CITY OF SBAKOPEE CONSE~Jr Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Request of Bituminous Roadways, Inc. for Extending Work Hours DATE: September 15,2009 INTRODUCTION: Bituminous Roadways, Inc., the contractor for the County Road 101 Improvement Project, from Sarazin Street to 70th Street, has requested that City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, be suspended for certain work hours. BACKGROUND: The above named section of the City Code restricts the hours of operation from 7:00 A.M. to 10:00 P.M. on weekdays, and from 9:00 A.M. to 9:00 P.M. on weekends and holidays. Bituminous Roadways, Inc. is requesting a suspension on the hours to allow for work 24 hours a day, Monday through Saturday, from September 28 to October 17, 2009. The contractor is looking at six to eight days within this time frame. This request is being made due to the amount of bituminous mix to be placed in a short time for the project and to place the bituminous mix at times to minimize traffic disruption. Staff would recommend that if the suspension of hours is granted from September 28 to October 17,2009, that the approval is subject to the following conditions: 1. Approval is contingent upon minimizing noise exposure. 2. If property owner complaints are received by the City, the suspension can be revoked at the discretion of the City Engineer. 3. No work on C.R. 101, from Sarazin Street to Shenandoah Drive, from 10:00 P.M. to 7:00 A.M. If Council approves the suspension, a public notice to meet the City Code requirements and notice such as a news release would be placed in the Shakopee Valley News. ALTERNATIVES: 1. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, per this memo, and direct staff to publish notice of the suspension terms with the conditions as recommended by staff. 2. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, for some other period of time as determined appropriate by the City Council, and direct staff to publish notice of the suspension terms. 3. Do not approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D. S-11.2 - Construction operations will be restricted to the hours between 7:00 a.m. and 7:00 p.m. Monday through Friday and the hours between 9:00 a.m. and 5:00 p.m. on Saturdays. We respectfully request the following; Flexibility to extend the work hours as stated above. To be variable Monday through Friday and Saturdays, dating from September 28th, 2009 to October 17th, 2009. We can not give specific dates and or times but are considering 6 to 8 days within the time frame as stated above. This request is due to inclement weather conditions and other factors that we have no control over.
