Authorize Execution of Instruments and Agreements for the CSAH 21 Project 5 6. f CITY OF SHAKOPEE Memorandum cn~,~~ ,"~1l!! .. ~,U ~i~i :;) ~ I<i TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Authorize the Appropriate City Officials to Execute Instruments/Agreement for Right-of-Way (CSAH 21) Project DATE: July 21,2009 INTRODUCTION: Attached are Instruments/Agreement for execution by the City for right-of-way needed for the CSAH 21 Improvement Project, from CSAH 42 to CSAH 18. BACKGROUND: In conjunction with the CSAH 21 Improvement Project, the City and County have executed a Construction Cooperative Agreement dated April 9, 2009. In that agreement the City was to provide the necessary easements and other instruments for right-of-way for the County in order to construct the road, from CSAH 42 to CSAH 18. Attached is a letter from Randy Ronning and also the various instruments that need appropriate City Official's signatures in order to provide the necessary right-of-way for the road construction. These instruments and agreement are listed in the letter from Randy Ronning and also as follows: . An instrument entitled Warranty Deed by which the City conveys to the County right-of- way described as "Parcel 3" on Scott County Right-of-Way Plat No. 60 and as "Parcell" on Scott County Right-of-way Plat No. 61. . An instrument entitled Quit Claim Deed by which the City conveys to the City the remaining parcel as described in its Exhibit "A" to satisfy recording requirements by use of Right-of-Way Plats. . An instrument entitled Drainage and Utility Easement by which the City grants to the County easements for drainage and utility purposes described as "D.U.E. I" on Scott County Right-of-Way Plat No. 61 and as "D.U.E. 4" on Scott County Right-of-Way Plat 62. . An instrument entitled Temporary Construction Easement by which the City grants the County temporary easements for construction purposes described as "T.E. 1" on Scott County Right-of-Way Plat No. 61 and as "T.E. 3" on Scott County Right-Way Plat No. 60. . An agreement entitled Right-of-Entry Agreement for Parcel No. 33 (a!k/a Fire Station Parcel). With this agreement and instruments, Right-of-Way Plat No. 60 and 61 are enclosed for use in describing the parcels as previously described. Also attached to these agreements and Right-of- Way Plat No. 60 and 61 is a parcel sketch of the City's parcel that was purchased from the Shutrop's and the impact of the County highway to this parcel. ALTERNATIVES: 1. Authorize the appropriate City Officials to execute the four instruments for warranty deed, quit claim deed, drainage and utility easements and temporary construction easements and the right-of-entry agreement by the City to the County for the CSAH 21 Project. 2. Do not execute the instruments and agreement for the CSAH 21 Project at this time. 3. Table for additional information. RECOMMENDATION: Staff would recommend Alternative No.1, as these easements are necessary to complete the project and comply with the provisions in the Construction Cooperative Agreement, previously made by the City and the County on April 9, 2009. Minnesota Dear Mr. Loney: Enclosed are instruments and an agreement for the City to convey and grant right-of-way associated with an extension on new alignment of County State Aid Highway No. 21 ("CSAH 21") under Project SP 70-621-024 (CP 21-15). Weare presenting the enclosed instruments and agreement for execution by the City and thereafter delivery to the County. The enclosed instruments and agreement comply with the provisions in a Construction Cooperative Agreement dated April 9,2009 made by and between the City and the County. (hereinafter referred to as "subject property") WHEREAS, the County is planning to construct an extension of County State Aid Highway No. 21 ["CSAH 21"] and appurtenances on new alignment from its intersection with County State Aid Highway No. 42 northerly and easterly to its intersection with County State Aid Highway No. 18 near an interchange with US 169 under its highway project known as Project SP 70-621-024; WHEREAS, the City is a partner in the County's project, which includes the City, under its Shakopee Public Utilities Commission, extending its utility services as part of the County's highway project; WHEREAS, the State of Minnesota's Department of Transportation ("Mn/DOT'), the City and the County have entered into a Memorandum of Understanding dated November 18, 2008, which provides for a pending transaction by and between the parties regarding Bridge #4175, Parcel #75 and about six (6) acres adjacent to CSAH 21; WHEREAS, the said about 6 acres adjacent to CSAH 21 has been described in the attached Exhibit "A" and shown on a drawing attached as Exhibit "B"; WHEREAS, in the meantime, the County desires to enter onto the subject property for the purposes of commencing construction operations and activities associated with and to construction of an extension on new alignment of CSAH No. 21; WHEREAS, the City is willing to grant a temporary easement to construct and right of entry over, under and across the subject property. [2] NOW THEREFORE, FOR VALUABLE CONSIDERATION and the mutual covenants and agreements set forth, it is hereby agreed: 1. The City does hereby grant to the County, its employees, agents, contractors, successors and assigns, temporary easements to construct and right of entry over, under and across that part of the subject property, which is described on the attached Exhibit "A" and as shown on a drawing attached hereto as Exhibit "B." 2. The City hereby agrees that the temporary easements to construct and right of entry shall be and continue in full force and effect until terminated by the City executing and delivering instrument(s) in the favor of Scott County and in a form acceptable to Scott County, which conveys and warrants by parcel split in fee the real property as described in the attached Exhibit "A" and shown on a drawing attached as Exhibit "B", when a Construction Cooperative Agreement for CSAH 21 is entered into by and between the City and the County. 3.
