Renewal of MMUS Contract for Safety Training & Consulting City of Shako pee S. ~. 6 · MEMORANDUM TO: Mayor and City Council CONSENT Mark McNeill, City Administrator FROM: Kris Wilson, Assistant City Administrat~ SUBJECT: Renewal ofMMUA Contract for Safety Training & Consulting DATE: September 11, 2009 Introduction The Council is asked to authorize the appropriate officials to enter into the attached contract extension with the Minnesota Municipal Utilities Association (MMUA) for the provision of services related to OSHA-mandated safety compliance and training. Background Since the beginning ofthe year, the City has been contracting with MMUA to provide safety training and compliance assistance. This includes the development of policies and procedures to ensure the safety of our workplaces and both general and specialized safety training for employees. Under the contract, a designated Regional Safety Coordinator from MMUA spends two days per month in the City working to establish and operate a comprehensive, City-wide safety program that meets both state and federal OSHA requirements. The Safety Coordinator is also available to us in the case of a serious workplace accident or a visit by OSHA inspectors. This is a well established safety program utilized by Shakopee Public Utilities and numerous other cities in the metro-area. Additionally, MMUA works closely with the League of Minnesota Cities to structure their training and services for cities. MMUA operates on an October 1 - September 30 fiscal year, therefore the City's first contract ran from January 1 - September 30,2009. The attached contract would provide for the continuation ofthe same set of services from October 1, 2009 - September 30, 2010. Budget Impact The annual cost of the contract is $22,480, which is a $250 or 1.12% increase over last year. Funding for this item is included in the preliminary 2010 operating budget for the personnel division. Relationship to Vision This item is necessary in order to ensure the City's compliance with state and federal regulations, therefore it is a housekeeping item (F). Requested Action If the Council concurs, it is asked offer a motion authorizing the appropriate individuals to enter into a contract extension with the Minnesota Municipal Utilities Association for the provision of a Safety Management Program, at a cost not to exceed $22,480. Minnesota Municipal Utilities Association AMENDMENT TO SERVICES AGREEMENT Safety ManaQement PrOQram Contract Date: Auqust 14. 2009 Contract Number: 191-2010 The seNices agreement entered into between Minnesota Municipal Utilities Association (MMUA) and City of Shakopee (Shakopee), dated December 18,2008, contract number 191-2009, is amended as follows: P ART II. Section 1. 1. DURATION: This Agreement shall remain in force from October 1, 2009 until September 30,2010 (the "expiration date"). PART III. Section 1. 1. COMPENSATION: For the services covered by this Agreement, Shakopee shall pay MMUA an annual fee of twenty-two thousand four hundred eighty dollars and 00 cents ($ 22,480.00) for the Q.DQq--l-D1 annual period. Such compensation shall be due and payable according to the selected payment terms below. Payment terms for the fee agreed to above shall be based on one of the following options (select one): o Annual Payment ($22,480.00) o Quarterly Payments ($ 5,620.00 each) For any term of less than twelve full calendar months, the fee shall be a portion of the annual fee, pro-rated based on the number of calendar months or partial calendar months in which the services were provided as a percentage of twelve (12).
