.
DESIGN REVIEW COMMITTEE RECOMMENDATION:
On Tuesday, Novemberl0, 2009, the president of the Downtown Partnership, Mike Beard, and the
chair of the Historic Preservation Advisory Committee, Jay Whiting, met with Community
Development staff to review the FILP applications. After discussion, the committee recommended
not granting the requested loan for the replacement of the doors, sidewalk, and ramp for the reason
that there would be no substantial visual change or enhancement of the current building facade.
However, the committee did recommend granting the requested loan for the soffit, fascia, siding,
and the handrail improvements, equaling an amount of$lO,725.00, as they felt those improvements
were consistent with the program guidelines, with a condition that the applicant provide vertical l'
by 6' cedar boards every 8' to 16' along the facades in an effort to comply with the Performance
and Design Standards of the City Code.

Building Permits & Inspections
Applicant is responsible for obtaining appropriate building permits, per the Shakopee
City Code. In the case of improvements that do not require a city-issued building
permit, the applicant must submit the name and state license number of the contractor
completing the work and agree to an inspection of the work by a city building official.
Loan Disbursement
Awarded loan funds will be dispersed to the applicant upon submittal of receipts or
invoices for supplies purchased and work completed.
V. Certification
City staff or an authorized representative shall have the right to inspect the property to
be improved at any time from the date of application upon giving due notice to the
owner and to occupants.
INVe certify that all statements on this application are true and correct to the best of
my/our knowledge. I/We understand that any intentional misstatements will be grounds
for disqualification.
INVe authorize program representatives the right to access the property to be improved
for the purpose of the deferred loan program and to take photographs of the structure
before and atter rehabilitation.
INVe further understand that IIwewill make the final selection of the improvements to be
made with the loan funds and that the contract for improvements will be solely between
myself and the contractor(s). The administering agency will not be liable for the
inadequate performance of the contractor(s).

DATA PRACTICES ACT
The following notice is provided for those applicants for the Shakopee Downtown Fa~ade
Improvement Program that are individuals. The following does not apply in cases where the
applicant is a non-individual. such as a corporation.

In accordance with the Minnesota Government Practices Act. the City of Shakopee is required to inform you
of your rights as they pertain to the private information collected from you. Private data is that information which is

The information coUected from you or from other agencies or individuals authorized by you is used to
determine your eligibility for the Downtown FaCfSde Improvement Program.
The dissemination and use of the private data we collect is limited to that necessary' for the administration
and management of the Downtown Fayade Improvement Program. Persons or agencies with whom this information
may be shared include:
1. City of Shakopee personnel administering the Downtown Favade Improvement Program.
2. Individuals charged by the city with reviewing applications and making recommendations to the Shakopee EDA.
3. Members of the Shakopee Economic Development Authority (only that information needed to approve the
application for loan funds and/or payments to contractors).
4. Federal. State. County, local and contracted auditors.
5. The contract for deed holder (only that you are a loan recipient and the amount of the loan).
6. Law enforcement personnel in the cases of suspected fraud.
7. Those individuals or agencies to whom you give your express written permission.
Unless otherwise authorized by State statute or Federal law. other government agencies utilizing the reported private
data must also treat the information as private.
You may wish to exercise your rights as contained in the Minnesota Government Data Practices ACT. The rights
