DISCUSSION
Mattamy Homes submitted an application on April 24th requesting final plat approval of Riverside Bluffs
Second Addition, proposed for property north of Eagle Creek Blvd. and generally west of Foothill Trail. The
plat, as currently proposed, contemplates the construction of37 single family homes and several outlots on
approximately 17 acres. The preliminary plat was approved on September 6, 2005, and the First Addition of
the final plat was approved on September 5, 2006.
Staff received comments from City Engineering, Scott County Public Works, Parks, Recreation, and Natural
Resources Director, and SPUC. Additionally, staff received comments from Centerpoint Energy, which noted
that the developer is to work with them on proposed work surrounding the natural gas high-pressure transmission
pipeline, and from the City Finance Department, which noted that there is a special assessment of$24,386.99 for
the 2006 sewer extension project that will need to be paid off. Staff has incorporated the comments and
conditions into the draft resolution.

RESOLUTION NO. 6916
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE FINAL
PLAT OF RIVERSIDE BLUFFS SECOND ADDITION
WHEREAS, Mattamy Homes, applicant and property owner, has made application for final
plat approval of Riverside Bluffs Second Addition; and
WHEREAS, the subject properties are legally described as:
Outlot C, Riverside Bluffs First Addition
WHEREAS, the Shakopee Planning Commission conducted public hearings on the
preliminary plat on April 7, April 21, and May 5, 2005; and
WHEREAS, all required public notices regarding the public hearing were posted and sent; and
WHEREAS, the Shakopee Planning Commission had recommended denial of the requested
preliminary plat; and
WHEREAS, the City Council reviewed the preliminary plat request at its meetings of June 21,
August 16, and September 6, 2005; and
WHEREAS, the City Council reviewed the final plat request at its meeting on July 7,2009.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SHAKO PEE, MINNESOTA, THAT THE FINAL PLAT FOR RIVERSIDE BLUFFS
SECOND ADDITION IS APPROVED SUBJECT TO THE FOLLOWING CONDITIONS:
I. The following procedural actions must be completed prior to approval of a grading
permit and/or a street/utility plan:
A. The applicant has yet to receive approval of the site's storm water management
plan. Please see the attached memo from Todd Hubmer and Steve Gurney of
WSB & Associates, Inc. dated July 1, 2009 outlining the items that need to be
addressed in order to approve the plan.
B. No public improvements (site grading and street and utility) will be constructed
until the City Engineer and the Shakopee Public Utilities Commission (SPUC)
approves the required Final Construction Plans and Specifications.
C. The applicant shall grade the entire site, as proposed on the submitted plans, in
one phase within one year from the date of approval of the grading permit
application. Grading will be defined as bringing the site up to the proposed
finished grade with materials deemed acceptable by the City of Shakopee
engineering department, providing topsoil per City requirements and applying
seed, mulch and/or sod per City requirements and providing an as-built grading
plan per Section 2.5 of the City of Shakopee Design Criteria.
D. The applicant shall obtain a NPDES permit prior to any land disturbing activity.
A copy of this permit shall be provided to the City Engineering Department.
E. The applicant shall submit pavement design calculations to the City Engineer.

F. The applicant shall obtain the necessary CenterPoint Energy permits/approvals
prior to any land disturbing activity within their easement.
G. The applicant shall show the grading and erosion control associated with the
crossing ofthe bypass channel to the north of Lots 1-3 of Block 2.
H. The applicant shall remove all landscaping from within drainage and utility
easements per the most recent version of the City of Shakopee Easement Fencing
and Landscaping Policy. Areas that are not in compliance include, but are not
limited to, the following:
. Drainage and utility easements encompassing the approved high water level
of the storm water basin.
. The drainage and utility easement centered on the storm sewer alignment
from AP 5012 to MH 5011 to MH 5010.
1. The applicant shall provide a minimum of four (4) feet of cover over the top of
the public sanitary sewer between MH G and MH H.
J. The applicant shall provide a plan and profile for the sanitary sewer from MH A
to the end of the eight (8) inch stub between Lots 7 and 8 of Block 4.
K. The applicant shall install sod the full width of the drainage and utility easement
from CB 5000 to CB 5001 to CB 5002.
L. The applicant shall obtain a permit from the Prior Lake - Spring Lake Watershed
District (PLSL WD) for the Oak Ridge Trail crossing of the Prior Lake Outlet
Channel.
M. The applicant shall provide a bituminous trail crossing over the bypass channel
located to the north of Lots 1-3 of Block 2.
N. The applicant shall provide the engineered plans, specifications, details and other
pertinent information for the retaining walls and ornamental fencing.
O. No landscaping, ponding, berming, or signage shall be permitted within the
County right-of-way.
P. Any work within the County right-of-way shall require a County permit.
II. The following procedural actions must be completed prior to the recording of the
Final Plat:
A. Approval oftitle by the City Attorney.
B. Execution of a Developer's Agreement, which needs to include provisions for
security for public improvements within the Final Plat as well as payment of
engineering review fees, and any other fees as required by the City's adopted fee
schedule.
1. Street lighting to be installed in accordance with the requirements of the
Shakopee Public Utilities Commission.
2. Electrical system to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
3. Water system to be installed in accordance with the requirements of the
Shakopee Public Utilities Commission.
4. The developer shall be responsible for payment of Trunk Storm Water
Charges, Trunk Storm Water Storage and Treatment Charges, and Trunk
Sanitary Sewer Charges, as required by the most current City of
Shakopee Fee Schedule.

5. Street construction, sidewalks, trails and retaining walls shall be
constructed by the developer, consistent with the City Engineering
requirements.
C. A security, in an amount to be determined by the City Engineer, shall be
provided until construction of the storm sewer from CB 5000 to CB 5001 to CB
5002 is completed by the applicant and formally accepted by the City.
D. Payments of Trunk Sanitary Sewer Charges shall be made, as required by the
most current City of Shakopee Fee Schedule.
E. Payments of Trunk Storm Water Charges and Trunk Storm Water Storage and
Treatment Charges shall be made, as required by the most current City of
Shakopee Fee Schedule.
F. Provide electronic files (AutoCAD and Adobe Acrobat formats) of the Final Plat
to be recorded with datum on the Scott County coordinate system to the City
Engineering Department.
G. The applicant shall submit a drawing clearly showing how the entire site will be.
served by private utilities.
H. The applicant shall initiate the process for vacating the roadway easement
(document number 142601) along the west plat boundary.
1. The applicant shall incorporate Outlot E and Outlot F into the adjacent lots.
J. The applicant shall vacate the drainage and utility easement encompassing the
former alignment of the Prior Lake Outlet Channel (document number 279888).
K. Easements shall be shown on the Preliminary and the Final Plat as approved by
the City Engineer. They shall include, but not be limited to, the following:
1. Minimum drainage and utility easements for public sanitary sewer and
public storm sewer need to be dedicated per the City of Shakopee Design
Criteria, Section 10.1 (A-D). The easements need to be centered along
the public utility alignments.
2. Provide a drainage and utility easement over all of Outlot C. For the
storm sewer from CB 5000 to CB 5001, provide a minimum often (10)
feet of drainage and utility easement to the east of the utility alignment.
Denote the dimension on the plat drawing.
3. For the storm sewer from CB 5001 to CB 5002, provide a minimum of
twenty-eight (28) feet of drainage and utility easement to the east of the
utility alignment and west of the utility alignment to the plat boundary.
Denote the dimension on the plat drawing.
4. For the storm sewer from AP 5012 to MH 5011 to MH 5010, provide a
minimum of forty (40) feet of drainage and utility easement, centered
along the utility alignment. Denote the dimension on the plat drawing.
5. For the sanitary sewer from MH A to the end of the eight (8) inch stub
between Lots 7 and 8 of Block 4, provide a minimum of forty (40) feet of
drainage and utility easement, centered along the utility alignment.
Denote the dimension on the plat drawing.
L. The applicant shall pay the special assessment for the 2006 sewer extension
project.
M. The final trail alignment shall be determined prior to grading and installation.
Connecting sidewalks/trails shall be provided throughout the development as
required by the City.

N. Temporary street signs shall be provided prior to issuance of building permits,
and shall remain until such time that permanent street signs are installed.
O. Building permits may be issued in areas where sidewalks are not completed;
however, issuance of occupancy permits shall not occur until the sidewalks are
completed.
P. The applicant shall properly vacate all unnecessary easements.
III. The following items need to be addressed/completed prior to issuance of a building
permit:
A. Record plans shall be provided per the City of Shakopee Design Criteria, Section
2.5 and Section 11.2 (A-L). The record plans need to be submitted to the
engineering department.
B. The applicant shall vacate the drainage and utility easement encompassing the
former alignment of the Prior Lake Outlet Channel (document number 279888)
prior to issuance of any building permits on Lot 10 of Block 1 and Lot 21 of
Block 4.
C. The applicant shall obtain an easement prior to performing the grading
improvements and storm sewer improvements on the property to the west of the
subdivision. These improvements will need to be completed by the applicant and
formally accepted by the City prior to issuance of any building permits on Lot 1
of Block 1 and Lots 1-7 of Block 4.
D. For the storm sewer from CB 5000 to CB 5001, provide a minimum often (10)
feet of drainage and utility easement to the west of the utility alignment. The
drainage and utility easement shall be dedicated to the City prior to issuance of
any building permits on Lots 1-7 of Block 4.
IV. Following approval and recording of the final plat, the following conditions shall
apply:
A. Building construction, sewer, water service, fire protection and access will be
reviewed for code compliance at the time of building permit application(s).
B. Noise issues along the County roadways may arise as traffic levels increase in the
area. The developer and/or their assigns shall be responsible for any required or
desired noise mitigation measures.
C. The developer shall implement the use of Best Management Practices for erosion
control and stormwater management during construction.
D. The applicant shall verify that the tree replacement plan is part of the overall plat
tree replacement plan. The approval of the preliminary plat required a total of
464 replacement trees to be planted. The final plat application for the 2nd
Addition illustrates the replacement of 164 trees. The applicant must verify that
the additional planting of 300 trees has been met.
E. The applicant is required to seed the storm ponds with a native wetland seed
mixture, and erosion control blanket shall be placed four (4) feet on both sides of
the normal water level and around outlets to prevent erosion and sediment
deposits in downstream surface waters.
F. The applicant shall not plant ash trees (Fraxinus sp.) on the site due to the threat
of Emerald Ash Borer.
G. The applicant shall not plant replacement trees in the following areas:
1. Drainage and utility easements containing utilities.

2. Emergency overflow areas.
3. Below the high water level inside easements of storm ponds.
4. County Road line. of sight.
5. City owned right-of-way.
H. The applicant shall meet the city's woodland management ordinance
requirements.
1. The applicant shall ensure that at least every third tree planted along the streets
should be of a different species to diversify the tree plantings.
J. The applicant shall provide the City with a trail easement as needed for the trails.
K. The applicant shall construct a trail to a width consistent with the existing trails,
in locations consistent with the drawing dated August 5, 2005, including a trail
bridge capable of supporting a light-duty pickup or utility vehicle for snow
removal. Costs for constructing the trail and trail bridge shall be the
responsibility of the applicant, with credit given toward park dedication
requirements.
L. The trails shall meet ADA requirements and must not exceed a slope of 5%.
M. Ornamental railings shall be installed in locations as required by the city, of a
design consistent with the City's standards.
N. Park dedication requirements that are required and previously accepted with the
preliminary plat are consistent with the plan dated August 5, 2005. The
contractor is required to resubmit the plans for the park areas consistent with the
attached drawing. The highlighted areas are eligible to meet the park dedication
requirements. The drainage channel is not eligible for park dedication credit.
The land that is eligible is the land above the high water mark, which contains
the trail corridor. The remaining park dedication requirement will be satisfied
with the construction of the trail. The developer will be credited for the trail and
bridge construction. To be consistent with the final plat, the developer is
required to build the trail along CSAH 16 the entire length of the development.
This trail must be clearly identified on the plans.
O. Applicant shall install park, open space, and/or wetland boundary markings at
locations to be determined by the city.

The application indicates a request for Final Plat approval of a residential (R-1B) development in
the eastern portion of the City. The property is Outlot C of the Riverside Bluffs I st Addition and
is located north of County Road 16 (Eagle Creek Boulevard) and west of Foothill Trail.
This review is preliminary, as more comments are to follow with additional plan submittals.
However, I offer the following comments at this time for the applicant and for the planning
department:
General Comments
The following items need to be addressed/completed prior to release of the Final Plat for
recording:
1. Execution of a Developer's Agreement, which needs to include provisions for security
for public improvements within the Final Plat and the engineering review fees.
2. A security, in an amount to be determined by the City Engineer, needs to be provided
until construction of the storm sewer from CB 5000 to CB 5001 to CB 5002 is completed
by the applicant and formally accepted by the City.

Additional Comments on Box Culvert Design
. For two 12'x6' RCBC sections and a future peak design flow of 475 cfs, the headwater
depth is 4.12 feet (elevation is 757.42.) This leaves 1.88 feet above the HW elevation,
which does not provide 50% additional opening as previously discussed. The size of the
RCBC must be increased to provide this opening.
. The invert of both RCBC barrels should match so that the lintel beams and drop walls are
flat rather than stepped. To restrict flow to one side, a 2-foot weir should be placed at the
mouth of the second barrel, as shown on the attached sample plans.
. Consider using twin box sections rather than separate barrels. If separate barrels are
used, they must be separated a minimum of 3 feet to allow for placement of the tie bolts.
. Provide fence at the ends of the 12'x6' RCBC.
. Show profile of 10'x4' RCBC and the profile of the high pressure gas line to verify
clearance at their crossing.
. For all box culverts, show the general section, complete with foundation
recommendations, and the schedule of quantities. The attached plan sheets can be used
as an example.

Based on a review of the application materials provided, staff has the following
conditions for approval:
1 The applicant must provide the City with a trail easement needed for the trail.
2 The applicant must construct a trail width consistent with the existing trails. New
segments of trail intersecting the existing trail shall be constructed to be 10' wide
as generally shown on the drawing dated August 5,2005, including a trail bridge
capable of supporting a light-duty pickup or utility vehicle for snow removal.
Costs for constructing the trail and trail bridge shall be the responsibility of the
applicant, with credit given toward park dedication requirements. Final trail
alignment shall be determined prior to approval of the final plat.
3 Applicant must install park; open space, and/or wetland boundary markings at
locations determined by the City.
4 The park dedication requirements that are required and previously accepted with
the preliminary plat are consistent with the plans dated August 5,2005. The
contractor is required to resubmit the plans for the park areas consistent with the
attached drawing. The areas outlined in green are park areas that are eligible to
meet the park dedication requirements. The drainage channel is not eligible for
park dedication credit. The land that is eligible is the land above the high water
mark. This area contains the trail corridor. The remaining park dedication
requirement will be satisfied with the construction of the trail. The developer will
be credited for the trail and bridge construction. To be consistent with the final
plat the developer is required to build the trail along CSAH 16 the entire length of
the development. The trail must be clearly shown on the plans.
5 The trail must meet ADA requirements and must not exceed a slope of 5%.

1. The applicant must verify that the tree replacement plan is part of the overall plat tree
replacement plan. The approval of the preliminary plat required a total of 464
replacement trees to be planted. The final plat application for the 2nd addition
illustrates the replacement of 164 trees. Applicant must verify that the additional
planting of 300 trees has been met.
2. The applicant is required to seed the storm ponds with a native wetland seed mixture
and erosion control blanket be placed four feet either side of the normal water level
and around outlets to prevent erosion and sediment deposits downstream surface
waters.
3. The applicant is not allowed to plant replacement trees in the following areas:
a. Drainage and utility easements containing utilities,
b. Emergency overflow areas,
c. Below the high water level inside easements of storm ponds,
d. County Road line of sight.
e. City owned right-of-way.
4. The applicant must meet the City's woodland management ordinance requirements.
5. The applicant is not allowed to plant ash trees (Fraxinus sp.) on the'site due to the
threat of Emerald Ash Borer.
6. At least every third tree along the streets should of be a different species to diverSity

We have reviewed the Final plat and offer the following comments:
. On the west side of the proposed plat, it is unclear what the purpose of Outlot 6.and Outlot 1f"are.
There is also roadway easement listed on Outlot g.as well. No access will be granted to CSAH 16
in this location. The existing Outlots should be removed and the roadway easement vacated. Any
accesses that do exist along CSAH 16 shall be removed from the County right-of-way and graded
to match the ditch.
. There is no trail shown along CSAH 16 along this portion of the plat. The grading proposed along
the rear lots lines should consider installation of a future trail.
. No landscaping, ponding, berming, or signage shall be permitted within the County right-of-way.
. Any work within the County right-of-way shall require a County permit.

12, 2009. CenterPoint Energy has reviewed your final plans for Riverside Bluffs Second
Addition dated April 24, 2009 with no revisions as of this date. CenterPoint Energy
approves the plans, conditional on the following.
This approval is based on:
1. A CenterPoint Energy representative must be on site during work surrounding the
natural gas high-pressure transmission pipeline. Call our dispatch office at
612.321.5455 to arrange for a "watch dog" to be on site during construction.
2. Future compliance with the plans during upcoming construction.
3. Please be advised, the plans do not show any recreational equipment in the
easement area, now dedicated as park area. No approval for such equipment
would be permitted in the future.
This approval is based on only the exiting plans referenced above. This approval is
intended as an isolated exception. Any future situations or encroachments must be
evaluated on an individual basis.
Should maintenance of this pipeline ever require excavation, CenterPoint Energy may
have to remove any encroachments, depending on the urgency. CenterPoint Energy
