INTRODUCTION:
The Police Department is requesting approval for appropriate city officials to enter into
an agreement for voluntary police services for the 2009 PGA Golf Championship.
BACKGROUND:
In February 2009, the City of Shako pee was officially requested by the City ofChaska to
assist with the 2009 PGA Golf Championship being held in Chaska during August 2009.
The official request is attached to this memorandum. The Volunteer Police Services
Agreement has recently been reviewed by the City Attorney to permit Shakopee Police
Officers to assist Chaska during this event. It is understood that the City of Shakopee is
not obligating itself to provide police officers to the City of Chaska under this agreement
and that any Shakopee police officers will be serving solely on a voluntary basis for the
City of Chaska.
In relation to questions regarding the Fair Labor's Standard Act and worker's
compensation coverage, Shakopee Officers will not be compensated by the City of
Shakopee and will be working completely on a voluntary basis. Under the terms of the
agreement, the City of Shakopee agrees to provide worker's compensation coverage for
their officers. Historically this event has generated very few law enforcement contacts,
other than those associated with traffic and is regarded by staff as low risk. City staff also
feels that the important to continue to support our neighboring agencies and continue the
strong partnership with the Chaska Police Department by allowing Shakopee officers to
volunteer for this event.

RECOMMENDATION:
Staff recommends Alternative #2, execution of the agreement.
BUDGET IMP ACT:
Shakopee Officers will not be compensated by the City of Shakopee and will be working
completely on a voluntary basis
ACTION REQUESTED:
If the Council concurs, they should, by motion, authorize appropriate city officials to
enter into the Volunteer Police Services Agreement for the 2009 PGA Championship,
August 9th through August 18th, 2009.

Dear Chief/Sheriff:
As you may know, my city is the home of the Hazeltine National Golf Club. We have been the site of many
major amateur and professional golf tournaments, such as the 1991 U.S. Open, 2006 U.S. Amateur, and the
2002 PGA Championship to name a few. This year - August 10 through 16 - we will host the 2009 PGA
Championship. This tournament is one of golf's "Top Four" championships, with the other three being the
Masters, the British Open, and the U.S. Open.
I am the PGA Committee Chair of Public Safety and Security. My department has the command and control
responsibility for law enforcement and security functions on the golf course. I term this as "inside-the-fence",
which includes any and all tournament public safety and security functions occurring relative to actual player,
spectator, vendor, and course protection needs. My area of command does not cover traffic control
functions. Those functions will again be -expertly- handled by the Minnesota State Patrol. Our other partners
are the FBI, ATFE, Secret Service, and US Postal Inspectors.
Many metro and out-state officers have worked our past events, and have contacted us expressing an
interest in working this 2009 event.
I am able to again offer interested officers (and spouses) a day of free admission in exchange for each day
they work. Many officers have a desire to work the entire event, because they get the "best seats in the
house." Meals will be provided for working officers.
Uniformed officers would be assigned to duties such as:
. Player escort (Primary)
. Dignitary escort (Secondary)
. High profile presence on the course
Officers can be assured that a large contingent of private security will be employed and in place to staff the
more routine, and mundane (yet important) assignments associated with this type of an event.
Here is what I need from you:
. Your approval of this use of any of your officers.
. Getting this information out to your officers.
. A Joint Powers Agreement between our units of government (a standard agreement, which I will
provide for your review)

POLICE SERVICES JOINT POWERS AGREEMENT
2009 PGA CHAMPIONSHIP - AUGUST 10 - 16,2009
AGREEMENT, Made this day of , 2009, by and
between the CITY of SHAKOPEE a Minnesota municipal corporation, and the CITY
OF CHASKA, a Minnesota municipal corporation (hereinafter "Chaska");
WHEREAS, the Chaska Police Department has requested the aid and
assistance of the City of Shakopee with the provision of policing services and other
related activities at the 2009 PGA Championship, August 10 - 16, 2009; and
WHEREAS, the cities of Chaska and Shakopee are authorized to enter into an
agreement authorizing the exercise of police powers within the jurisdiction of Chaska,
pursuant to Minnesota Statutes, Section 471.59; and
WHEREAS, it is in the best interest of the City of Chaska to enter into this
Agreement in the interest of public health, safety and welfare.
NOW, THEREFORE, the parties agree as follows:
1. PURPOSE.
As requested by the City of Chaska, the City of Shakopee will
. provide policing services at the 2009 PGA Championship and other
related activities on August 10 - 16, 2009, in the City of Chaska. It is
understood that the City of Shakopee is not obligating itself to provide
police officers to the City of Chaska under this agreement and that any
Shakopee police officers will be serving solely on a voluntarily basis for
the City of Chaska.
2. COMMAND OF SCENE.
The City of Chaska shall be in command of the scene and will make
issue and duty assignments. When appropriate and practical, Chaska
officers, at the request of City of Shakopee officers, will
handle the citing and arrests of persons, as circumstances require.
The personnel and equipment of the City of Shakopee shall be
under the direction and control of the City of Chaska until the City
of Shakopee withdraws assistance.
3. WORKER'S COMPENSATION.
Each party shall be responsible for injuries or death of its own
personne1. Each party will maintain worker's compensation
insurance or self-insurance coverage, covering its own personnel
while they are providing assistance pursuant to this Agreement.
Each party waives the right to sue any other party for any worker's
compensation benefits paid to its own employee or volunteers.
4. DAMAGE TO EQUIPMENT.
Each party shall be responsible for damages to or loss of its own
equipment. Each party waives the right to sue any other party for
any damages to or loss of its equipment, even if the damages or
losses were caused wholly or partially by the negligence of any
other party or its officers, employees or volunteers.
5. LIABILITY.
A. For the purposes of the Minnesota Municipal Tort Liability
Act only (Minnesota Statutes, Section 466), the employees
and officers of the City of Shako pee are deemed to be employees (as
defined in Minnesota Statutes, Section 466.01, Subdivision 6) of the
City of Chaska.
B. The City of Chaska agrees to defend and indemnify the City
Of Shakopee against any claims brought or actions
filed against the City of Shakopee or any officer,
employee or volunteer of the City of Shakopee for
injury to, death of, or damage to the property of any third
person or persons, arising from the performance and
provision of assistance pursuant to this Agreement.
C. Under no circumstances, however, shall a party be required
to pay on behalf of itself and other parties, any amounts in
excess of the limits on liability established in Minnesota
Statutes, Chapter 466, applicable to anyone party. The limits
of liability for some or all of the parties may not be added
together to determine the maximum amount of liability for
any party.
6. COMPENSATION.
Officers will not be monetarily compensated for shifts worked.
The City of Chaska will provide meals to uniformed officers

working shifts. Officers will be offered from the Professional
Golfers Association (PGA) a day of free admission to the
Championship in exchange for each full day (minimum of 8
hours) of uniformed shift work.
7. SEVERABILITY.
If any portion of this Agreement is found to be illegal, that portion
of the Agreement shall be severed and the remainder ofthe
Agreement shall remain in full force.
8. AMENDMENT.
This Agreement may only be amended in writing by agreement by
both parties.
