Michael Leek, Community Development Director RE: First Amendment to Agreement for Transit Convenience/Prepaid Fare Reimbursements MEETING DATE: December 15,2009 INTRODUCTION AND BACKGROUND: The Metropolitan Council has forwarded the proposed amendment for approval by the City Council. The amendment clarifies the term of the agreement and that the City will participate as a member of the Regional Fare Committee in setting regional fares. Because these are minor amendments, and because it is desirable to have City participation in the Regional Fare Committee, Council is asked to approve the amendment. RELATIONSHIP TO CITY GOALS: Because it relates to the provision of economical transit alternatives, this item relates to Goal B. High quality of life. ACTION REQUESTED: Offer and pass a motion authorizing the appropriate City officials to execute the "First Amendment to Agreement for Transit ConveniencelPrepaid Fare Reimbursements between the Metropolitan Council and the City of Shakopee. ~A;k~ R. Michael Leek Community Development Director FIRST AMENDMENT TO AGREEMENT FOR TRANSIT CONVENIENCE/PREP AID FARE REIMBURSEMENTS BETWEEN THE METROPOLITAN COUNCIL AND CITY OF SHAKOPEE The Metropolitan Council (the "Council") and the City of Shakopee (the "Provider") agree that the Transit Convenience/Fare Reimbursement Agreement entered into on August 13, 2009 shall be amended in the following particulars: 1. Duration of Agreement; Termination. The parties agree that the term of the Transit Convenience/Fare Reimbursement Agreement shown under Section 12, Duration of Agreement; Termination shall be changed to extend from December 31, 2009 to December 31, 2010. 2. Fare Reimbursement Methodology. The Council and the City of Shakopee agree to meet during 2010 as members of the Regional Fare Committee and develop a more accurate fare reimbursement methodology using recently acquired technology to begin in 2011. 3. Ratification. The remaining provisions of the above-referenced agreement shall remain in full force and effect without change except as amended above. IN WITNESS WHEREOF, the parties have caused this amendment to be executed by their duly authorized representatives. This amendment is effective upon final execution by both parties.
