SUBJECT: Recycling Receptacle Definition

Comment:
Introduction:
The City Council is asked to modify a section of the City Code which defines acceptable
containers for recycling.
Background:
Currently, the City Code does not differentiate between garbage containers and recycling
containers, requiring each to be constructed of "weather proof, insect and road proof
materials". A resident contacted me, stating that the language was inconsistent with the
type of recycling bins provided by the City's contract hauler.
The recycling containers that are the subject of this question and used by Dick's
Sanitation for the Shakopee contract were provided by the City, and funded through a
grant received from Scott County.
While the City Code language specifically addresses the type of materials of which the
container is constructed (for example, wood construction would not be acceptable), it
might be argued that the function of the open-topped recycling containers for the City
contract is not insect and rodent proof. In order to resolve this discrepancy, we are
recommending that the definition of the acceptable recycling receptacle be amended, and
specify that the recycling containers themselves shall be constructed of a durable material
such as plastic or metal.
If the Council wishes to consider requiring the recycling containers to be insect and
rodent proof, they should be aware that the current contract hauler is scheduled to talk
with the City Council at an upcoming meeting about going to a "one sort" container
which would meet the insect and rodent proof standard.
Recommendation:
I recommend that the City Code be amended to redefine acceptable recycling containers.
Relationship to Visioning:
This supports Goal F, "Housekeeping"
Action Required:
If concurs, the Council, should, by motion, adopt Ordinance No. 825:

AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA,
AMENDING CITY CODE SECTION 3.15, SUBDIVISION 1, PARAGRAPH E
RELATING TO THE DEFINITION OF REFUSE AND RECYCLING
RECEPTACLES
THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA,
ORDAINS:
Section 1. City Code Section 3.15, Subdivision 1, Paragraph E is amended to
read as follows:
SEC. 3.15. RULES AND REGULATIONS RELATING TO SOURCE SEPARATION,
COLLECTION AND DISPOSAL OF REFUSE.
Subd. 1. Definitions. As used in this Section, the following terms shall have the following
meanings:
E. "Receptacle" ,means, with respect to refuse receptacles, individual containers
constructed of weather proof, insect and rodent proof materials such as plastic or
metal for refuse and recycling purposes and, with respect to recyclinq receptacles,
individual containers constructed of a durable material such as plastic or metal
suitable for holdinq recyclable materials.
Section 2 - - Effective Date. This ordinance becomes effective from and after its
passage and publication.
Adopted in session of the City Council of the City of Shakopee,
Minnesota held the day of ,2009.
