(j~ Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Jeff Weyandt, Assistant City Engineer SUBJECT: Assessment Hearing for the Church Addition Improvements, Project No. 2009-7 DATE: August 5, 2009 INTRODUCTION: Attached is Resolution No. 6925, a resolution which adopts the assessment for the above referenced proj ect. BACKGROUND: The final project cost for the proposed improvements is $165,890.00, which consists of construction costs, financing costs and engineering/administration costs. 100% of the project costs will be assessed to the undeveloped parcels within the Church Addition Development. The commercial property located adjacent to Kin'lock Way will be assessed 28.5% of the improvements. The remaining costs will be assessed on a parcel basis to the 79 undeveloped townhome parcels. The assessment for the commercial property is $47,278.61. The assessment rate for the townhome parcels is $1,501.41 per parcel. Attached to this memo is a map of the project area and the assessment roll for Council consideration and adoption. AL TERNA TIVES: 1. Adopt Resolution No. 6925. 2. Deny Resolution No. 6925. 3. Assistant City Engineer JW/pmp ENGR/2009-PROJECTS/CHURCH-ADDITIONIWORDIMEM6925-ADOOPT-ASSESSMENTS RESOLUTION NO. 6925 A Resolution Adopting Assessments For The Church Addition Improvements Project No. 2009-7 WHEREAS, pursuant to proper notice duly given as required by law, the City Council of the City of Shakopee met and heard and passed upon all objections to the proposed assessments of: The Area proposed to be assessed for such improvement is: Those properties lying within Section 16, Township 115, Range 22, Scott County, Minnesota. Said properties being further described, but not inclusive: . Properties adjacent to Kinlock Way, Jarmann Lane, Rymark Court and Blakewood Drive NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. That such proposed assessment together with any amendments thereof, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named herein and each tract therein included is hereby found to be benefitted by the proposed improvements in the amount of the assessments levied against it. 2. Such assessments shall be payable over a period of five years, the fIrst installment to be payable on or before the fIrst Monday in January, 2010, and shall bear interest at the rate of 5.75 percent per annum from the date of the adoption of this assessment resolution. To the fIrst installment shall be added the interest on the entire assessment from the date of this resolution until December 31, 2010, and to each subsequent installment when due shall be added the interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within thirty (30) days from the adoption of this resolution; the owner may thereafter pay to the County Treasurer the installment and interest in process of collection on the '.', ,'.. current tax list, and may pay the remaining principal balance of the assessment to the City Treasurer. 4. The Clerk shall file the assessment rolls pertaining to this assessment in her office and shall certify annually to the County Auditor on or before November 30th of each year the total amount of installments and interest on assessments on each parcel of land which are to become due in the following year.
