DATE: October 20, 2009 INTRODUCTION: Engineering staff along with a Technical Evaluation Panel (TEP) has reviewed the Swamp Lake Mitigation Area and determined that additional monitoring is necessary to comply with requirements set forth by the US Corps of Engineers (COE) and the Board of Water and Soil Resources (BWSR). Compliance is necessary to grant final approval of the Wetland Conservation Act (WCA) permit for the Pike Lake Road and CSAH 21 wetland impacts. BACKGROUND: The TEP met in July and in September to determine the necessary courses of action in order to certifY the acreages of wetlands. The COE and BWSR are requiring additional monitoring in the next three (3) year monitoring period. The attached extension agreement with WSB & Associates, Inc. outlines the technical work they will perform to address this additional work. City staff will be completing the weekly and monthly monitoring components in order to reduce costs incurred, the additional services mentioned in the proposal will not be needed from the consultant. The Swamp Lake Mitigation Area was constructed to accommodate a transportation link between Southbridge Parkway and Pike Lake Road as well as the construction of CSAH 21. ALTERNATIVES: 1. Holmes St. Shakopee,~ 55379 Re: Swamp Lake Mitigation Area- COE permit stipulations City of Shakopee, MN Dear Mr. Loney: The purpose of this proposal is to outline additional work that is required to fulfill the permit stipulations from the US Corps of Engineers (COE) and Board of Water and Soil Resource (BWSR) for the Swamp Lake mitigation area. These requirements need to be met to validate the permit for Scott County CSAH 21 project and the Pike Lake Road project. The original scope of work for wetland monitoring was written with the City of Shakopee and costs shared with the County. At that time, the scope of work included monitoring for conformance with the Wetland Conservation Act. However, as part of the subsequent US Corps of Engineers permit requirements and ongoing agency review of the Swamp Lake site, additional work is needed. This work must be completed to secure agency approval of the CSAH 21 wetland replacement plan. This scope is outlined below for continued monitoring to meet agency requirements for 2009, 2010, and 2011. The proposed scope of work was developed with the understanding that the City of Shakopee will perform the required weekly field hydrology monitoring and forward the data to WSB & Associates, Inc. (WSB) for reporting. If the agencies require monitoring beyond 2011, costs will be additional to this scope of work. Task 1: Prepare Supplemental Documents $1,672 As part of the acceptance of the mitigation credits, the TEP requested (June 2009) supplemental documents pertaining to the site history, construction activities, and design. These documents were compiled into a Supplemental Information Report and was submitted to the TEP on September 17, 2009. The TEP is requiring this information before certifying the wetland credits for the CSAH 21 wetland replacement plan. Minneapolis. St. Cloud Equal Opportunity Employer P:\LETTER PRopos.US\Shakopce\Swamp Llk.a\LTR-blancy-MonitoriPg Calt Elt 093009.doG Mr. Bruce Loney, PE October 1,2009 Page 2 Task 2: Annual Vegetation Monitoring $3,648 Monitoring of the mitigation site will consist of two site visits per year to quantify and map the vegetation in each plant community per the Wetland Conservation Act (MN Rules 8420.0810) and COE Pike Lake Road permit stipulations. One site visit was completed prior to the September 22, 2009, TEP meeting. Task 3: Technical Evaluation Panel (TEP) Meetings $1,275 During the CSAH 21 permitting process, the TEP requested additional on-site meetings in order to approve the wetland mitigation site and the mitigation credits that are necessary for the CSAH 21 and Pike Lake Road projects. This task includes three TEP meeting, one of which was held on September 22,2009, and two meetings to be held each year in 2010 and 201 1. Task 4: Well Installation and Survey $3,324 The COE is requiring weekly hydrology monitoring in each plant community for the first ten weeks of the growing season and then monthly hydrology monitoring after that until the end of October. This was a condition of the COE permit, and it is our understanding the County or City did not complete this work as of the September 22,2009, Technical Evaluation Panel meeting. WSB will complete a review of the Swamp Lake Mitigation site to determine the most effective locations to monitor surface water within the mitigation site. Upon this review, one staff gauge and four (4) wells will be constructed and installed in each plant community for a total of three monitoring locations. Gauges/wells will be surveyed annually each spring to calibrate the elevation ($500 per year-$1,500 for the three year scope). This cost also includes a one-time field training session to instruct City staff on hydrology monitoring procedures to complete. Task 5: Prepare and Submit Annual Monitoring Report $1,368 WSB will process the vegetation and hydrology monitoring data annually. A wetland mitigation monitoring report will be prepared and submitted to the agencies by December 31 each year for the three year monitoring period (2009-2011). If the agencies request additional meetings outside of Task 3 to review this data, it will be discussed with the City of Shakopee prior to WSB proceeding, as this would be outside this scope of work. Task 6: Wetland Delineation $1,824 One wetland delineation will be required at the end of the mandatory monitoring period (anticipated 2011). The wetland delineation will include a written delineation report and locating the wetland boundary with GPS. The wetland credits for CSAH 21 will not be accepted by the agencies until Tasks 2 - 6 and field monitoring are complete. Sterna, PE City Clerk Vice President Mayor Date Additional Services Weekly Hydrology Monitoring It is our understanding that the City of Shakopee will carry out annual hydrology monitoring at each of the three monitoring locations on a weekly basis for the first ten weeks of each growing season and a monthly basis thereafter until the end of the October. The City of Shakopee will provide WSB with the monitoring data the following Monday (for the first ten (10) weekly sessions) and within two (2) weeks following each monthly session. If the City of Shakopee requests WSB to complete the weekly or monthly monitoring, WSB will perform the hydrology monitoring and charge the City on an hourly basis in accordance with WSB's current standard fee schedule. We estimate this additional cost to range around $220 per monitoring session. Based on monitoring for 14 monitoring sessions, the estimated cost would be approximately $3,080 per year.
