INTRODUCTION:
Attached is Resolution No. 6913, a resolution receiving a report and calling for a hearing
and Resolution No.6914, a resolution declaring the costs to be assessed, ordering the
preparation of proposed assessments and setting an assessment hearing date for the
Church Addition Improvements, Project No. 2009-7.
BACKGROUND:
Church Addition final plat was approved on June 1, 2004 and the public utilities, curb
and gutter and the first layer of pavement was completed in 2004. Much of the building
was also completed in the following years and staff has been working with the developer
to complete the public improvements, which consists mainly of the final bituminous
wearing course. The security was a Letter of Credit from a bank that is no longer in
business. In addition, Tollefson Development is being foreclosed on its development by
the bank that did the financing for the development. At the June 16, 2009 City Council
meeting, Council directed staff to complete the public improvement project with a 429
assessment project and assess the undeveloped properties in the Church Addition for
these improvements. To complete the improvements in 2009, the City should follow the
following schedule:
. July 7 - Approve Resolution No. 6913, a resolution receiving a report and calling
for a hearing.
. July 7 - Approve Resolution No. 6914, a resolution declaring the cost to be
assessed, ordering the preparation of proposed assessments and setting an
assessment hearing date.
. August 5 - Conduct a public hearing for the improvements, order the
improvement, approve plans and conduct the assessment hearing.

If property owners do not reserve their right to appeal the assessment during the
assessment hearing the next step would be to approve a change order to the 2009
Bituminous Overlay Project.
If property owners do reserve their right to appeal the assessment a change order should
not be approved until August 18,2009.
Staff will make a full presentation at the August 5, 2009 public hearing on the feasibility
report to the public and the City Council.
ALTERNATIVES:
1. Adopt Resolution No. 6913. This action will receive the feasibility report and set
the date for the public hearing for August 5, 2009.
2. Deny Resolution No. 6913. This action will halt the project until such time that
City Council reconsiders the resolution.
3. Move to receive the feasibility report but do not set a date for the public hearing at
this time. This action will place the project on hold until such time as the City
Council sets a date for the public hearing.
4. Table Resolution No. 6913 to allow time for staff to prepare additional
information and/or revise the feasibility report as directed by the City Council.
5. Adopt Resolution No. 6914. This action will declare the costs to be assessed,
order the preparation of proposed assessments and set an assessment hearing for
August 5, 2009.
6. Deny Resolution No. 6914. This action will haltthe project until such time that
City Council reconsiders the resolution.
7. Table Resolution No. 6914 to allow time for staff to prepare additional
information.
RECOMMENDATION:
1. Offer Resolution No. 6913, A Resolution Receiving a Report and Calling a
Hearing for the Church Addition Improvements, Project No. 2009-7 and move its
adoption.
2. Offer Resolution No. 6914, A Resolution Declaring the Costs to be Assessed,
Ordering the Preparation of Proposed Assessments for the Church Addition
Improvements, Project No. 2009-7 and move its adoption.

WHEREAS, pursuant to a motion passed by the City Council on June 16,2009, a report
has been prepared by the City Engineer, with reference to the Church Addition Improvements,
Project No. 2009-7, and this report was received by the Council on July 7, 2009.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SHAKOPEE, MINNESOTA:
1. The Council will consider the Church Addition Improvements and all appurtenant work
in accordance with the report and the assessment of abutting and benefited property for all or a
portion of the cost of the improvements pursuant to Minnesota Statutes Chapter 429 at an estimated
total cost of the improvement for the Church Addition Improvements of $165,890.00.
2. A public hearing shall be held on such proposed improvements on the 5th day of August,
2009, at 7 :00 P.M. or thereafter, in the Council Chambers of City Hall, at 129 South Holmes Street,
Shakopee, Minnesota, and the Clerk shall give mailed and published notice of such hearing and
improvement as required by law.
3. The work of this project is hereby designated as part of the 2009-7 Public Improvement
Project.

RESOLUTION NO. 6914
A Resolution
Declaring The Costs To Be Assessed
And Ordering the Preparation Of Proposed Assessments
For The Church Addition Improvements
Project No. 2009-7
WHEREAS, a report has been prepared for the proposed improvements and the
final estimated project cost for the improvements is $165,890.00 and the City Council has
ordered the Church Addition Improvement Project by Resolution No. 6913.
NOW, THEREFORE, DE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SHAKOPEE, MINNESOTA:
1. The cost of such improvement to be specially assessed is hereby declared to
be $165,890.00.
2. The City Clerk, with the assistance of the City Engineer, shall forthwith
calculate the proper amount to be specially assessed for such improvement against every
assessable lot, piece, or parcel of land within the district affected, without regard to cash
valuation, as provided by law, and keep a copy of such proposed assessment in her office
for public inspection.
3. That the City Clerk shall, upon the completion of such proposed assessment,
notify the City Council thereof.
BE IT FURTHER RESOLVED:
1. That a hearing shall be held on the 5th day of August, 2009, in the Council
Chambers of City Hall at 7:00 P.M. or thereafter, to pass upon such proposed
assessments and at such time and place all persons owning property affected by such
improvements and proposed assessments will be given an opportunity to be heard with
reference to such assessment.
2. That the City Clerk is hereby directed to cause a notice of the hearing on the
proposed assessment to be published once in the official newspaper of the City of
Shakopee at least two weeks prior to the hearing and she shall state in the notice the total
cost of the improvements. She also shall cause mailed notice of such hearing to be given
to the owner of each parcel described in the assessment roll not less than two weeks prior
to the hearing.

1. INTRODUCTION
On June 16, 2009 the City Council ordered the preparation of a feasibility report
to complete the Church Addition development.
2. BACKGROUND
The developer for Church Addition has not completed the improvements and did
not supply the City with a valid financial security to complete the improvements.
As a result, the City will complete the improvements and assess 100% of the costs
to the undeveloped parcels within the development. The streets have a reduced
load capacity and need this improvement to increase the load capacity for
construction of undeveloped parcels.
3. PROPOSED IMPROVEMENTS
The proposed improvements consist of general site cleanup, pedestrian ramp
repairs, crack repair and placement of the final lift of bituminous.
4. SPECIAL ASSESSMENTS
100% of the project costs are proposed to be assessed to the undeveloped parcels
within Church Addition. The commercial property located adjacent to Kin10ck
Way will be assessed 28.5% of the improvements. The remaining costs will be
assessed on a parcel basis to the 79 undeveloped townhome parcels. The
estimated assessment rate for the commercial parcel is $47,278.61. The estimated
assessment rate for the townhome parcels is $1,501.41 per parcel. A cost
estimate, assessment map and preliminary assessment roll are included in the
Appendix.
5. CONCLUSION
The total estimated project cost is $165,890.00. From an engineering standpoint
the improvements are feasible, cost effective and necessary for the preservation of
the existing infrastructure.
