INTRODUCTION AND BACKGROUND
Council is asked to consider the renewal of Liquor Licenses for the period July 1, 2009
through June 30, 2010. Staff has checked for delinquent property taxes and utility bills.
The Building Inspector has visited premises for the annual inspection, per City Code.
Applications and certificates of insurance have been reviewed for compliance with state
requirements.
Nine applications are not in order for one of the reasons identified in the preceding
paragraph. Council approval of these licenses will be conditioned upon compliance with
all licensing requirements. No license will be delivered until the licensee is in
compliance with all requirements.
An Off Sale liquor license has been issued to James Richard Duerr, dba Shakopee Wine
Cellars. Mr. Duerr has incorporated and is now applying in the name of Duerr LLC, dba
Shakopee Wine Cellars.
According to Section 5.02, Subd. 9 of the City Code, no on-sale license shall be granted
for operation on any premises, which does not have City water. City Council may waive
this requirement for any business having obtained an on-sale license prior to July 1, 1997,
and operating at premises where potable water is supplied from a well, provided that
water quality from the well is tested and approved by the Minnesota Department of
Health in accordance with their standards. Staff has been in contact with the Minnesota
Department of Health, Environmental Health Services. They have advised that the wells
at Stonebrooke, Dangerfields's and at the KC Hall have been tested and meet water
quality requirements. It is appropriate, therefore, for City Council to approve waiving the
requirement of City Code Section 5.02, Subd. 9, which requires connection to City water
and sewer.
The Alcohol and Gambling Division of the State of Minnesota has brought it to our
attention that a few liquor licensees need to upgrade their food license by installing
additional equipment in order to prepare meals on the premises. In order to qualify for a
Sunday on-sale liquor license, an establishment must be able to prepare meals on the
premises. The liquor licensees affected have been advised of this requirement and have
been given two years to come into compliance, in time for the 2011 license period. *

2. Waive the requirement of the City Code Section 5.02, Subd. 9 for Dangerfield's
Restaurant Inc., Stonebrooke of Shakopee, Inc., and for Knights of Columbus
Home Association, Inc.
3. Consistent with previous approval, the following conditions are placed on the
approval ofthe licenses for MCW Entertainment, LLC dba Hater's Bar and Grill:
a. The extended 648 square foot area of the license which includes the deck shall
be closed on a daily basis to the public at sunset and no sale or consumption of
food or beverages is allowed on the deck after sunset.
b. The doors to the extended deck license area shall remain closed at all times
after sunset except in the case of an emergency.
c. Applicant's failure to comply with any of these conditions shall be grounds for
suspension or revocation of the license by the City Council.
4. Consistent with previous approval, the following condition is placed on the
approval of the licenses for VFW Post #4046, Inc.:
a. No alcohol possession or consumption in the patio area shall occur after 11 :00
p.m.
