SUBJECT: Consider Approving Plans and Ordering Advertisement for Bids for
Fuller Street Pedestrian Bridge and Trail, from Appaloosa A venue to
Vierling Drive, Project No. 2009-1

INTRODUCTION:
Attached is Resolution No. 6961, which approves the plans and specifications and authorizes
staff to advertise for bids for the Fuller Street Pedestrian Bridge over T.H. 169 and trail, from
Appaloosa Avenue to Vierling Drive, Project No. 2009-1. Previously, on January 6, 2009, City
Council adopted Resolution No. 6863, a resolution approving the plans and specifications for the
Fuller Street trail extension Project, No. 2009-1. These original plans were designed to modify
the existing bridge over T.H. 169 and to make the trail connection along Fuller Street, from
Appaloosa A venue and Vierling Drive.
Before those plans were sent out for bids, the City was made aware of possible stimulus funds
that could be used for this project. Staff did apply for Federal stimulus funds with a modification
in that a new pedestrian bridge similar to the bridge constructed on C.R. 79 would be the design.
Attached to this memo is a letter from Mn/DOT stating that all Federal requirements have been
met and are approved and we are now authorized to advance this project to a bid letting.
The plans have been completed by WSB & Associates, Inc. and all appropriate MnJDOT
approvals have been made, thus the recommendation from staff is to bid the project for a
December 22nd bid letting and to be brought back to the City Council on January 19,2010 for
consideration of award. With Federal funding involved, there are numerous Federal
requirements that need to be met and all items must be met prior to the award of contract.

WHEREAS, pursuant to a motion adopted by City Council on July 1, 2008, Bruce
Loney Public Works Director has prepared plans and specifications for improvements for the Fuller
Street Trail Extension Project by grading, concrete curb & gutter, bituminous pavement, bituminous
trail, street lighting and any appurtenant work, and has presented such plans and specifications to
the County for approval; and
WHEREAS, Resolution No. 6863 was adopted by City Council on January 6, 2009; and
WHEREAS, the City of Shakopee has been successful in obtaining Federal Stimulus
Funds through the American Recovery and Reinvestment Act (ARRA); and
WHEREAS, the plans and specifications have been revised for a separate pedestrian bridge
over T.R. 169 by grading, concrete curb & gutter, bituminous pavement, bituminous trail, street
lighting and any appurtenant work and such plans and specifications have been presented to the
Council for approval.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SHAKOPEE, MINNESOTA:
1. Such plans and specifications, a copy of which is on file and of record in the Office
of the City Engineer, are hereby approved.
2. The City Clerk shall prepare and cause to be inserted in the official paper and in the
Construction Bulletin an advertisement for bids upon the making of such improvement under such
approved plans and specifications. The Advertisement for Bids shall be published as required by
law.
Adopted in session of the City Council of the City of Shako pee, Minnesota,

Dear Mr. Loney:
The plans for the above referenced project have been approved and you have been authorized to advance
this proj ect to letting. Note that federal requirements include submitting pay requests within 11 months of
authorization. The following items are attached or were previously sent to assist you in preparing the
specifications and for further processing of this Federal-aid project:
- Approved Original Plan
- Ad Language (for use in preparing the advertisement).
- DBE letter and attachments for use in notifying the low bidder
- Annotated Proposal Pages (required language to be incorporated into your proposal)
- Computer files (contains project specific information and required language for your proposal)
- Schedule of Materials Control- for use on this project (required in your proposal package)
Upon completing the Project Proposal, please send a copy to Ron Bumann, Construction Practices Specialist,

COOPERATIVE CONSTRUCTION AGREEMENT PROCESS
I. A!ireement Request and Execution
If all review comments have been satisfactorily addressed and all required documentation was included
in the fmal submittal, you can expect the following to happen:
1. The Plan, specifications and estimate are submitted to the Central Office Municipal Agreements Unit
along with agreement request. See the following agreement submittal checklists.
2. The agreement will be prepared. Approximately 3 to 7 weeks are required depending upon the
Municipal Agreements Unit workload and the complexity of the project.
3. The plan will be routed through the Offices of Technical Support, Land Management, and State Aid
(if needed) for final review and signatures. Minor revisions may be necessary in which case the
designer will be contacted. When fully approved, the original is sent back to the designer.
4. The agreement will be submitted to the local agency to be presented to the City Conncil or Connty
Board for approval. A resolution authorizing the agreement is required it must be
NOTARIZED or STAMPED with the city or county seal. This process may take between 2 and
12 weeks depending on the local agency processing requirements.
5. After execution by the local agency, the agreement is returned to Metro State Aid for signature.
6. The agreement is then forwarded to the C.O. Municipal Agreements Unit for final signatures from
MnlDOT, the Department of Administration and the Attorney General. This signature process takes
approximately 1 to 3 weeks.

shall run 3 ads in 3weeks and the bid opening cannot occur until 1 0 days after the last ad.
2. Bid Opening - Bid opening (letting) shall not occur until the local government unit (LGU) has
executed the agreement.
3. Award of Contract- Award of Contract must not occur prior to the execution of the agreement by
MntDOT. Prior to the award of the contract the local agency shall submit an ~bstract of bids and the
certified low bid to Metro State Aid Office. - \.

4. Metro District reviews the low bid and contacts C.O. Estimating,regarding any concerns.
5. Metro District concurs in low bid and submits low bid information to Municipal Agreements Unit as
well as a concurrence letter to the LGU supporting the award of the contract to the low bidder.
6. If being utilized, the Municipal Agreements Unit revises the Schedule "I" within the agreement to
reflect the actual bid prices for the project.
7. Fully executed agreement sent to local agency, which constitutes MnlDOT's formal concurrence in
the award. A copy of the fully executed agreement and payment processing package is furnished to
the local agency within approximately 2 to 4 weeks.
