Cox, City Clerk SUBJECT: 2010 Fee Schedule DATE: November 25, 2009 INTRODUCTION The City Council is asked to consider adopting the attached ordinance setting fees for licenses, permits, services, and documents for 2010. BACKGROUND Prior to the end of each year, the City Council adopts a fee schedule by ordinance for the ensuing year. The fee ordinance includes the fees for all licenses and permits issued within the City of Shakopee. Department heads have been asked to re-examine their fees and make appropriate recommendations for adjustments to the City Council. A summary of those recommendations follows. In the proposed ordinance, the stricken language is deleted and the underlined language is inserted. City Clerk/Administration - recommends deleting the fees for Minnesota Home Finance Agency Rental Rehab Grant Applications because the program is no longer in operation, page 1; recommends clarifying the license fee for a motion picture theatre to be more consistent with the city ordinance, page 1; moving the fee for outdoor performance centers from page 2 to page 1, increasing the fee for a temporary 3.2 beer license and a temporary liquor license to $35, page 1; increasing the weekly license fee for a peddler's license to $50, page 2; increasing the fee for an annual refuse collection license to $125, page 2; and, deleting the audio/video dubbing fee for VES copies because we are getting away from using VES, page 3. Building Department - recommends adding a fee for a sewer & water line repair, page 4. The Metropolitan sewer Service Availability Charge (SAC), that is forwarded to the Metropolitan Council, is increased and more clearly outlined on page 8. . , 2010 Fee Schedule November 25, 2010 Page -2- Finance Department - recommends increasing the application fee for tax Increment Financing, page 1; recommends moving the service fee for certification (assessing) delinquent accounts from page 18 to Office Charges on page 3; and, recommends a 3% inflationary increase for the VIP connection fee for properties benefited by the VIP interceptor that were both inside and outside the city limits when it was assessed, page 8. The storm water drainage fee and the sewer service charges are adjusted per November 4th Council action, page 18. Fire Prevention - no changes recommended. Police Department - no changes recommended. Public Works - no changes recommended. Planning Department - recommends adding a fee for a copy of the comprehensive plan on DVD and increasing the fee for a paper copy, page 13; recommends increasing a zoning verification letter by $5, page 13. A deposit is added for administrative costs, page 15. Engineering Department recommends an increase in the grading fee for projects greater than $200,000 and a fee is added for work without an authorized work permit for NPDES, pages 16 and 17. Fees for work in the public right-of-way are increased as outlined on page 18. Park and Recreation it is recommended by the Park and Recreation Advisory Board that the fees be increased as indicated on pages 20-23. A summary of the fee changes is outlined in attached uExhibit A" from the Park, Recreation and Natural Resources Director. ALTERNATIVES After hearing any comments from the public in attendance, Council should consider: 1. Adopting the fee ordinance as proposed. 2. Amending the fee ordinance as drafted. 3. Table the fee ordinance for additional information. RECOMMENDED ACTION - after making any desired changes: Offer Ordinance No. 826, Fourth Series, An Ordinance Setting Fees for City Licenses, Permits, Services and Documents, and move its adoption. I:\clerk\judy\FeeMemo2009 EX H I '8 JT "ft" 2010 Fee Schedule Changes The format has been changed from a chart to a format similar to the rest of the fee schedule. This was done for consistency. .A. Community Center Fees a. The membership fees were increased slightly to reflect the new tax rate. These fees are shown with tax included for administration purposes. b. Replacement card fee is a fee that has been charged but not illustrated on the fee schedule. c. There has been an increased request for copies and faxes, we are therefore setting a per page fee. d. Per the recently adopted parks and recreation facility use policy a for-profit rate for room rentals has been added to the fee schedule. B. Ice Arena Fees a. Ice rental rates are assessed their annual increase to remain competitive with surrounding communities and organizations. C. No Changes D. Sports Association Fees a. Youth Association - additional optional services at a rate of $2.50/participant. b. Adult Leagues - The PRAB is recommending that the non-resident fee not be assessed to the adult leagues but that the per team fee be increased. This change is made to try to attract more participation. E. No Changes F. Park Facilities a. Huber Park resident fee was increased to reflect a price that more sufficiently covers the cost of the rental. Additional staff time rate was added to fee schedule. b. The old fee schedule listed ball fields and soccer fields with and without lights. A new heading was added to the fee schedule to cover all outdoor fields, courts and rinks. The resident fee is not changed however a non-resident fee was added per the recently adopted parks and recreation facility use policy. c. Per the recently adopted parks and recreation facility use policy a for-profit rental rate was added for outdoor facilities with and without lights. d. Per the recently adopted parks and recreation facility use policy a non-resident fee was added for the concession stand rentals e. Youth building -The Y2 day rental rate was increased per the PRAB recommendation. Per the parks and recreation facility use policy a non-resident rate was added for weekday rentals. G. No Changes H. No Changes H: \Budget\2010\Fees\expla nationsll.18.09 ORDINANCE NO. 827, FOURTH SERIES AN ORDINANCE SETTING FEES FOR CITY LICENSES, PERMITS, SERVICES AND DOCUMENTS WHEREAS, by Ordinance No. 810, the City Council established a fee schedule effective January 1, 2009; and WHEREAS, the City Council has determined that adjustments to those fees are reasonable and appropriate. NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Shakopee, Minnesota, that the Fee Schedule dated January 1, 2010, a copy of which is on file in the office of the City Clerk, is hereby approved and adopted in its entirety. BE IT FURTHER ORDAINED, that the Fee Schedule shall become effective on January 1, 2010, unless indicated otherwise therein and all other ordinances and resolutions inconsistent herewith shall be repealed effective January 1,2010. The City is authorized to draw against this escrow in the event the building permit applicant fails to comply. The Escrow is required under City Code Chapter 16. Fast Tracking Issuance of Building Permits (Auth. Private Developrnents The development fees for private developments apply in situations where private developers choose to construct the public improvements, rather than having them constructed by the City. The fees that the City charges in those situations are intended to reimburse the City for all of the direct and indirect costs incurred by the Public Works Departments to process the development application, to process and administer the project, to review and approve the plans for the project, and to inspect the construction of the project. The percentage used for various items are based on the historical costs incurred by the City. The Developer shall reimburse the City for costs associated with the first bituminous seal coat performed on the bituminous paved streets within the plat. The costs shall be based on the lastest contract unit prices the City has received plus 3% for next year's increases and administration costs. The estimated City fee shall be deposited with the City at the time the Developer's Agreement is signed. Streets and Utilities The Development Fees for private developments include a lump sum of 7.5% of the estimated construction costs for the following: public sanitary sewer, public storm sewer, public street construction, sidewalks, boulevard trees and other appurtenances. Recreation Program Fees Recreation program participants are charged fees to cover costs associated with the program. These fees vary depending on the program type, supplies costs, length of the program, etc. A $S.OO service fee will be charged for changes/class cancellations prior to the registration deadline.
