SUBJECT: 2010 Street Reconstruction Issues

The purpose of this memo is to update Council as to how staff is preceding in regard to
specific design issues on the 2010 Street Reconstruction Proj ect.
I Issue #1 - Sidewalk on Dakota Street I
Dakota Street is 41-feet wide with no sidewalk within the project limits (7th Avenue to
Shakopee Avenue). Staff is proposing to construct a sidewalk on the east side of the
street and to narrow the street to 37- feet, with the west curb line remaining in the same
place and the east curb line shifted 4- feet. Staff is also proposing to extend the sidewalk
180- feet north of 7th A venue to connect to the existing sidewalk. This will require
shifting the east curb line 4-feet on Dakota Street, south of 7th Avenue outside of the
project limits. This shifting and narrowing of the street creates enough width to construct
the sidewalk.
I Issue #2 - Sidewalk Connections Outside of Project Area I
On Dakota Street, in order to make the sidewalk connection from 4th Avenue to 10th
Avenue, there are two gaps outside the project area in the sidewalk route. One is from 4th
A venue to the alley south of 4th A venue, and the other is from Shakopee A venue to 10th
Avenue along School District property. Staff recommends making the connection near
4th Avenue as part of the project. If the school district agrees to pay for and maintain the
segment from Shakopee A venue to 10th A venue this segment will also be added to the
project.
I Issue #3 -Funding of and Maintenance of Sidewalk Along Dakota Street I
The sidewalk from Milwaukee Manor to Shakopee A venue would be considered a new
sidewalk. If considered a collector street, sidewalks are not assessed, if a local street,
sidewalks are 100% assessed. Reconstruction projects typically would be assessed at
30%.
The reason to install sidewalks along Dakota Street is to provide a route to Pearson and
the Middle School. Staff believes the sidewalk should be classified a safe route to school
and pay for 100% of the cost. Staff would ask the School District to pay for the sidewalk
connection along Dakota Street, from Shakopee A venue to 10ili A venue. The
maintenance of the sidewalk would be by the local property owners unless directed
otherwise by Council.
I Issue #4 - Street Width of Shakopee Avenue I
The City has been reducing the residential street widths to 37- feet as streets are
reconstructed. Shakopee Avenue, between Main Street and Market Street, is 45-feet
wide and is proposed to be reconstructed in 2010. Due to the fact that this is the only
block of Shakopee A venue scheduled to be reconstructed within the next five years, staff
is only proposing to reduce the width to 41- feet.
Issue #5 - Reconstruction of Private Driveways
In 2009 for the first time, the City gave residents the option to have their driveways
reconstructed as part of the City's project. Staff is recommending that the City
discontinue this option and require residents to negotiate privately with the contractor if
they would like their driveway reconstructed.
The cons to offering this program are as follows:
1. The 2009 project was delayed by approximately three weeks due to all of the
private driveways. This resulted in an extra three weeks of inconvenience for all
residents on the project.
2. Additional coordination efforts resulted in higher project costs, in which 70% is
paid from the general tax levy.
3. Driveways outside of the right-of-way can be different. It is difficult for the
contractor to give the City one unit price for all driveways.
4. The driveway work is considered a private improvement and tax exempt bonds
should not be used to finance the improvement.
5. The City takes on additional liability by performing work outside of the right-of-
way.
If Council does not agree with how staff is proceeding, please provide additional
direction. Attached to this memo is a drawing and pictures to illustrate and depict the
issues outlined.

1. Discuss 2010 street reconstruction issues with staff and provide direction on each
Issue.
2. Table for additional information.
