Sewer Backup Claim CITY OF SHAKOPEE J ~. c; /, Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Sewer Backup Claim from Terry Sturlaugson at 834 Scott Street South DATE: July 7, 2009 INTRODUCTION: Attached is a letter from Terry Sturlaugson of 834 Scott Street South who is requesting to discuss a sewer backup incident to his house on April 7, 2009. BACKGROUND: A sewer backup did occur on April 7, 2009 and damage did occur to the residence at 834 Scott Street. Attached are the following items in conjunction with discussion of this letter. . Report from LMCIT adjuster on the sewer backup incident and his determination of the City's liability. . Cost estimate of repair and cleanup of the damage. . E-mail from LMCIT adjuster on reimbursement of damage. Mr. Sturlaugson would like to address the Council on his damage and cost as our insurance has determined that the City is not liable. The property damage has been estimated at $2,276.82 for cleaning and $10,642.68 to repair the damage or a total of $12,919.50. Staff did have our insurance adjuster review the claim and his assessment is that the cleaning cost is acceptable but the repair work is high, as there was no hardwood flooring in the basement. The flooring was carpet, vinyl and concrete in the rooms affected. If the City was to offer compensation an offer of $7,276.82 is recommended by the LMCIT adjuster. The options for the City is as follows: 1. Offer no compensation and allow the matter to go to court. 2. Offer a reduced compensation as recommended by our adjuster. 3. Offer a full compensation as submitted. The City did offer reduced compensation in October, 2005 to a resident who experienced damage and the City was not liable. The original claim was $16,600.00, then reduced to $12,000.00 and the City did eventually offer $10,750.00 which was accepted. Staff recommends to discuss the matter with the resident on his claims and provide direction to staff and the resident on this matter. One more note is that the resident does not have sewer backup insurance coverage. ALTERNATIVES: 1. Approve a motion concurring with the LMCIT recommendation and deny the claim. 2. Approve a motion offering a compensation amount as a settlement with a release signed by the property owner. 3. Table for additional information. RECOMMENDATION: As discussed on June 16,2009, on sewer backup claims in which the City is determined not to be liable, would be discussed on a case by case basis. Council will need to discuss this matter after hearing from the resident. This will follow-up my meeting with you at your home on April 10, 2009. I have reviewed City policy, as well as the specifics of this claim, and have completed my investigation into this matter. Based upon my findings, there is no indication of any negligence on the part of the City of Shakopee in causing or contributing to this sewer backup incident and the resulting damages to your property. Based upon these findings, there is no legal liability on the part ot the City, and I must respectfully deny your claim. I regret that I cannot advise you more favorably. Following is information obtained during my investigation. The City schedules routine maintenance of the City sanitary sewer system over a three-year cycle. The section of the City sanitary sewer main where this recent blockage incident occurred was last jetted/ cleaned on October 16, 2007. No problems were noted . " with the City sewer main at that time. In an effort to aggressively maintain the City sewer system, the City performs root foaming work in older areas of the sewer system which have clay tile pipe. The root foaming procedure is used to kill tree root growth and to prevent tree root growth. The root foaming process has a three year guarantee. The area where this recent blockage incident occurred was last root foamed on September 26, 2006. Furthermore, the area where this blockage occurred was televised on March 1, 2006. No problems were noted at that time. In summary, this maintenance history indicates that the City has been in compliance with their routine maintenance schedule, and they have performed extra maintenance work in an effort to prevent tree root growth within the City sanitary sewer system. Regarding this most recent incident affecting your home on April 7, 2009, the City was unable to clarify the cause of the blockage. The City was unable to clearly observe any substance of significant size in the sewage flowing into the downstream manhole after the blockage was cleared. The City indicates that they may have seen a bundle of tree roots, or something dark of significant size, but they were unable to retrieve anything and could not get a clear look at anything. If it was a large bundle of tree roots that got hung up within the City sanitary sewer main, the source.of any such tree roots would have been from a private sewer drain line somewhere upstream from the blockage location. It is common for plumbing companies or sewer service companies to cut tree roots out of private service drain lines and push the tree root debris into the City sanitary sewer system. The City has no control over what private parties may put into the City sanitary. sewer system. No one notified the City of any tree root cutting activities in your neighborhood prior to this blockage incident. The City was first notified of this recent blockage problem by means of your telephone call to the City at approximately 8:16 PM on the evening of April 7, 2009. There is no indication of any delay on the part of the City after they were notified of this blockage problem. Minnesota courts have consistently ruled that there are four (4 ) factors that must be considered when deciding whether or not a municipality can be held liable for damages resulting from a sewer backup. These are: . There must be a defect in the City's main sewer line. . The City must have had notice or knowledge of the defective condition in the City's main sewer line. . Upon notice of the defect, the City failed to respond in a reasonable time. . As a direct result of the City's failure to respond, damages occurred. Based upon my investigation, the blockage incident on April 7, 2009 was the Cityts first notice of a defective condition within the City's sewer main line in the area where the blockage occurred. The City responded within a reasonable time once they were on notice of this defective condition. Based upon all of the available information, there is no indication that the City would be held liable for your damages resulting from this recent sewer backup incident, and on this basis no compensation is being offered to you. That work was completed, and the charges by Coit for the services they rendered should be considered acceptable. -The scope of the dwelling rebuild appear generally accurate with one exception. There was no hardwood flooring in the basement. The utility room had a concrete slab surface. The Laundry, Bathroom and Bedroom Closet had vinyl (tile) flooring. The Family Room, Bedroom and Hallway had carpet over pad. You should note that in Coit's service bill, they charged for tearing up wet carpet and pad in the basement (family room), bedroom and hall. All of the flooring was affected, so the accurate scope of the flooring damages would be to go back with average grade carpet and vinyl flooring, not hardwood flooring. Since I don't know how much labor charges are being made for which trades, I do not know what adjustment should be made in the labor category of the Sturlaugson's proposal. The materials category should be reduced by approx.$1 ,050 - $1,400 to account for the difference in the $4/s. f. costs for hardwood flooring compared to average grade carpet & pad material costs of approx. $2 - $2.50/s.f. IF the City is contemplating compensation to the Sturlaugson's, my recommendation would be to offer them reimbursement of the Coit service billing plus $5,000. They clearly misrepresented their damages with regard to the hardwood flooring vs. the carpet. The $5,000 is much closer to the Fair Market Value of their loss (for the building repairs) , and the City has a very strong case for defending itself with regard to any allegation of legal liability. .- I hope these comments in this message are helpful.
