Sec. 1060, Noise Eliminate and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D be suspended for Saturday work hours. BACKGROUND: Scott County Highway 21 project has been awarded to Enebak Construction Company. Enebak would like to request extending working hours, Monday through Saturday for the entire length of the project from 7:00 A.M. to 7:00 P.M. Staff has reviewed this request and the 7:00 A.M. to 7:00 P.M., Monday through Friday work hours are allowed by City Code currently. The one change from City Code is on Saturdays, which is from 9:00 A.M. to 9:00 P.M., and staff would have the following recommendations. . For areas north of C.R. 16 and within the CSAH 21 construction limits, staff would recommend a Saturday starting time of 8:00 A.M. . For areas south of C.R. 16 and within the CSAH 21 construction limits, staff would recommend a Saturday starting time of7:00 A.M. The reason for different starting time is that south of C.R. 16, there are no homes that are adjacent where noise would be an issue with the construction equipment. North ofC.R. 16, there are homes adjacent to the C.R. 21 work site, however an 8:00 A.M. starting time for Saturdays has worked in the past for larger construction projects Staff would also recommend that if suspension of hours is granted that the approval is subject to the following conditions. 1. Approval is contingent upon minimizing noise exposure near residential areas. 2. If residential complaints are received by the City, the suspension can be revoked at the discretion of the City Engineer. 3. Blasting activities, if any, must be done after 10:00 A.M. If Council approves this suspension, a public notice to meet the City Code requirements and notice such as a news release would be placed in the Shakopee Valley News. ALTERNATIVES: 1. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, as requested by Enebak Construction Company, as per their letter dated November 18, 2009 and as modified by City staff and direct staff to publish notice of suspension terms with the conditions as recommended by staff. 2. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, for some other period of time as determined appropriate by the City Council, and direct staff to publish notice of the suspension terms. 3. Do not approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D. 4. Table for additional information. RECOMMENDATION: Staff recommends Alternative No.1.
